  1. My Adjustment of Status was APPROVED!!!! this morning. YaaaaaaaaaaaaH!!!

    My AOS Interview went well this morning. The Interview process took less than 10 minutes.Very quick!.. Interview time was 8:30am and I was there by 8:15am...I was called in at 8:35am..The Officer was very cool and friendly. He led me into the room and told me to raise my right hand up for an oath. Then he started asking for my Passport, ID and I-94, I immediately furnished him everything he ask for, then he ask me when is the last time I've seen my ex-spouse and he ask for Divorce document and my Birth Certificate, I gave him those as well. He made me relaxed throughout the Interview process. He then started asking the Yes & No questions, when he got to the Criminal section, he ask; have you ever been arrested or charged with a crime and I said yes that it was connected with the abused I went through and the Charge has been dismissed and expunged. I immediately want to furnished him the documents to back it up and he said he doesn't need it that he already review and researched my case that am fine. I was immediately relaxed and he said am going to Approved your case Congratulations, he started writing some documentations note with Red pen at the right Official Only section of my I-485 Applications. He shook my hand and he said do you have any questions for me then I said when can I get my green card then he said in 2 weeks then he smiled and he patted my back and led me out of the room and he said Congratulations. I am now free...I am so Happy.Thank you Jesus!

  2. Hello If you want a quick processing of your case, go ahead and do a walk-in Biometrics instead of waiting for September....I had my Biometrics done early as well. This will speed up your case processing...Just an advice because it works for many.

    I just added our new I-751 receipt number to the "My Portfolio" section. No recent touches. I had to laugh when I saw our old receipt numbers in the "My Portfolio" section, one for the I-129F and the other for the I-130, both last updated 6/04/08. God, . . . I remember how confusing that all was with everyone on VJ trying to figure out which was the best route to go, I-129F or I-130? Mass confusion. :blink: It was impossible to explain to my wife. In comparison, this phase is a breeze (so far!). So much so that I have a hard time getting too excited about it.

  3. Hey Mafen, you've done the right thing by notifying Vermont Service Center of your correct address. We don't know either what might be in the letter/mail. my thoughts to you is to wait and see what is in the mail/letter they are sending you. Don't be panic, whatever it might be has a solution. Brace yourself up for any impact. It might be RFE Notice, or it might Intent to denial Notice or even it might Approval Notice. Wait and see. Every situation in life has a solution. Good Luck!

  4. Well I Don't have to power struggle or argue anything with you Kwala...Even a blind man reading your statement will justify your intellectual ability. Listen to yourself for awhile and read all these Jargons you called Experience Immigration advice back to yourself for one minute because as for me I still can't understand you. But all the same, everybody has right to share and contribute their opinion here on this forum but for crying out loud in the name of the Lord make your advice or your contribution accurately and understandably grounded on the actual fact of the discussion. Well Yahya54 made it known yesterday that Government Attorney won't agree to Terminate his Removal Proceeding not until Vermont Approved his I-360 Vawa. It is common for some people going through this ordeal when they are in removal proceeding because Government Attorney doesn't believe that their case will be approved or they just want to escape immigration justice. They want to see the approval first before they can actually Terminate and close the case. But Vermont needs his A-file to speed up their processing because their policy has changed they can't Adjudicate I-360 Vawa without his A-file because some facts and more clarifications might be in his A-file that will help adjudicating his I-360. You are entitled to your opinion but share it wisely and don't mislead or mis-informed people with your jargons. If his case has been closed form Immigration Court why Vermont need ICE to forward his A-file for? Immigration Judge/Court has it. Some Immigration Court once you have Prima Facie they will Terminate and close your case but some Immigration Court might not agree until they received Approval. But above all am done with this. Take care...Follow up with your Attorney!

I don't have a clue of what you talking about. Yahya I already told you what really happen to your case and you should follow up with your Attorney. Thats all I can say....Have a good day!

    3bvsla, I already told you as well what happened to your case don't mind Kwala, your case is still at Vermont. If Vermont transferred your case to NBC they will notify you right away when they did. Vermont has to complete the Preliminary Processing of your case before they can forward it to NBC to schedule the interview and to do the final review for your local office. Do what I told you yesterday and follow up with an experience Attorney. Have a great Day!

Your biometrics was out of schedule and that throw you out of timeline. But relax they are reviewing your case for Preliminary Processing because your I-485 is still at Vermont Service Center and after the Preliminary Processing is completed they will forward your case to NBC to schedule your Interview with your local office. Just a question hope no criminal convictions on your record? Also to be on the safe side call USCIS National Customer Service Center tomorrow and make a Service Request about your case outside processing time and it might make them do something very quick regarding your case. Vermont still got your I-485. Your late Biometrics caused all this delay. Call Customer Center and make Service Request for Action on your case. Good Luck.

  8. @Yahya, Ok I see what is going on right now...Its common for the DHS Government Attorney to be mean that is the quality of their job to close the loop. Well its not going to be easy on you especially using VAWA in Removal Proceeding as a man thats why DHS Government Attorney is not agreeing to Administratively Closed or Terminate your case. Its all good but you have to file a motion to administratively close your case, this is different to you Terminating your case because DHS Government Attorney will not agree to that with you. Administratively Closure of your case will allow USCIS to effectively Adjudicate your I-360 VAWA because they will need your A-file to Adjudicate your I-360 due to their recent changes in processing procedures at Vermont. Administratively Closure of your case will not finally Terminate your Removal Proceeding from Immigration Court but it will take it off the Immigration Court Hearing Calendar and it will be put away on the shelve and in that case they can effectively forward it to USCIS and it will give USCIS total access and jurisdiction right to Adjudicate whatever benefit you requested from them. As far as I understand your case it seems your A-file that Vermont needs is still with the DHS Government Attorney at your Removal proceeding in Immigration Court. Let your lawyer talk to the Immigration Judge including DHS Attorney about the delay of not agreeing to Administrative Closure of your case is costing the effective Adjudication of your I-360. Sometimes its the best route to Adjust Status before Immigration Judge if your I-360 is approved and if USCIS denied your I-360 you can have it approved by the Judge but this process is hectic and cost money also time because it might take forever to complete. Tell your lawyer not to ask for Termination but Administrative Closure of your Removal proceeding to allow USCIS to effectively Adjudicate your I-360 that is the magic word. Or you can ask Judge to continue your case to give USCIS enough time to Adjudicate your I-360 either way..which ever way is good for you. But to Administratively Close your case will be the best option as far as I know. Good Luck! .....     @Sweet Mgeni, Your lawyer is right you have to wait for USCIS to make a decision because they have jurisdiction right to adjudicate your case right now. But you could have filed a motion to reopen your Removal Order Initially when your I-360 was approved and Adjust Status in front of the Immigration judge. If USCIS denied your I-485 you can still Adjust Status before Immigration Judge, you are fine because you have Approved I-360 Vawa which exclude you from lots of inadmissible Offences. Relax and let USCIS reach their decision, all the same you are in safe hands anyways whichever ways.     Just an experience advice, Tell your lawyer representing you at the Immigration Court in your Removal Proceeding to file a motion to the judge to Administratively Closed your case or Terminate your case so that USCIS can Adjudicate your I-360 and Adjust your Status. Tell your lawyer to discuss it with Government Attorney that your I-360 case will be Approved and your case is very strong so that S/he can agree with you or if there is no agreement with Government Attorney file your Motion anyway to the Judge and serve him/her a copy and forward your case before the Court/Judge they will either agreed for your case to be Administratively Closed so that if your case is Denied before USCIS they will re-calendar your case before the Judge or if your I-360 got Approved by USCIS you can forward the Approval to the Judge and your case will be Terminated finally. But you have to do this ASAP.. Your lawyer has to file that Motion to Administratively Close your Removal Proceeding so that your A-file can be transferred quickly to USCIS, because if your case is not Administratively Closed or Terminated it can take an indefinite time or awhile to reach USCIS and your I-360 will suffer on time Adjudication. Just my 2 cents advice because the exact situation happened to someone I know and that is the solution to overcome that. Or you can allowed USCIS to Approved your I-360 and Adjust your Status before Immigration Judge. But this process might be long......Good Luck man!

  10. Your case is under what they called "Supervisory Review" It may or may not lead to a denial, it may go to a supervisor prior to a denial being issued. It goes to a supervisor when the adjudicating officer assigned to your case is not sure of what to do. The adjudicating officer wants to issue a denial and wants a denial going to supervisor first for review. On the other hand, the supervisor may instruct the adjudicating officer to Approve the case. That is why it takes so long because they have to review and research the laws, rules and regulations to backup their decisions. Every Denial decision has to have a supporting laws that governs it, incase it went to the Appeal Review. Thats why supervisor has to approved the final decision on a complicated case like yours. Goodluck...Talk to your lawyer right away and brace yourself up incase it turns to Denial.

  11. Relax....No big deal. They received some info or maybe when they recieved and review your A-file there were some information contrary to what they have right now. So in that case the adjudicating officer on your case has to forward your case to the supervisor for review and decision. What you can do is to ask your lawyer or the senator to write letter to VSC to make decision on the evidence on file. Request for supervisor review so you can move on. I know for sure that something is on your file that trigger immediate decision. Your case definitely need supervisor's review for final decision. Relax gave them 60days then write them and request Supervisor's Review on your case and it might help you to know what really happened with your case. Goodluck!

  12. Early Walk-Ins Biometrics Done Today Yay!!!

    I received my Biometrics Appointment yesterday 08/02/2010....Early Walk-ins Biometrics was Done Today 08/03/2010...Code 3

    I got there around 10:13 am, few people were there, I was fingerprinted and get done within 15 minutes. The waiting period to the Biometric process was very quick and the staffs in there were so friendly and professional. They didn't question/query me about the Original Appointment date in my notice letter, they just verified my identity and gave me a form to fill out and within 15 minutes I was Fingerprinted... 10 fingers, Photo and Signature and 10:30am I was out of the place. I get that out of the way now waiting for my interview!!!..... One more huddle to cross over.

  15. Hello Yahyah,

    Wow your case is pretty slow and overdue for approval. Just a question..When you did your background check in replying to ur RFE did you have any criminal record? Because when you sent back ur RFE Background check they should have approved your case if there is no criminal record that will make you inadmissible...Something is not right here..You filed your case in November, 2008 and I filed mine on January, 2009 and many people in that processing time already got a decision, either approval or denial. Maybe your name got stuck in FBI name check and Security checks...I bet you that, because they could have denial you long time ago if that is not the case. Maybe they flag your case file and mark your file for further security check..Also maybe your country and your religion trigger further security checks or maybe somebody already report you and make false allegation on you to USCIS. Nothing personal though but trust me that is the problem. Your name got stuck in FBI and National Security Check...Don't worry when everything came back cleared you will be approved..It might take a while but they will surely approved you if there is nothing on you. Good luck Man! Hang in there and be more patient because if they want to denial you they could have done that long time ago. That is my 2 cent advice to you!

    Today I called USCIS Customer Service and complained about my Biometrics Appointment that I haven't received as of now and the lady at the Customer Service escalated my request and transfered me to an Immigration Officer, she looked into my case file and said according to my record I was scheduled for Biometrics on 08/26/2010 by the Adjudicating Officer assigned to my AOS case but they haven't mail it yet, that I should be expecting it in the mail soon. My interview is on 08/18/2010 and my Biometrics was scheduled for 08/26/2010...I planned that when I received it I will do Walk-In Biometrics if they allow me to do it before my interview date. Why was it like that? Interview before Biometrics Appointment? Isn't it weird or is it a normal process? The Officer lady said my case process is in good shape that everything will wrap up in August 2010. She even said my case is pretty fast that I should have nothing to worry about other than to show up for my interview. Am seriously anxious and can't wait for my interview day to come.....Approval is coming up in August for many people in here because August is known for massive Approval of I-360 Vawa case and AOS I-485 Vawa related case, mark my word.     Like you advised I called USCIS National Customer Service Center 1-800-375-5283 and I got a Service Request for Biometrics Appointment regarding my upcoming I-485 interview which will be sent to me within 2 weeks...Just to be on the safe side, I prefer to get the Biometrics process over with. Am so excited and at the same time nervous but am positive that I will be approved for my Green Card because if I can be approved for I-360 VAWA with all these issues and situations..I will definitely be approved for my I-485 because it all connected with my VAWA case. My I-485 interview date is pretty fast because VSC just transferred my case to NBC on June 22 and NBC transferred it back quickly to my USCIS Local Office for Interview scheduled for August 18th... I can't wait for the day to come so I can be free completely! Please to all my friends in this forum that we have suffered together I need your prayers to go with me for favor and approval on my interview day! To those of you that still waiting for approval of one thing or another, hang in there your day of approval is fast approaching..We will all rejoice together..Good things come to those who wait patiently.     No the last touch and update on my online status was on 06/26/2010, 07/01/2010 and 07/02/2010 when it says my I-485 case was pending at the USCIS office which my file was transferred to. Since then no touch on my online status...Untill I received an appointment interview letter scheduled for 08/18/2010 today in the mail.

I received interview appointment letter today for my I-485 Adjustment Of Status after my I-360 VAWA was approved on June 22 ...My I-485 interview was scheduled for August 18...But my I-485 online case status doesn't change from: Initial Review "This Case is now pending at the office to which it was transferred" and I wasn't scheduled for biometrics appointment but had one done by myself for my I-360 VAWA to prove Good Moral Character which the result shows No Record Found.. Am so confused and scared.. And also I have a misdemeanor long time ago..7 years ago was lied on and implicated by my ex-spouse and its included in the VAWA case but has been dismissed and expunged from my record beside that I don't have any criminal record. I can't afford my attorney fee to accompany me to my interview...please guys do you think there will be a problem regarding this or will I be approved if I go to my interview by myself..Please any veterans with full knowledge, I need an advice of what to do. I have a month before my interview. My interview appointment is so quick though I requested an expedite on all my case, I-360, I-765 and I-485 which was approved on February 18, 2010....Or is this normal processing...Please I need an intelligent and professional with full knowledge response. Thanks guys!

What will happen or what can I do if I go for my interview and its the same Immigration Officer that interviewed me and my ex-spouse initially is the one that will interview me again for my Adjustment Status...What should I do if he is asking me all the questions about the I-360 and the prove of abuse...Please guys I need a concrete advice..My lawyer is asking for a lot of money to follow me to my interview and I don't have such a huge amount....Am planning to go by myself...But I needed some advice of what to do when I get there because its the same USCIS office that my ex-spouse withdraw my petition from and they put me on deportation proceedings before Immigration Judge closed my case for USCIS I-360 Adjudication....My ex-spouse have flooded some false accusations about me to that office initially..long time ago....Any concrete advice from a reliable veterans here will be appreciated...Thanks am waiting!!!!!

    Also my I-485 was Transferred to USCIS Office on 07/01/2010 .......but I don't know if it is a USCIS Local Office

    I pray for a quick and complete approval of my I-485.....OMG! I can't wait anymore, am so happy and nervous at the same time. Please guys can someone tell me what is the next process from here.. My passport has expired and I need to renew it ASAP...I might be called for an interview soon. Yahyah hang in there approval is on the way.

  22. Yes thank you Jesus! my I-360 was approved and my I-485 was sent to NBC this morning for Standard Interview. It was updated from Initial Review to Testing and Interviewing... Is this normal? Finally am Free..I am so happy, excited and full of Joy!!!!!!!! Thank you all for your love and support in this Forum...I really appreciate you all....! So what is the meaning of my I-485 status is this normal for everybody...I mean from Initial Review to Testing and Interviewing without Appointment for Biometrics! Am confused and surprised!
