Hello everyone,
I appreciate any help you may give me on this matter. My fiance is awaiting the information to be sent from the Polish consulate. We filed the I129F which was approved so we are now waiting for him to be granted a K1 visa. His sons are now 18 and 12 and their mother was given custody after the divorce. He did not wish me to put his sons' names on the I129F since they could not come because of the custody situation. So, on the form I indicated that he had two sons living with his ex, but I did not name them specifically. So here are the questions I have. Will the younger son be able to come as immediate relative (no waiting for visa)when he turns 18? Will the older son be able to come with his father or must he wait since he was not actually named on the petition and is already 18? Will he have to wait years for a visa number to come up? Thanks again!

I am so happy!! The petition was approved!! I just received the email today that the NOA2 has been mailed!
Hooray!! Maybe a late summer wedding!!

I hope the best for you. We filed on December 28, got a touch on April 8 but no other email. I waited for a couple weeks and then called. The lady told me she did not show that on her computer. So frustrating! I guess each case is different. Good luck to all of you.

Something horrrible has happened and my spouse has suddenly passed. I feel completely lost and have no idea what to do now. My conditional PR expires in mid 2011. If I understand correctly, I'll have to remove conditions on my own with a widow waiver. This is where my questions begin.
1- Since my conditional GC is based on marriage, am I out of status now?
2- Do I still have to wait until the 90-day window of the 2 year anniversary or can I/must I file earlier?
3- Do I use form I-751 or I-360 (which is a widow's petition for GC)?
4- Is this what the 2009 law change regarding the widow penalty is about? (if so, I'd like to get a lawyer)
I'm not sure I'll be able to afford a lawyer because there is a mountain of medical bills and funeral costs - so your input would be highly appreciated.

Hello everyone,
I am grateful to be a VJ member. Will you please help me understand the process? My fiance's sister was born in Poland and is now a US citizen. She applied in 2000 for him to live permanently in the US and was told it would be a ten year wait. I met my fiance while he was visiting his sister. He returned to Poland, I visited him there and we applied for the fiance visa. The receipt date is 12/29/09. But the fiance's sister is very worried he will never be able to come. Here are my 2 questions:
1. Does the fiance visa allow him to be considered an immediate family member? That is, will he have to wait for a visa number, as he would with his sister's petition where he is considered fourth in preference? From what I understand, a spouse does not have to wait for the visa number to come up, however, he is a fiance and not a spouse yet.
2. Should I be concerned that the visa petition is not yet approved? According to the VJ timeline, some have already been approved at the California Service Center that have NOA dates of 12/29 and after.
I sincerely appreciate any help; I need to help my future sister-in-law not to worry, and me too.

I just mailed the I129F on 12/21/09 and appreciate you all being here for me as I am new to this. My fiance lives in Poland. I met him here while he was visiting his two sisters and their families. Then I accompanied the sisters to Poland to visit him and other family still in Poland. One of the sisters is concerned that the fiance visa will not be issued. She has been discouraged because she applied for her siblings to come here, they waited many years and still no visa so they decided to give up. My fiance was finally given a visa after three denials. We are both law abiding people. I am asking for a little reassurance, not a guarantee--is it likely that a visa will be issued if there have been no crimes committed, or other reasons for a denial?
My second question regards the proof of support for my fiance. I became a full time student at age 51 and have not worked for a couple years. Would that be a reason for denial of the visa? Or is this an issue if he has his own money? He is a co-owner of his business in Poland but also pays support for his two sons. Thanks!
