He said he is just waiting for my status to be fix and once I get back to the US he said that when we will file the divorce.
He is really insane now yes he was nice but he is an asshle now...Calling me while his with his mistress, Sending me emssages like Happy New Year I fell asleep at the ladys night PARTY hahaha...
So he is being an asssskholle here he doesnt wnat and marr counselling either.He jsut doesnt want to be amrried he wants a freedom.That is all,I asked him is this temproary or permanent thing witht this Mistress he said TEMPORARy, are u 100% happy he said NO,but He is enjoying it.
He is completely a different person now:(
I just dont think I can be with this person after all:( Im scared to turst hima nd love him again and again Itried to convince him to change his mind but he doesnt want me there or with his side.
He asked me for some time before not knowing that he is cheating and who knows not just one girl....GIRLSSS maybe.
I want to have my own family again and he doesnt have that capability to be responsible,He is spoiled since only son,and if he doesnt get his way he WILL BE MAD AT ME.THATS why he always control me and dictating most of our decision as a couple.AT first he is very giving and all and then He slowly changed.I guess he jsut coudnt have a steady gf. Well agree with Laser1. You guys need a thorough marriage counseling asap. You were in love and that's for sure. From your post, it's really hard to tell that he hates you or deserts you whatever. His cheating is not from his own problem. You are also responsible for that. It takes two hands to make a clap. If you are whatever he wants to hold still, he wouldn't have done that. Just wake up, don't pick the partner for everything you think which is his faults. As long as you feel he still feels you in his heart, not to say 100% which is impossible, move on with that, and hug him for a long discussion and marriage counseling. Good luck.

I am badly hurt and love him so much until now and I just coudnt accept the fact that he cheated on me so many times and forgive him over and over he cheated on me on the 1st year of our marriage only found out when I moved with him in the states I went through his computer and saw evidence of him cheating on me ,THIS IS after 2yrs of our marriage when I foudn out.He was apologetic he said its nothing they are just talking and all,
we moved on and we were happy again I forgive him and then few months after he did it again with few different girls in different states where he has to work.Was going to leave him but I couldnt since I love him so much.
Its so painful whe u trusted ur life to someone that u think is worthy with ur love.
ANyways I want you guys to know that I stayed with for 5 yrs becoz I love him until now its just sometimes you have to know what ur options are I just wnt to know all the negative and positve effect of all the action that I am planning to do.
Having my 13yrs GC instead of 10yrs I was given 13yrs since we were able to show them that our marriage is real and not for the sake of getting GC or being in the US.
I was doing okay here in MANILA I am educated has BAchelors degree Im not from any juicy club or bar I am bery hard working and was able to find two jobs in GUAM and one job IN the states.
SO the fraud is not an issue here I just want to know which is better to file a divorce sooner to get what I deserve.
OR to wait for my CITCIzenship...
SINCE I only have few months just to complete the requirements but then again I mvoed back to MANILA to study another DEGREE becoz he wants me to get a high paying job.
I udnertand tht thats why I came home and sacrifice being away from him for a cheaper education.
I am staying here in Manila for 8 months now.
and as far as i know I have 6month -12months for me to be away from US.
AND i cna show the immigration that MY address is still in GUAM US territory.
AND even in my school records I put down our GUAM adress.
ANYWAYS the bottom line is if someone cheated on you and u love the person and u are married ITS NOT EASY to just give up on the relatioship itself...I waited for him to change BUT I guess he will never changed .
I thought we were OK before I left GUAM.
Anyways I talked to him he said he wanted me tojust move on and leave somewhere else but not GUAM and he will still support me even IF we get a divorce.He is actualy being helpful since He knows what he did and how badly hurt I am.
He is making alot of money compare to me.SO I was jsut wondering about the spousal support that I cna atleast get from him since I need to get a job again once I come back to the states or GUAM.
NOW should I file the divorce IN GUAM or just go somehwere and FILE IT there ....
DO I have to be in Guam again to file our divorce.
Some says wherever state you are that where you file the divorce.and some says file it to where we live as a married couple which is GUAM.
I will comeback this JANUARY to save my greencard too.I just dont want to have a problem with Immig.
ANYWAYS my plan is to move back to Guam and find a new job and get a divorce.. he said he will file it and will pay for it.BUT he is completely against the thought of me coming back to GUAM so he can do what he is doing there now.
I just want to move on really I want to move somewhere else too but all my credentials and ID's is still GUAM it will be a pain IF i have to move now in the middle of eveything and change all the ADDRESS and ID's.
Thats why I just want to move back to GUAM just to get my job back and save up....
I am really not greedy..IF I am we wont last for 5yrs.becoz he doesnt give me anything no credit cards nothing like tht no house just renting no plans of babies no car ...
So If I am greedy I will jsut leave him and go find a RICH man to be with.BUT I am not like that I still believe that LOVE is the most important thing than MONEY,,,,
coz if you really love each other you can work face and face all the finacial challenges.
When he lost his job back in the US I didnt leave him I continue to support and love him coz he is so depressed.He is also alcoholic but I help him to stop the habit.
SO now I can honestly say that I am not greedy and I still love him.

I just want to welcome you to California.
As you may or may not know, California is officially the Golden State. As such California has attracted gold diggers for way over a Century. You'll feel right at home here. Weather is nice too.

You are so ridiculously out of line here it's not funny. It is HIS choice to cheat. She plays no part in that. She does not control him. He makes his own choices. A good man doesn't cheat, no matter what "she does to cause it".

It looks like you and him have taken on a plan that is too ambitious for you to carry out, to save money. I recommend that you and him go to marriage counselling.

Isnt too weird to do that?I know I really work so hard got two jobs to make him happy ,and he does 1 job and its a big paying job.He is just selfish to cover most of the expenses of our marriage though I work hard he said its not enough to cover all of our expenses which I cmpletely understand since He wanst happy with my joband schedule I really have to keep up with his schedule.
Its jst hard we were so fine and inlove for 2 yrs and after I move to the STATes things changed:(
I guess its really hard to love someone that is not really committed to the marriage.
He already told me that he wasnt really ready to get married.He dosent want to have kids,he just want to travel drink party and all that single life.
SO marriage counselling is not an option for him.
I already suggested him of doing that so many times and he said NO.

Hello everyone,
I jut want to ask some questions regarding my situation right now I am
married for 5 yrs, we are still married, got married in the Philippines to USC And I just have few months to get my citizenship but moved back to the Philipines for cheaper school and husband cheated while he is in Guam working after few months now I want to know what are the rules if I want to divorce my husband after I got my citizenship?
We are really miserable since 3yrs but been very happy for 2 yrs.We are friends and talk things smoothly that he will still support me and all until i get back on my feet.,but I don't want to rely to whatever he say since he is seeing another girl now.while I am here in the Philippines.
Will I get an alimony if he lives in Guam ?and I will move to
California? And got a 6 month residency there? Riverside County to be exact.
We lived Guam for 1.5yr 2010-2012 and before that we lived with his mom
for 1 yr in Florida 2009-2010. I live here in the Philippines 2007-2009 during our marriage.
We never buy anything except car when we got married.Using his hard earned money.
I worked for just 1.5yr in the states GUAM in a hospital and its just 10.50./hr job ...I don't have money now since I
am just studying right now while he supports me.He said he can save money by doing this cheaper education and wait till i became a nurse then our income will be much better.
I got two jobs while I was in Guam and still hubby is not very happy with my income and with me.Fights arises here and there cheating and all those kind of drama.IM tired I did everything I could to make him happy he doesnt want a baby yet since MY income is not big enough.for 5yrs I put up with his sshitt.Im just tired.
And he is earning good money like 80 grand a year.
What should I do I want a divorce but I don't have money right now but
will move back to the states this March to work again and to get my
citizenship. Save money and divorce him eventually.
He said he doesnt want us to get a divorce he just want I guess to fuuuck around and wait till I become a nurse.And if he thinks he is done with all his cheating he will come back to me.
WILL I get an ALIMONY? I know that it all depends on the state of residency of the two.
Please let me know what my options are.

Red flags no don't worry it's just that I've said earlier that USCIS have their own reason why they did that, plus they will tell you to send more evidence if they are doubting you and your application.
So for now just wait for any notice from them. Okay

Case are being transferred to whoever are assigned to your case. Not so sure why though because in my case I remember they also changed or transferred us from and to other states Just like what happened to you but wasn't relly sure why I just can't remember it's been 3 yrs I guess.
Don't worry they will send you more notice of action to let you know what to do next.

Thank you guys for your helpful response.
I have physically stayed in the US for 2 years and 7 months.
And I just took some vacation over those yrs for 3 times outside the country.
My address is still under the US soil which is Guam, and for "physical presence elegibility " I guess I am more than eligible (18months or 1 1/2 yr) versus 2 yrs and 7 months is more than enough .
It so happened that I left Guam or US soil 4 monts ago this april 2012 coz my school started then.
Basically or technically I am still US resident ,all my documents & address I still pay taxes ,I have drivers license of Guam And insurance,so If I come back to Guam this October I can just say I was out of the country for a valid reason or important purpose (education).
Plus I did not intend to live outside the US I just intend to study outside the US.
What do you guys think ??
What is this 3 months thingy under US jurisdiction ? Is it really have to be "physically present" for the next 3 months before applying? Coz if that's the case I can't prove that haha.
And I also read that if you were outside the country for the next 6 months you can't apply for Citizenship??? Have you read this guys?

Are you now working as a staff Nurse? I have no plans of getting a board it taking an exam here in PI I just need to study here and take the NClex over there.
My friends are there in California they are all nurses and studied here Too but did not have a problem I'm so sorry to hear about your school thing.
I a resident of Guam formerly from Florida but will get all my NClex requirement for Florida because thats where all my relatives husbands family are from and I got my CNA license there too and they are not very strict or they are just being fair....
So I don't think I'm gonna have a problem about my school it's good ...

My suggestion to you is get your citizenship first! You are eligible now but if you will continue going back and forth to PI until you finish your school, then you might have a problem. Remember, two of the requirements for citizenship application are PHYSICAL PRESENCE AND CONTINUOUS RESIDENCY. Even if you go back and forth to US just to break the 6 month rule, they can still deny your application.
If you are not really in a hurry to become a citizen, you can apply for re-entry permit BUT that does not preserve your residency, it only protects your green card from being revoked. If you choose to apply for re-entry and have finished school in two years--let's say, 2014...from 2014 count 4 years and 1 day for you to be eligible and that would be in 2018.
The opportunity is right in front of you to apply for citizenship NOW based on your Marriage. Don't wait till its too late. School can always wait but your elegibilty to become a citizen knocks not too often.

Hi Gibby, thanks for a quick response. I know and I have read online "USCIS" (website) that I cant apply a citizenship if I am outside the country for 6 months, which I will be from April 2012 - October 2012.
Plus I have to be there physically 3 months straight before I file the naturalization. And I can only apply the 90 days thingy before my 3 years anniversary which was last JUNE 2012, they said if I missed it then I can't apply the 90 days thingy
So I just have to wait until I finish school.It stinks that I am goign through this sssssssshhhhhhh!!!! I just find it difficult for people like me who wants to save money for education and for immigration. The bottom line here is USCIS are being so smart of getting money from people like us. Every move will cost you 300-700USD for all the documents and paper work.Its just too much:(
Coz re-entry permit cost 380USD almost 400USD.... I need to get this twice in 4 yrs.
Theres also the N-470 that protects my residency or my intention to apply a citizenship this cost as much as 400 USD:(

If you become US citizen, then you can live outside of country for any amount of time. There is no time-limit. No re-entry permit is required. But you are required to file taxes every year ( even you are outside of country ). Not sure how it effect if someone doesnt file taxes but if he/she is a naturalized USC.

This is not what the OP has asked.
To the OP: As long as you can prove that you have not abandoned your residency, and not exceeded your stay outside of the US, you should be ok. But it will be difficult for you to make them understand as to why you are living seperately from your husband. Trust me, I have been around the world, and education is cheaper here than anywhere else as long as you are a resident. That is if you are talking about QUALITY education. Good Luck!

I just need clarification on my case. I am a permanent resident of US for over 2 yrs now.I arrived the US last Sept 2009 ,Sept 2012 will be my 3rd year to apply US CITIZENSHIP,(married to US citizen). I got my visa thru my US citizen spouse."CR1" visa after 2 yrs I was able to lift my conditional visa. After that I got my 13 yrs greend card.
I just want to know If I can still apply US citizenship If I am outside the country for the next 6 months . I am here in the Philippines for 4 months now,I left US last April this year to study outside the country because its cheaper here in Asia.I am planning to apply my citizenship this OCTOBER. As being married to US citizen the rule is after 3 yrs of being in the US they said you can apply 3 months or 90 days before your 3 yr anniversary, my anniversary will be on SEPT. 2012 next month. Meaning I can apply it JUNE 2012.But I am here in Manila studying again for 4 months now,after two months OCTOBER our vacation I will go back to the states and thinking what to do.Either to apply citizenship , re-entry permit or just go back and forth every 6 motnhs "every semester break?
I am wondering if I am allowed to apply citizenship when I left April this year and will be back to US on OCTOBER on our school sem. break. I am planning to stay in the US for a month of my school break, while on vactaion I want to apply US citizenship...My husband is in the US so he can just file some of the paper work for me and I will just fly back If I need to be there for an interview or biometrics.
Some advise me to just get a re-entry permit that will allow me to be outside the country for 2 yrs. I just got in the nursing program and this will be for 4 yrs.Im only on my 1st year. I need to know which path to go to.
I am thinking of getting my citizenhip or re-entry permit which way is better and to save money...
CITIZENSHIP has rules and regulations I know that i also read their website some are confusing though...
as well as re-entry permit... please enlighten me here.
Some says and one of the GUAM USCIS agent told us if your US LPR or resident you can be outside the US with in 6months or with in 12 months...And the agent said that it depends on the immigrations officer.SOME are nice to just let me in the country with no hassle and some wont....
I am just confused,,coz my total stay in the US is not exactly 2 yrs and 9 months... Im lacking 2 months...

I didn't have to show CFO/GCC when I renewed my passport.I guess it depends on who you are talking to.I went to the Philipppine consulate here in Guam. The guy just asked me for my marriage cert., he is also looking for my Birth Cert. I said I was told that Only Marriage Contract/cert. Is enough.Because if you are hettig a marr.cert. ofcourse they "already" asked for our birth cert . I tol the guy it doesn't make sense to ask for my birth cert. "again". He realized it too so no other documents aside fr my "Marriage Certificate".
The answer for your 1st respond for why we didn't change my name when we are filing out documents or paperwork the very beginning? It's because as usual all of my Identification is under my maiden name my passport and all. We just want to match all out paperwork .

Hrllo Dave thanks for your help, yeah it's kinda weird because its easier for mento change my last name in y passport as long as you show them your marr. Cert. Your good. Yeah it's such a pain to change last name when women got married:)
Theres no harm in trying I will just try and explain thoroughly fr them to change it:)

hello Everyone pls help me with this one.
I just have some question hope you can enlighten me with this one.
I just recently change my last name to my passport maiden name to my married name, I just renew my passport last week because it will expire this March 2012. Now the agent fr the consulate told me if I want to travel just bring along with me my marriage certificate all the time for me it's not a problem ,,
my question is can I also just change my name to the I 751 form that I already sent them ? I sent the form i751 last August 2011 using my maiden name , then they requested us to send them more evidence ,the Request for more evidence / or "the RFE form", I was just thinking if I can resent the form i751 and fill it up again and change my maiden name to my married name then just attach a letter explaining that I would like to change my last name.I'm also done with my biometrics and it's on my Maiden name I don't know if I should just wait to receive my new green card and use my maiden for the mean time I just don't want to Have a problem with my paperwork and with the immigration I want all my id's to match, like my passport and my greencard ,
I don't know just wondering what's the best thing to do.... Should I just wait for my greencard and apply for citizenship after few months and there just change my last name or change it bow since we are going to send them back the RFE ... The USCIS advised me to did this. resend and write a letter.

Question me and my husband are going to file the removal of condition form I751 I just want to know if my husband need file the I 865 since he filed the I 864 for me before...
Because we called uscis & they told us two different answer
U did change my addres online Filed AR11 since I am not us citizen and then it says there on their website that if u are us citizen and have moved u have to file I 865 to notify them if he or my husband as us citizen filed an AOS for me before that form is I 864
Pls enlighten me

Try to wait till you tie the knot here in US because it's such a pain to change last name I have the same problem I just retain my maiden name for now once I become US citizen that's when I will change my last name that's the best thing to do

because When they started PROCESSING THEIR VISA is BEFORE the 2 yr ANNIV or their wedding I guess thats why they gave YOUR WIFE a CR1.YOU HAVE TO call THEM to let them KNOW about your situation.
