Got my approval letter in the mail on 9/24. The letter came from our local USCIS office. It states my permanent GC and the 797D will arrive in a mailer in next 60 days. After that I checked my USCIS website case status online and that isnt still updated and says Initial review. So I would suggest wait and you may hear back form your local USCIS office.

ah..ok..

well I called in yesterday again coz I sent an email requesting expedite on scheduling the case.originally my case decision was to happen on 6th May, which it has not and has gone in sme further review transferred to a different department??? which is supposed to take another 17 days making me end up on 27th, thats way outside the 15th deadline. Anyways point is she said they will send out the case to mumbai within 48 hrs of decision..lets hope that still happens sooner

"Per latest telephonic inquiry our case was accepted by NVC on 04-18-2011. After the 15 day period for "final review", on 05-06-2011, the case was not decisioned and is currently pending further investigation. The "further investigation activity" will require 15 more days for processing upon which, the case MAY be approved and forwarded to the above mentioned consulate. Since this 15 day period is beyond the cut-off date of 05-15-2011 for the consulate to schedule interview, it is more than likely to be scheduled in month of July. Is there any expedite process, post the decision, to forward the case to Mumbai Consulate, so the interview can be scheduled within June time slot"

Our case was admitted into Final Review and I do not recall of filing for EP. If you speak to the operator ans ask the status they usually tell you what stage the case is at. I usually do a twice a week follow-up with the NVC live person.My 10-15 days period was done on Friday 6th may, so I checked back again and they said some "Supervisor" is reviewing the case. I am getting really anxious as the cut-off dates for interview scheduling are May15th for Mumbai, for June interviews.

Read all of posts about the ITIN application unfortunately after i got the rejection notice from IRS..

I had sumbitted

1. notarized copy of birth certificate

2. notarized copy of marriage certificate

3. notarized copy of birth certificate

As seems to be the case, none of the notarized nonsense seems to works.

I have unfortunately sent my wifes birth certificate for DS-230 and dont have the original to submit. Would just a voter-id or another government photo ID (i.e. PAN-TAx card?) work ?, alongwith a plain photocopy of the passport?

I will try to enquire with the wife if she has other true copies of her birth certificate, but if that doesnt turn out to be so, I am screwed..

alternatively.. how hard is it to get an Appostille in India? any idea?

If you are referring to the police clearance certificate, my fiance was told that at first too, but what they really needed was 1,000 INR. The Delhi police clearance certificate took my fiance 3 weeks to get...we've been trying to prepare in advance as we probably won't even receive our NOA2 until late April.

Try printing out the requirements from the internet and taking those along with your NOA letter(s) to the police. If they still won't process the PCC without the packet IV letter from the consulate stating that you need it, then have your wife speak to a policeman in her neighborhood, not at the police station, and inquire if there are any "fees" she can pay to have this process expedited. Your wife will not get a receipt for having paid this fee. I don't know about your wife's city, but in Delhi, you also have to present two people who will attest for you that you are of good character and they have to have proof such as a voter ID card that they live on your block.

If you are referring to the passport clearance certificate, your wife should go to the passport office that issued her passport. It should only take one day to get it done, no mystery "fees" involved and they won't need the letter from the consulate.

We had used a copy of the 1st NVC letter that basically tells you a case# is assigned.. The PCC should not need anything more than that.Besides from that the usual drill of proofs such as attested passport,residence proof, maybe a copy of marriage certificate etc..

For proof on 864 i have my previous years 1040`s and not the "tax Transcripts" per say. Also I was planning on submitting the filled out 1040 for 2010. Do i have to wait till my tax returns get filed and then use this 1040?Or I can provide that for my wifes interview at consulate? I imagine the filed version would take ages to clear out..especialy when I am submitting it with the ITIN application..

If I'm not wrong, on the AOS it included an employment letter which contained our rate of pay. I also included my last 6 months paystubs. This had the year's total on it (December 31st paystub) and current ones till I sent it in. If you are self employed, you may need to consult a power greater than me. I'm not sure on that case. It's a tough calculation to try and guess how far you are to being able to bring your wife over. I'm not sure of the timeline of the consulates in India.

There was a quite extensive discussion of the proper ways to file in the CR1 IR1 forum. Married filing taxes It's long but helpful if you decide to file prior. My accountant said the route we're taking makes it very easy on all involved. Best of luck Swap!!

My wifes application is at NVC and i paid the IV bill . Based on various inputs I am going to submit my 864 with the coversheet page. As i recently started earning regularly I wanted to include my `10 tax papers as proof of income. Going thru the taxes I realized that to claim the " married and filing together" I need a tax ID for her and hence need to file the W7 for her ITIN. However isnt ITIN is going to take a heck lot of time and also isnt it just for non-immigrant visa holders or does it apply to general spouse of US citizens? I know this is a tax question but I asked nevertheless. I am in a dilemma as filing married would help our case not to mention the greater refund, but filing single would get my 1040 filed sooner..

Any advice is appreciated..

Me too had filed for my wifes i130 which returned back coz of part c address, but I think I actually l had a mistake. in the notice of rejection they usually state name...dob..country of birth as such..In my case it said Country as "Unknown" I checked my I 130 and its screwed up coz i filled it online so the form did not accept State/Country altogether ..as a result they can see only state after printing it and a big + sign..so it was not clear.

But like ur case i have stayed in India and both of us have studied pretty in same schools till 18. We got married this June`10 and I stayed in India at my parents place for 2 weeks only. I put that 2 weeks as duration of staying together..

anyways lot of stuff i guess

letsee m a bit angtsy coz u never know what the USCIS guys r expecting..

All the papers i sent in my application has a series of numbers printed on them.Also on the check. So they can easily figure out that the new i130 which i will be sending is revised ..just want to know if that would be alright..

Just another lingering doubt..the Part c employment section ..is it pertaining primarily to the US employment if existing? my wifes never worked in US.Shes worked in India only that to self employed so I have put that in..

If you are talking about Part C & #2 address - Then put only as India and Zip/Postal Code will make it out is as Maharshtra state. Apart from this you will also mention spouse oversea address in #19 there you can give it complete address state/country.

Even for Place of birth question you put name of city and India as state/country of Birth.

From what we read as filing instructions in the i-130, we made the affidavits..Do they need financial co-ownership or common residence as a proof? We havent really lived together prior to marriage or after. Coz I was there for just a week, later after the marriage, I had to fly back here..

Also the wedding pictures proof is needed during her actual interview..i am not submitting them with the i-130 now..is this correct??

No, the documents in the miaden name shouldn't hinder you, they didn't for me. The visa will be issued in the name in the passport and the green card in the name on the visa. If you intend on changing names, do it before the interview to avoid costly name changes in the US

No, affidavits are simply the word of someone, most people don't include them preferring to focus on primary evidence
