  1. Hello to all!

    My cousin was approved last July 30, 2013 (F2A). We keep on calling NVC but, the answer still the same: " Case is not in the system yet. It will take 8 weeks to deliver from USCIS to NVC". But, there are few late July and early August approved case that at least received their case number or received by the NVC. What should we do? Any tips? Thank you.

  2. Hello everyone! I am hoping somebody can help to answer my questions.

    My aunt arrives last January 2013 (petitioned by her USC daughter). She then petitioned her son as minor and he is now 20 which is visa availability is now current. Petition was approved July 30, 2013. But my aunt did not work because she is watching her grandkids. Sponsor is not an issue. But my aunt doesn't have any income, and of course no ITR yet. We are aware that even if she has zero income she needs to file her (taxes) zero income or not, but as stated above she just arrived this year. My questions are:

    1. Can we attach an explanation letter during NVC process to inform them that she is not working, zero income and no ITR yet which is required on NVC stage? We are a little bit confused how to handle this. We really need your expert opinion or maybe if someone who already has the experience about this type of situation. Co sponsor is not a problem, just on my aunt's part she do not have ITR yet. She needs to fill up her own affidavit of support and separate for Co sponsor is this correct?

    2. NVC considered my aunt's son as minor and he is 20 now, is he still required to sign the DS 3032 choice of agent or my aunt will be automatically be the agent?

    3. If DS 3032 is required, can he (beneficiary) appoints her sister instead of her mother due to language issues? My aunt is already old and do not speak good English. ( for inquiry purposes only) just in case they need to call to NVC for inquiry.

    4. If we are not mistaken, all the process and steps for F2A is the same with the JAMES shortcut/ NVC flow chart with the I-130 / IR category? Please clarify.

  3. My wife's cousin petitioned her mother from the Philippines and got approved last week. She (wife's cousin) is now preparing for I 864. Her situation is like this:

    She will be the the Sponsor for her mother and she will fill up I-864.

    Her income is not sufficient so, she will use her husbands income and he is going to fill up I-864A.

    Info about her current source of income:

    She is self employed

    She is receiving SSA benefits from her husband

    She is also the one receiving SSA benefits for their minor daughter.

    Info about husbands current source of income

    SSA benefits (disability benefits)

    Other pension benefits( taxable)

    My questions are:

    1. For her current income on question #23 I-864 form, she is going to put her current self employed income, her own SSA benefit and her daughters SSA benefit since she is the representative payee for her minor daughter, is this correct?

    2. 24b. House members income, that would be her husband's income this would be his SSA benefits and his pension correct?

    3. On #25 what number is she going to put here? They filed their taxes jointly, and the line 22 on their form 1040 is her self employed income plus her husbands taxable pension.

    4. And on I-864a total income of her husband what is she going to put?

    I read different post about what to put on the total income but there are different answers. Some says put their line 22 since they filed jointly. Some says determined their individual income and that should be " their" total income.

    If we will put their separate income in I-864 and I864A it wouldn't match their total income line 22 on form 1040 because their SSA benefit is not included to the line 22 instead it was on line 17.

    Please give us a clear inputs. Thank you.

  4. So I send in my I-130's for my wife and stepdaughter. And a week later I receive the standard NOA stating the they received and are processing. Then, in another week, I receive a 2nd NOA stating that my petition was transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. What is this all about?

    The letter itself explains that your case was transferred. It is normal so sit back and relax while waiting for noa2 approval.

  5. For a 1040 form, add the non-taxable SS to the line 22 figure. For a 1040EZ add the non-taxable SS to the AGI.

    For current income add the SS to the current earnings. Document the current SS with an award letter.

    Thank you very much pushbrk! I need more clarrification. If we add up AGI and his benefits, I read people receving rfe because of the figures didn't match in the tax return... Do you think it will cause rfe or it is already considered that AGI and SS benefits will be his total income? Thanks.

  6. My friend is working on their I-864 right now and asked me about the AGI but i am unsure what to tell him. He is receiving SS retirement benefits at the same time he is working. Does he need to add his current income at work and his SS benefits as a currents income on I-864? What about the total income in the past 3 years? His SS income was included in tax return but it was not included when they add up the AGI, the AGI alone is his total income or salary at work. And they put his SS benefits on line 17 on tax return. Thanks for the help.

  7. Let your fiance to follow-up your case atleast twice a week to make sure that the embassy really works on your case. And that the additional documents they asked is in the CO's desk for review. Good luck and May your fiance's visa wilt be done soon!! GOD speed!!

    It will take from 2 weeks to one month depending on how you do the follow up calls. So, wake them up every two weeks. Good luck!

  8. My husband had petitioned his ex-wife and brought her to the US through a fiancee visa and now my husband is petitioning me as a wife {cr-1 visa}.Do we have to

    write the name of my husband ex because my hubby filed a petition for her before? or just put none because fiancee visa and marriage visa is two different visa.

    You are right fiancé visa and spouse visa is two different visas but the question is have he petitioned someone before? So, the answer is yes because he petitioned her before.

  9. Hello all,

    Once my fiance enter in the country can he get a SSN or do we have to get married first? Yes. Most people recommend to wait after 2 weeks of entry.

    Will he be able to get a job with his K-1 visa? No. After you get married, he need to adjust his status- apply for his GC and EAD.

    How soon can we apply for a SSN? recommendation is 2 weeks after his arrival to US soil.

  10. Is it possible that she "passed the tests of english and U.S history and government" as was checked on the form, but was unable to answer some of the other interview questions the officer asked her?

    Very sorry about the frustration--hopefully you can get a straight answer from them. It upsets me so much to see all the trouble people have to go through who are trying to play by the rules and immigrate legally!

    my dad passed his test, mom didnt .. on the speech part. she said while the IO was going through her application and on those YES/NO parts she answered one wrong. Then the IO asked again, she answered right then. IO said she is weak in english speech and needs to be tested again. She was given the white paper with speech part checked on retest. :oops:

  11. To the OP: solve your problems step by step. Dont mix the current process to the future steps that you need to deal later on. Make a clear plan. List all the things that you need to do first before jumping to the next steps. As of now, you are having a hard time financially. As others stated the I130 won't expire, so best thing to do gather all the documents that she needed. One of them is passport. You don't have to spend 500 bucks to do that. Calm down, think, take a deep breath. Talk to your wife about how you can save. She can do the seminar in Cebu. Ask your wife to look for seasonal airline promotions for tickets, or travel by sea compare prices which one is cheaper. Ask your wife if she knew a friend or relatives in Manila or Cebu that she can stay for one or two nights so that she don't have to pay for the hotel. There is a lot of things that you can do in a cheaper way if you will find a way. Good luck!

  12. Young man, You should slow down, take a deep breath and prepare for some work. The people on this site are helpful and knowledgable. Most if not all of the answers your looking for are easily found on this site with links to the government sites associated with those requirements. Just because you are not getting the answers you want to hear doesnt mean people are against you. People do want to help but are not going to do the work for you.

    This is at a minimum 8-9 month process, really no way of getting around it. Start spending as much time as you can researching and reading the guides etc. on the wonderful site.

    USEM does not accept co-sponsors. (For I130? Really?) This means you and you alone will have to meets the minimum requirements.
