  1. Hi fellow VJ,

    If I plan to do DCF for my spouse, how many more months (besides the preceding 6 months), I (USC) need to be at the consulate oversea contry?

    I assume, after living oversea for 6 months, we then can apply I-130 at the consulate, then I can come back to the US and my spouse can process the rest of the procedure without being me present in the consulate oversea. Is that correct?

    Originally want to pursue K-3 visa but since K-3 visa is no longer valid, maybe we need to do DCF option.

    Are you guys living together abroad? If so, you might qualify for a DCF filing. This is much better.

    Wow, thank you guys for the information. At this point, we are not living together. But I plan to go abroad so we dont have to live separately when I am filing K3 visa. Just curious if that is one of our option. Thanks again!

    Btw, can you elaborate why DCF filing is much better?

    You do not have to be present in the USA to file a petition. However, the petition is submitted to a USCIS service center stateside...

    Are you saying, I can initiate the process of applying K3 visa from the US? And I can wait for the K3 visa to be approved in other country?

    Or all the process from applying till approval can be done outside the US?
