  1. Applied for AOS from K-1. We sent a form from my wifes local (abroad)court that states her Birth Cert. is unavailable and it is basically a statement of birth date/place signed by her mother stamped/certified by the local court in her native country. This form was sufficient to quallify for the K-1 but apparently not for AOS (I-485).I have been trying to nail down exactly what evidence would suffice but searching the uscis web site returns too many pages not specific to the subject. Can anyone having been in the same situation guide me to the specific info needed to satisfy the RFE. They also gave a time limit of 87 days to reply....is there any wiggle room in this time .....it may not be easy to secure the info. since she is not in her native country. Any help would be appreciated.have about 70 days left.

  2. My fiancee had her K-1 interview on 7/22 and was approved. She was given the date of 7/29 to pick up her visa. On the morning of the date she was to pick it up she received a call telling her not to come....no reason....was told she would be contacted. It was not the consulate that called but the private company that handles such things for them. Is it possible the decision is being reviewed or re-evaluated?

  3. I am happy to see the info above. I have been totally frustrated in any attempt to get info from Lagos. The Dept of State says Lagos will send letter and after my emailing an inquiry Lagos sends the email re: interview date....several times I inquired as to the letter and never once could get a reply definitively stating the email (stating interview date etc) was THE letter and not to expect a hardcopy letter.

  4. After NOA2 I waited several weeks and with no contact from consulate before calling the DOS.I inquired as to the status of our case...was informed that the consulatehad not yet rcvd our case. I waited another 2 or 3 weeks ... (no contact from consulate) and called DOS again.I was informed that info had been sent to my immigration councelor and that an interview date had been set for July. Counselor had not rcvd anything yet. Waited another 3 or 4 weeks and called DOS once again...this rep told me that my pkt 3 info was rcvd at the consulte (how I asked...since we never rcvd the paperwork)

    Long story short my councelor nor I nor my fiance ever rcvd any pkt 3 paperwork nor have we rcvd a letter of invitation for her interview. After emailing the consulate re: the letter of invitation I got a response stating her interview date was (such a date) and that she should "go to the clinic for her medical immediately" WE never received a formal letter of invitation.

    Has anyone ever experienced this level of incompetency or lack of response/service?

    Curious about others experiences.

    Unfortunately after several non specific email responses from the consulate I lost my kool and shot off a less than flattering email which I must say included a generous amount of begging for a direct response.

    They never responded......Go figure! Hoping we have not now been blacklisted!

    Any input guys?

  5. This is one of those quirky gray areas. There are no explicit requirements or qualification thresholds with the I-134, so consulates generally use the I-864 requirements. However, there are a variety of things the I-864 specifically allows that most consulates don't allow with an I-134. One of those things is allowing two people to combine income to become a combined sponsor. This is because the I-864A is specifically provided for this scenario, and there is no corresponding I-134A form.

    While it's entirely up to the consulate what to accept with an I-134, if they accept a co-sponsor then they will usually require that co-sponsor to be one person who qualifies on their income alone. This means your friend will be the only one to sign the I-134, and he'll need to provide his W2's and other supporting documents to show which portion of the combined income on the joint return is his income. He will have to qualify to sponsor based on that income alone.

  6. My good friend has agreed to co-sponsor my fiance`( as I have just started new job and don't want to chance an issue ). He has sent me his joint tax return for he and his wife as proof of income. Since the return is joint must both spouses sign the I-134. Shouldn't be a problem but would like to know if I must ask them for this.

  7. Two I-134's is the ticket if the Consulate will allow it. You don't mention which country.

    It's only backwards if leave your life decisions to the government. One of your options is to wait until you can adequately support an immigrant spouse before you embark on the journey of bringing them here. You know, backwards from what you seem to have chosen to do.

  8. If you have no strong ties to your home country and are dirt poor the US embassy will treat you like you'll want to come over and stay for good illegally... Good reason!

    My first ever US visa was a B1/B2 valid for 1 year... I don't think I was treated badly at all as they treat everyone the same (with suspicion - if you have nothing to hide, sure you're not gonna stay here illegally then you'll have no problem!) So I used that a few times, when it ran out I applied for another and got granted a 10 year multiple entry tourist visa... It's all about trust, and if you get denied they usually have good reason... That's why I recommend before getting married on a K1 to try and visit on a tourist visa first, you should think twice about marrying someone the US embassy would not even allow into the country as a visitor!

    I understand what you all are saying here but.....fiance went for tourist visa at a consolate in a Nigeria recently. I Have known this lady for 3 years and spoken each and every day for that 3 yrs.....went to visit her in 2008....she has nothing to hide. She was not treated well at interview....interviewer did not even allow her to present evidence of her ties to her country or other information before handing denial note. However today a person flew out of Lagos and attempted to down a commercial flight to the US. ===Hmmmm?
