  1. Hello all:

this is a long and complicated story to tell, so let me make it shorter. It seems that the AOS process is taking for ever, and I am reaching my breaking point.

    July 3,2009: Got married.

    September 04 2009: Filling date.

    October 2009: Biometrics taken.

Nobember 2009: Received EAD, Interview letter scheduled for January 05, 2010.

December 28, 2009: Received USCIS letter in mail indicating that for unforseen reasons AOS interview has been cancelled.

January 05, 2010: Showed up anyway, we were interviewed that day and got a RFE (my(petitioner)G-325 along with two 2x2 photos was missing.

January 07, 2010: Husband took those documents to the local USCIS office in person.

April 2010: We went to an Infopass appoinment. They told us that our file is pending review, therefore we have to wait.

June 29, 2010: Received letter stating that records indicate that our case is pending review.

My husband, the applicant, has called several times the USCIS phone line, and we are told to wait or information we already know. I also check my case online;Request for Evidence, Response Review. It has been almost a year since we filled for AOS, and I had to postpone our traveling plans because of this. Any comments are appreciated.

PS: We are going to contact our congressman this week.

  2. Hello Arren.

On December 24, 2009 I got the same letter cancelling my AOS interview which was scheduled for January 5. So I immediately made an infopass appointment at my local USCIS office December 28. They did not give me any information on my case, just told me to wait for a reschedule letter.

So My husband and I decided to show up at the original interview on January 5th anyway, as some people in VJ had recommended, and since our file was in the office, the officer interviewed us that day at 2:00 pm (three hours later).

The interview lasted one hour and a half. At first the officer (woman) was so mean to us because she noticed that my husband was extremely nervous. So within one minute of us entering her office, she said with a rude tone "sorry, I cannot see you today because obviously you guys are not ready to have this interview today, and i'm not ready for this neither." I looked at her straight in the eyes, and said with a relax and confident tone "ok no problem, we can come back.". So to make this story shorter, she then decided to go on with the interview. The officer asked so many questions I was not expecting. After that she was so friendly, we were joking and laughing. She even took at look at our wedding album (she was smiling). ... she told me that My G325 was missing, and that I needed to mail that form as soon as possible along with 2 passport size photo, then she collected our proof of evidence (Utility bills, joint bank statements, Car title, etc) And finally she made my husband sign some documents.

Today, we are still waiting for the decision on our case, but I am so glad we showed up that day because our application was incomplete.

I hope this was helpful to you, and I apologize for writing such a long reply.

  3. I know my postings on here seem Ultra Stressed and that’s because I am. Before I started dealing with immigration for my husband and our pursuit of his green card I was a rather carefree person.

But he being a HIGH stressed individual and constantly claiming the gods have given him such bad luck that we are cursed and this won’t work he is not destined to be happy and he might as well prepare to be sent back to India right now plus many other wonderful rants of craziness, well it has made me the person I am now. Funny thing is I have amazing luck, I always tend to get what I want so I tell him that well if there is a balance between us then my luck will of course win out just with his luck it will just be harder than anything should be.

Sadly this has proven to be true. So with stupid stuff happening left and right down to even managing to chose a lawyer who hates dealing with immigration law and got stuck with it from her previous law firm (before they went bankrupt) as a specialty. I find myself at emotional wits end.

    So I have 2 questions.

1.) How long does anybody think it could take from when the USCIS receives the packet for the Request of Evidence they asked for on our interview? I know its only been a week since they have received it but I am just curious as to a base possible timeline.

2.) Does anyone know of any support groups available for this stuff? Because I talk to my family and friends and they tell me its all going to be okay but really they don’t have a clue what’s going on as my last family member to come here was over 140 years ago and most of my background comes from the initial people coming over on the mayflower. I have no history of immigration troubles like the beaurocracy of today and my lawyer is almost useless.

Sorry for this to be erratic but well its where I am at right now.

    Hi Meghan,

I also find myself in the same situation. My husband is from Poland, and we submitted his AOS application at the beginning of September.

    October: Biometrics

    November: EAD

November: Interview letter, scheduled for January 5th 2010.

December: got letter in mail December 24, for unforeseen circumstances interview cancelled

( have to wait for a reschedule letter).

December 28: went to infopass appointment. They did not give us any information, just told us to wait for new interview letter)

January 5th: Showed up at the Hartford USCIS office anyway early morning. Guest what, since our file was there, we were interviewed that day at 2 pm.

the officer told us my G325 was missing, to mail that back as soon as possible along with 2 passport size photos.

January 7th: my husband took those documents to the USCIS office in person.

That is a total of 5 months in suspense.. I'm getting more anxious as time goes by. Oh and I forgot to mention that every time I check my case status online, it still say: request for evidence stage.

Remember you are not the only one going through all this. Please keep me updated on your case, and best of luck.

  4. I would show up as well. There have been VJers who have received similar letters, didn't go, and then received notices that their AOS' were denied because they failed to show up for the schedule interview. The left hand at USCIS doesn't always know what the right hand is doing, apparently! (These members were able to get their cases re-opened but it is an extra hassle you don't want to face).

From the way the letter is worded I would say that the problem is at their end - not yours. It could be that they scheduled you with a staff member who is still on holidays at that time, or has to be somewhere else or is working on another issue at that time - or maybe they did overschedule. Other explanations I have heard is that the security check isn't completed yet, or the file is in another office and hasn't been transferred to the local office yet. Regardless, show up for the original date and time. The worst that can happen is that they will turn you away and say the interview was indeed canceled and you will be notified of the new date. The best that can happen is that they will interview you after all.

    Good luck.

Thank you.. your opinion was very helpful.

  5. Hello all,

I am a Naturalized US Citizen, who married a wonderful guy from Poland (L)(L)(L) about 5 months ago 07/03/09, after dating for over 1 year. On September 09, we submitted all the required documents for his AOS. The process was going smoothly until December 24, 2009 when we received this USCIS letter:

This is to advise you that due to unforseen circumstances, we have had to cancel the previously scheduled interview on January 05, 2010 for above application. We regret any inconvenience this may cause. We will advise you of any further action taken on this case, including rescheduling interview information under separate notice.

I am so confused!!!, How could they do this just two weeks before the Interview :wacko:

After reading similar posts in this forum, my husband and I have decided to show up at the interview anyways on January 5. The USCIS office is located on Hartford Connecticut. but I have two questions:

    A) Is it possible that the USCIS found something wrong with our case?

    B) Are they investigating us?

    I would apreciate any opinions.
