HELLO EVERYONE
OK SO RIGHT NOW MY HUSBAND HAS HIS GREENCARD. HE HAS HAD IT FOR ABOUT A YEAR NOW. A COUPLE MONTHS BACK HE GOT OFFERED AN AMERICAN JOB THAT WAS BASED OUT OF HONDURAS. SO WE TOOK IT. I CALLED THE IMMIGRATION OFFICE AND SPOKE TO THE LADY THERE ABOUT OUR SITUTAION AND SHE ONLY SAID THAT WE SHOULD RETURN EVERY 6 MONTHS AND IF IT WAS LONGER WE COULD APPLY FOR A RE ENTRY PERMIT AND STAY FOR UP TO TWO YEARS. SHE SAID WE COULD APPLY IN THE US BUT LEAVE BEFORE IT WAS APPROVED AND THEY WOULD SEND IT TO THE EMBASSY HERE IN HONDURAS. I HAVE ALSO CONFIRMED THIS ONLINE. HOWEVER SHE FAILED TO MENTION THAT HE WOULD NEED BIOMETRICS. OUR PLAN IS TO STAY HERE FOR ONLY 1.5 YEARS AND WE WILL CONTINUE OUR LIVES BACK IN THE USA AFTER THAT.
WE HAVE BEEN OUT OF THE COUNTRY FOR 4 MONTHS AND HE IS PLANNING ON RETURNING NEXT MONTH BEFORE THE 5 MONTH PERIOD TO APPLY FOR THE PERMIT FOR ONE YEAR. HOWEVER HE WILL ONLY BE ABLE TO BE GONE FROM WORK FOR A 8 DAYS. THIS OFCOURSE IS NOT ENOUGH TIME TO SEND IT IN AND ALSO GET THE BIOMETRICS IN. SO I HAVE TWO PLANS AND WANTED TO KNOW IF ANYONE HAD BEEN THROUGH THIS OR KNOWS THE ANSWER TO THEM
1. MY FAMILY IS VISITNG ME IN 3 DAYS AND WE CAN FILL OUT THE FORM AND HAVE THEM MAIL IT FROM HIS RESIDENT ADRESS AND THEN WHEN THEY SEND THE APPT FOR THE BIOMETRICS HE CAN FLY BACK AND TAKE THEM AND FLY BACK TO WAIT FOR THE APPROVAL .. PROBLEM SOLVED.. BUT I HAVE HEARD THAT YOU MUST BE IN THE COUNTRY TO FILE.. IS THIS SO YOU CAN DO THE BIOMETERICS OR IS THERE A CERTAIN REASON. HAS ANYONE FILED ABROAD AND DONE THIS??? HOW DO THEY KNOW YOU ARE OUT OF THE COUNTRY?
2. SEND THE APPLICATION WITH MY FAMILY. HAVE THEM MAIL IT 2 OR 3 DAYS BEFORE HE ARRIVES SO IT ARRIVES AT THE OFFICE WHEN HE GETS BACK IN THE USA.SO IF THEY CHECK THEY WILL SEE HE IS IN THE USA. THEN GO MAKE AN APPT AT INFOPASS TO SEE IF HE CAN JUST DO A WALKIN BIOMETERICS? WITHOUT AN APPT.. MY QUESTION IS HOW LONG AFTER THEY RECIEVE IT CAN YOU TRY THIS.. DO YOU HAVE TO WAIT FOR THEM TO GIVE YOU THE APPT BEFORE YOU TRY A WALK IN??
IF HE CAN'T DO EITHER ONE.. WHAT ARE OUR OPTIONS? HE CAN'T STAY ANY LONGER THAN THE TIME ALLOWED FROM WORK. WE ARE TRYING TO DO THE RIGHT THING AND GET THIS PERMIT INSTEAD OF COMING BACK EVERY 6 MONTHS AND RISKING IT.. ANY SUGGESTIONS.. ALSO DOES ANYONE KNOW HOW HARD IT IS TO GET YOUR GREEN CARD BACK IF THEY TAKE IT AWAY??? THIS IS NOT SOMETHING WE WANT TO GO THROUGH, WE ARE MARRIED AND PLAN ON SPENDING OUR LIVES IN THE USA ONCE THIS JOB IS OVER...
WHAT HAPPENS IF THEY DENY THE PERMIT DO YOU RECEIVE YOUR MONEY BACK? CAN YOU APPLY AGAIN?

No you can actually get one now if you want. My husband just filed for his last week. And it should be in the mail this week. Once you have entered the US on a K-1 visa you can apply for a SSN you just need to take your 1-94, birth certificate and passport down there and fill out the form they give u. SO if you want it now the better, if you are just waiting because you dont want to do it now, then it doesn't hurt either. Just needs to get it done though.

You can translate it. It is not a problem. You have to sign a document that says that you are fluent in the language. That doc is here on VJ. I did the same thing for my Fiancee and we had no problems.

Hey guys
I am getting my AOS packet ready to send out this week. my question is I have my husbands birth cert from panama that we used during out k-1 process. But it is in spanish. When I looked at the AOS guide it says if the birth cert is in another language it needs an english translation to accompany it. Can we do this ourselves since we both know english and spanish or does it have to be done professionally??

I am filling out my form for AOS. We are currently a K1 visa holder. On the 1-485 it asks for my visa number.. is this the passport number or is it that long number at the top called control number. Also I am turning my work permit in along with my AOS. On the I-765 it asks for my current status, do I put K-1 Visa or AOS pending??? I am not sure what to put there. If anyone can help with these questions I would really appreciate it! thanks

I know I am sooo excited. I would of never been able to do it without everyones helps from VISA JOURNEY.. I still cant believe it, I thought for sure I would have a RFE, or my 1134 would be denied, but Nope, it all went smooth from all the help I had a long the way from all you guys and this site! Thanks a lot everyone! It all should go pretty smoothly from ur NOA2
FYI everyone here are the things we made sure we had even before packet 3 to make things go faster was..
New birthcertificate for my fiance signed by authorities in panama.
Copy of something called a "solterio" its a paper stating you are single and never been married
I-134, mine was pretty bad since I JUST got employeed and have been out of the country for 2 years with no recent tax records, so I had my mother CO sponsor as well, she filled out the form, got a letter from the bank stating how much money has came in and went in the last year,(she has average income) and a letter from her employer stating she has worked there "This amount of time" making "this amount of money" and is a permanent employee there. I did not have any tax statments or pay stubs and they were not needed for us those are the only two documents we sent with him for the I-134
Also we had to get a police certificate from Panama stating he has no crimes.
These are the only things he took to his interview. when he got packet 3 he told them he already most of those papers ready at home, there fore they had him fill out the DS- XXX form, (sorry I forget the name) but it is the one they provide for you. He filled it out there, and since he explained he already had most of his stuff they game him an interview the next week. I think they sometimes give people far away interviews because they know how long it can take to get all those documents needed (Took us 1 month before) and dont want to set a date for an interview and then come to find you do not have some papers still, also they could just be backed up with other visas. NOT SURE... anyways the date of the interview, he said it took about 2 hours, they just asked him a few questions about me and where we meet and about my family. He said it was only about 20 minutes long of actual interview and then he had to pay around 130 for the Visa there. They ended up approving him on the spot and told him they would call him when he could pick the visa up.
I am not sure if this helps any of you but just wanted to give you an idea of what happened for us incase anyone was curious about the process.

GOT VISA APPROVED TUESDAY 3/9/2010!! WE ARE FINALLY DONE WITH THIS K1 VISA. SHOULD HAVE VISA IN HAND WITHIN A WEEK OR TWO! FIANCE IS FLYING IN APRIL 2! YEAAAAAAAAA! I AM SOO HAPPY.. NEXT GET MARRIED AND START AOS PROCESS!

I think I have an identity crisis!!!!!!!!!!!!!!!!!!!!!
Im bored at work today (as usual) so I decided to be my ####### retentive, obsessive compulsive self and start working on "Package 3" even tho, Dan hasn't got it yet. For the past few months Ive been collecting / keeping my paystubs and bank statements. I have copies of my tax returns. I asked my boss for the employment letter (I decided to bribe him with Girl Scout Cookies so, I should have it before the end of the day). Now I'm working on the I-134 Form.
Question 2 reads:
I am ____ years of age and have resided in the United States since (date) ___________
Well, I am... eeeeerrrrrr.... <coughs>... 25!
so that one is easy to answer now... the "resided" in the US part: I am Puertorrican which means I was born a US Citizen but PR is a territory, not a State. I moved to California in 2006. Should I say that Ive resided in the US since 2006 or use my birth date since PR is a US territory?
I've searched the forums left and right and... nothing. Ive googled it and... nothing so sadly, the only option I have left is call the USCIS and pray I get someone nice enough to answer my question. I've been debating about posting my question on the VJ K-1 Forum but to be honest, I am deadly scared of some of the moderators
Anyways now that Im done venting here... Im bored again, lol.
I was going to put NO put 2006 since question #1 already should show you hve been a Us citizen since birth but if you google , "is puerto rico considered part of the US"..It says yes, and they recoginize it as their own. SOOOO i would just put 25 and since (birth date). Since the question is just asking how long have you resided in the US.. and since the puerto Rico is considered part of the US i would jut put since birth. I do not believe it will be a problem at the interview. My fiances interview is tomorrow, and they told him that they are not that strict on the I-134, its just about income really, so I doubt they will even look hard into that specific question. I COULD be wrong and I am not saying this is the right answer, but its what i would put. In the end I think either way will be fine and dont worry too much. Which ever one you put it can be explained at the interview so they understand

Yay got out interview scheduled today! My fiance was called to come down and pick his packet 3 up from the embassy, he ended up filling out the paper work there, and since we already had the papers all ready a head of time ( birth cert, police cert, i-134, cert of solterio) they ended up just sending him for his medical right away and scheduled an interview for next tuesday! yay! I am sooo excited to be finished with this process..only 31 days from our NOA2 and hopefully we will be finished! WIsh US LUCK! and if anyone has questions let me know, Ill be sure to post how the interview went and the type of things they are asking! Good luck to you all as well!!

this is a buch of lies cause my fiancee is an american and i know they dont give u a dam flag and say welcome to usa and she never got a medical exam and she has to have that and the embassy dont phone u either they send a letter dont know who you trying to fool but this american u cant fool and they dont take digital signatures either have to have the real signiture so please dont let people think it was this easy cause i know its not.
I do not know of who you the person you were replying to about, but I just read your post and I have to say you shouldnt talk about things you know nothing about, not every person has the same experience, my fiance called me TODAY to tell me the embassy actaully wants him to come down there and sign the forms and show him what he needs for the interview instead of sending a packet 3 sooo obviously it does happen that way..

In case people are curious about the speed at NVC, it seems to be pretty fast at the moment. Our petition arrived at the embassy 13 days after the NOA2 date.
We just returned our packet 3 to the embassy in Port of Spain today, so crossing fingers for speedy processing and receipt of packet 4. This weekend is Carnival in Trinidad, and the entire country shuts down for about a week.
Good luck to everyone still awaiting the NOA2. Waiting is the hardest part of the process, no matter which step of the way you're on!
I got my noa2 on the 8th but have not heard or received anything else since then. How do I know if it was sent to the NVC and when it has left if it has already? Will it show this info on the Uscis website or do i check somewhere else now? thanks?

I got my NOA -1 on NOV 20th 2009 and have had only one touch on 12-01-09 since then.
Any clue when mine will be approved or touched ago? I hope soon.
I applied at the CSC and my fiance is a Indian citizen.

I have been reading the guidelines and see that you are able to use a co sponsor for the i 134 this is good for me but i have some questions.
1. I know I need to fill out 2 seperate forms one for me and one for my co sponsor, my problem is I have just recently moved back to the country because I was living in panama with my fiance. There I was finacially dependent on his income. SO I have only been back for about 2 weeks and have not found a job yet, therefore If I fill out the 134 there are a lot of spots where nothing applys to me , like income, job and assets. Do I just leave them blank, and also it says I need to bring all these things of proof but I have none because of the fact I have no job or income as of now. Will this be okay as long as my co sponsor is able to provide all these things on their I 134?
Please let me know what your experiences have been??

I sent in the 129F application 2 weeks ago, and the check was cashed. I checked my online bank statement to find the case #, and checked the status. Just wanted to know how to find out if my case was "touched". I remember reading it somewhere, but could not find the answer.

After you get your Noa1 they will send you somthing in the mail, I got my about 10 days after I mailed it off. When you get that it will give you a reciept number. Go to www.USCIS.gov on the side you will see something that says check my status. you can put that account number in and it will tell you where you are in the system. This will only tell you the basic. If you want to know if it has been touched you need to make an account so when you sign in you will see your account... something like WAC#XXOXOXO/ email updates/ mobile updates/ last updated/ etc.... where it says last updated, if that date has changed since you last looked at it, It has been "touched" updated. Hope this helps.

Hey guys I am also a November filer, I sent my package out nov 17th out from panama, and was recieved on the 19th, I recieved my Noa1 in the mail on Nov 27th. I am now waiting for NOA 2 hopefully with no RFE. Hey I was wondering where do I check to see if my petition has been "touched" I have the USCIS account but it doesnt give much details, is there another one that you guys are looking at to see updates?

I know that eventually you have to get a police record. Is this necessary for everyone or only the people with a record? anyways if it is necessary for everyone I have noticed on timelines it takes about a month to get. Is this something we can go ask for now from my fiance's police department since we are in his country right now, or do we have to wait for a particular form that the NVC sends us to have the police fill out?

Hey guys.. I am sending off my 129f tomorrow. yay!!! I followed the guidelines that VJ provided in the guides section and have everything they asked for.. I just have some questions, because we are on a time line, and we really dont want to get a big RFE in the mail. SO PLEASE HELP.
First is.. on both forms it asks for my fiances address abroad. Well in panama they all use mailbox centers with lock boxes down town for mail, so should I list the address of residence or the mailing address, because as I read ahead I see that they send your fiance a packet that he has to fill out and return, and I dont see how this packet will reach him with the address I listed, so do I need to change it to the lockbox address instead or do they contact you later and ask all that stuff ??
Second, as for evidence I am sending A full page letter of how we meet, photos (two with time stamps, one stamped on the day we began dating) and 10 more with dates on the back and descriptions, Passports with entry and exit stamps, and itinenaries of flights from panama, honduras, and california, all places we lived and traveled during our relationship. Is this enough?? I dont know what else to send because I dont live in the US right now so I cant get letters signed from anyone in the Us and everything like our apartment, and stuff is in only his name?? let me know if you have more IDEAS?

I just started my process today and I am trying to fill out some of the forms now, I have been traveling the last two years on a tourist visa to honduras and Panama but never lived there permantely or llegally just would stay the 3 months and leave for a week and come back on the tourist visa again. SO my question is on the application g325a there is a section asking about residence for last 5 years.. So do I need to list where I lived abroad, even though I wasnt considered a perm resident in those places? Plus when I lived in honduras I lived on an Island and there were no road names.. sounds silly but it was true only city names and areas, so how to I fill this in under street and number? Or is it better to leave all of it out and if asked later I just say I was traveling during the times not listed?????
