  1. Hi,

    My fiance has an interview next Tuesday but he lost his police record. It will take 8 days to get a new one issued and he really doesn't want to lose his interview date.

    But he has a scanned copy that he made before he misplaced the original. Is it ok to bring that only?

    I am sure they'll ask for the original, but can he just bring that back to them 2 days later? Or do you think he would have to wait weeks to interview all over again?

  2. Well, I guess I'm a little confused now. I thought we didn't have to worry about entering the U.S. with intent to marry as long as we showed she didn't intend to immigrate and would be returning to VE to complete the K3 process?

    I think it's just cleaner if you do it abroad. That way there's no question of lying at entry points. But I don't know anyone who's married in US and then applied for a K3.

    K-1 is the quickest option, and for us there was less visiting time in the US before he could apply for a work permit after our wedding. So our decision on WHERE to have our wedding was also a financial one (and emotional since being unemployed and newly immigrated can be very lonely!).

    So, since K1 is quicker (and you can visit the petitioner while both a K1 and K3 are in process), I don't see why you would choose K3 over K1.

  3. I think you'd run less risk if you were to marry her in Vzla, start the visa application process, and then have her come visit you with the proof of intent to return. If they find that she had intent to marry upon entering the US on a tourist visa (I've heard they can read emails, etc.), they can bar her entry for several years. We just did a fiance visa, and though we seemed to just get lucky, it only took us 3.5 months from submitting the packet to his interview date! Buena suerte!

  4. You can't count on anything's being looked at that's taken to the interview. Can you e-mail the consulate ahead of time? If you have scanned documents to attach in order to bolster your case, you can do that; or, at least provide COMPLETE contact information for people who can vouch for your reasons for not being there, si man.

  5. Yep - Gross annual income before taxes and deductions. You can interpolate the current years income but it cannot be proved since it is not "real" income yet and in this economy nothing is for sure.

    For factual data, provide your latest years salary. Submit a Letter of Employment from your employer stating your salary or pay rate, hours you work, how long you have been employed, full time / part time, etc... all relevant information and have it signed and dated by a authorized company individual.

    Provide a minimum of two years tax returns and w2's, bank statements and pay stubs. Check out the guides here on VJ, they are very helpful.

    I included the following:

    I-134 cover letter (optional)

    Complete signed and dated I-134

    Letter of Employment

    Most recent 6 months bank statements

    Most recent 6 months pay stubs

    Copy of Tax returns for 1040, 1040A and W2's (atually I forgot the w2's but there was no problem - whew)

    Everything included was outlined on the cover letter including our case number, names, consulate address etc...

    "Application Type: I129F , PETITION FOR FIANCE(E)

    I actually grumbled when I first saw it b/c I assumed it was an RFE! ;)
