  1. The same thing happened to me TODAY! I sent my papers off and was rejected with the same message. Check was made out for $590 to Department of Homeland Security. On the bottom of the Notice of Action page it does state that the checks and/or money orders may be payable to "Department of Homeland Security" or "U.S. Citizenship and Immigration Services". lol However, above that its says" Since the reorganization of the INS into three new agencies under the Department of Homeland Security, there had been confusion regarding who remittances should be made payable to. Unless specified above, your application is not being rejected for incorrect payee information.

    So why they check incorrect or imcomplete gaurantee amuont is beyond me especially if thats WHAT THEY TELL YOU TO MAIL IN!

    I have been on the phone with them all morning and no one can tell me whats wrong with my application. They are soo frustrating.

    Since we had similar problems I think I'm in a better position to tell u what to do. I simply went to bank of america and drew a cashiers' check for 590 dollars to "DEPARTMENT OF HOMELAND SECURITY" and I eventually got my first NOA today.Goodluck!

    It's been a long time since I've been on his site,I'm glad to be back though. Recently,I submitted my application for ROC and it's been returned back to me TWICE now. The reason according to them is 'the remittance you submitted has an incorrect or incomplete guarantee amount'. Also below in the green letter they sent me,it says "Your application/petition is being rejected for incorrect payee information.To ensure proper processing of your application/petition,please make checks and/or money orders payable only to Department of Homeland Security or U.S. Citizenship and Immigration Services"

    has anyone come across this kind of statement before pls I need help.I wrote a check for 590 dollars to Department of Homeland Security and they still returned it,I really don't know what I'm doing wrong.

    A little side info; you were informed but might not have paid attention to it. It's on the i-864, affidavit of support, and also mentioned elsewhere.

    Also worth mentioning is that if your spouse is your sponsor, he/she needs to file a sponsor change of address form as well. So there are two separate change of address forms you'll need to file.

    I filed my AR-11 as soon as I moved, but forgot about the sponsor form until a couple of months later. It was received and accepted without any issue.

    Please I need help with this situation.I'm about to file for removal of conditions on my green card,and as was studying the form on uscis website I came across the change of address information and the implication if not filed.I've moved since january of this year and I never knew about this filing of change of address and now I'm about to file for ROC,what should I do people? should I go ahead and just file for the change of address even though i'm 6months late already?? Please help!!!!!

  5. As I will not be at the Embassy Interview, I have ask my wife to write up a description of her interview experience. That might take her a little while. She will be leaving to Manila in about 8-10 hours and spending the night in a hotel there so that she can make the 0630 appointment. I am confident that this experience will seem anticlimactic resulting from the time it has taken us to get there. I think it will be more procedural than anything else as they know more about me than my family does. So we will give Caesar his do and pay proper respect to ensure we get our approval.

    I would like to see a 100% approval rate for all November VJ interviews we have listed. Keep the faith and know that we have done our preparations thanks to the information of those who have gone before us.

  6. Got Approved for my Mother and Father as of 1210pm .....

    We did receive a BLUE PAPER because my mother failed to take addtional documents with her.. (old passport with active us visa) ... Feeel free to checkout the detailed Embassy review for the Jamaica consulate after 30 min. from this post...

  7. Thanks for the concern. I used two of my senate reps almost a week apart. The fist one told me late last week that the consulate replied him that we were married according to the Nigerian custom laws when my fiancée admitted I gave some gifts, hence they could not issue us a K-1 visa. I was hoping to get a positive feedback form the second one who told me she has not gotten any response from them yet and would resend the appeal today. I was still optimistic until I saw the next response to this topic after yours.

    Thanks for the info. Up till now I was still hopeful, I guess I have to move on. Actually, one of the senate reps I am using got a reply from the embassy and was told that according to the Nigerian customary law we were married, hence they would not grant a K-1 visa. I was hoping the second senate representative would give me a better news ...I guess I should not expect anything different from her either. Thanks for the heads up, now I have to plan a trip. Could you please tell me how long it took you to get your interview the second time when you filed for the spousal visa?

    Well I'm still waiting for the interview,our petition is still at NVC.

  8. Ok so, I got a reply to my email from the Lagos Consulate today. In spite of my whole clarification and appeal and explanation, they said the case is already closed as far as they are concerned, and that they are going to send back my petition to DHS/USCIS. They told me to direct all inquiries about the case to the DHS/USCIS. So cold!!! I called the DHS and explained the misunderstanding, and the DHS told me to wait for my petition to get to them first, so they can review and decide. My representative also said he sent them a note today to reconsider, but he has no guarantee that they'll listen. Told me it could take 2 to 3 weeks to hear anything. At this point, it's a waiting game. Anybody have any experience as to how long it took for their petition to be returned, reviewed and reapproved? It feels so helpless and frustrating to be so powerless!

    Hello Tero,Firstly I'm so sorry for what happened with ur petition.This is exactly what happened to me during my interview early this year,the CO said we were married cos we did introduction and also gave gifts.I later found out from the registrar of Ikoyi registry in Lagos that introduction/engagement are regarded as marriage in Nigeria's customary laws.We were left with no other choice than for my fiancee(now my wife) to come down and quickly went to a registry,collected a marriage certificate then file a spousal visa.

    My advice therefore to u is to come down here and get married then apply for a spousal visa just like I did.Why?This is because it took a total of about six months for the embassy to send back our petition to USCIS and for them (USCIS) to reach a decision which they ultimately denied.So my brother,u have just got to be very fast about it,forget about the K1 and move on.

  9. Hello everyone,

    My petition has been returned by the embassy to USCIS 3 months ago. When I called them for the status update, I was told to wait 100 days for the case to be reviewed. After 100 days, I called them again. Now they tell me that minimum wait time is actually 120 days (4 months). What if next time they'll give me another time frame? It's been almost 2 years since I started the fiance petition process. I'm so upset :crying: :crying: :crying:

    I'm tracking the status online and they say there "We'll let you know once the case is reviewed." Basically, there's no time frame at all!

    Has anybody been through this? What's the average wait time?

    Sorry mate! Well during mine it took like 6 months!Actually,I do not know when the embassy sent it to USCIS,but I was denied on the 7th of January and I got a reply in first week of August.It was eventually dismissed.Hope yours will be be faster and won't be dismissed.Take care.

Hey NigeriaorBust,I was just reading through ur post to some guy that got denied and I realised u applied twice due to denials.I just have some questions to ask u if u don't mind?What happens to someone like me that got denied on K1 bcos I did introduction and the CO regarded it as a legal wedding.Now we have filed another petition on CR-1/IR-1.Can u help pls?I just wanna know wat to expect,Thanks.
