You are exactly right. I just called customs at the airport I arrived at and they did indeed make an error, giving me 90 days in line with a K1 visa. I have to go back and have the I-94 re-issued with a date corresponding with my K3.
Thank you

I entered the US on a K3 visa (with child on K4) on the 13th Dec to join my US citizen husband. The visa is valid until Dec 2011. Perhaps I am naive, but I thought that I could stay in the US under this visa until Dec 2011, during which time I could either change my status or wait for my I-130 to run its course.
I only noticed last week that our I-94's which have been stapled into our passports state that we were admitted on Dec 13 2009 on class K3/K4 until March 13 2010. It says on the back of the I-94 that we are authorized to stay in the US only until the date written on the form, ie March 13 2010, only 90 days after our arrival!! I thought that this must have been an error.
I called the USCIS and they say that I have to leave the country by March 13th if I have not filed for my adjustment of status by that time. I was unprepared for this, I thought I could adjust at anytime during my K3 validity. I do not wish to apply to adjust before the 13th March, I had planned to wait until the summer. It could be that I decide not to adjust at all and just wait for the I-130 but it appears that this option has been taken from me.
Is this usual procedure? Any advice would be appreciated.

Got my notification today on DX website. My visa will be here tomorrow. YAYYYYYY
Hope you get yours sorted soon Richard

I was told my visa interview would be 6 to 8 weeks from them receiving my checklist back, with at least one months notice - I was given 10 days notice!!!
I would honestly prefer it if they said it would take 4 weeks to process the visa, then I wouldn't be sat here worrying.
I called the visa non-information line earlier, they say I can't make an email enquiry about my status until 15 days after my interview, to thats a week away. Great.

Still waiting here as well Richard.
The lack of information available on the premium visa helpline is very frustrating. It would be nice to be able to talk to someone who actually does know what is happening. When my visa was approved on the 30th Nov they said it would take 3 to 5 days to reach me. A lot of others have recieved theirs in this time. Now the helpline say that its 5 days before they even look at the visa. So what is right???
Just hoping that they have not lost everything, getting a new passport at this time of year will be a nightmare, argghhhhh.

Except for me, getting rather worried now

Well done for you guys.
Mine is still not tracking on DX

Also approved on the 30th November and nothing showing yet.
I wonder if they do certain visa's quicker than others.
Its getting very frustrating

I had my interview and was approved on the 30th November too. I was also told 3 to 5 business days, but still no sign and not on tracking system. Phoned the embassy and they now say it could be posted any time up to Monday 7th and if I dont get it by Weds 9th to ring back (on premium line of course). Hope I am with my husband by Christmas
Did you get as wet as I did standing outside in the rain? What fun!
Child not included on I797
in Removing Conditions on Residency General Discussion
Posted
I recently filed my I751 adjustment of status, including my 7 year old daughter in section 5 and paid biometrics for us both.
I have received the I-797 Notice of Action. It states that MY status has been extended for one year but does not include or mention my daughter anywhere. The ASC appointment notice will follow.
Is it usual not to include children on the I-797? Has her status also been extended?
