  1. Hi,

I am a US citizen and I am in the process of Divorce from a Man I married from India and helped to get his green Card. Our marraige was a love relationship and a true marraige and like other true marraiges it just didnt work out. As of February 13 we would have been married for 4 years. So I dont think that would have posed any issues. He and I have been apart for awhile and I have fallen in love with a man I met in Beirut. I was talking to him online before I went so we have been conversing for awhile and when we met it just felt right. So now I want to Marry him and bring him to the USA. I will be divorced in 3 weeks and I figured I would file after that. What issues if any should I expect? Also he is a Syrian on Refugee status in Lebanon, will this help or make for any other issues I cant forsee?

I am nervous and still a foolish romantic. Yes I looked for an US Citizen to be with but sometimes things just dont work that way. And I had to go and start the tough path of the USCIS again. This site was helpful in the past and I hope it will be again.

    Thanks

    Meghan...

  3. Yay! Your NOA1 should be on its way ;)

I think that as long as you have strong evidence of a bona fide marriage, you should be fine without a lawyer :)

What kind of evidence are you sending with your packet? Also, are there any special circumstances - major things like criminal history, stuff like that?

No special circumstnace but we do seem to lack pictures we really didn't do much that was picture worthy and when we did we never thought of getting a picture of us together. I think this was a stupid lack of comprehension on our part but we have lots of normal proof of a life together. Leases and bills plus a few event and movie tickets stubs.

  4. My Husband and I will be sending our packet out by hopefully Monday the 23rd. His Conditional Residence expires on 3/17/12 and I am really anxious to get this going. I am nervous about not using a lawyer this time as I used one last time but she seemed to be a complete waste of money even though our goal was acheived. We should have no issues but we did have to have the second interview last time which really freaked me out. Is there any reason to use a lawyer in this case or is it considered to be simple enough???

    Thanks,

    Meghan

  5. My husband and I are having our second interview this Wednesday the 17th and several of you have told us that this will in all likelihood be a Stokes Interview. Does anybody have any idea of what questions can be asked???

I know this may be a silly question as I live with this man and married happily for love and I really feel like I know him. However, sometimes there are stupid things that come up that we never thought to ask or too tell each other about or thought we talked about already. So any questions will be helpful...

  6. can u give details from the first interview. do you guys live together? just make sure u know every detail of your marriage process, each others family, and your home.

I wrote up our first interview in January for a question back then so I will paste it below.

But we live together and have since Last January. We met in July of 2007 so we have known each other a long time. I even went to India before we married to meet his family. I think we werent affectionate enough. We are both not PDA people and we were told not to be by our lawyer. So I always thought we were way too professional and maybe it came off as distant.

This is what I wrote about my first interview in January...

""""Well my husband and I had his AOS interview in the Fairfax, VA office today and it was irritating. After an hour and half wait we were brought into an office where we were asked a minimal of questions. She got all of my husbands info and he was fine with his simple name address marital status, are you here for ill intent, ever been arrested questions. Then when asked my name I gave my maiden name. (I have less than a year of saying it and I was nervous) so I started off stupid. Then when asked how we met I told her the story. She just kept writing and writing with her evil red pen and gave us back some of the back-up we submitted that she decided she didn’t need and she just kept writing. My lawyer suggested that we mention I spent a month in India and I showed her the pics to prove it. She said that my pics could have been taken anywhere (now the next time I take a vacation I will think twice over my background).

She handed me back my tax forms and asked me for the W-2’s I did not bring my W-2’s because I had submitted my tax forms. She then printed out the EVIL Form: I-130 request for evidence. With the need for W-2’s checked and initially she had the box checked stating establish the bona-fide relationship for which I started to panic and bring up that my phone bills showed while he was in India last year we had spoken on the phone several times a day. She looked at the bills and asked him for his India phone numbers and she took the phone bills and said she would go over them and verify that the numbers matched the bill. So she reprinted the form and that line was not checked just the W-2 box but she told us that we should still provide any proof we can come up with for our relationship. She was very intimidating in this request. The w-2’s I easily have and found within 10 minutes after coming home but the proof of our relationship is freaking me out. I have been the only one working for the past year and we live in Northern VA/DC area not a cheap location so we kept it minimal this year. We barely went anywhere and when we went to the movies we threw away the ticket stubs. When we traveled to meet my family in Ohio we went by car you can’t prove joint travel when you go by car. We honestly had the most boring year of my life but we were newly married and didn’t mind staying home. """""

  7. Okay now I have a new issue. My husband and I received a new letter this Saturday telling us that we need to have a Q&A/2nd Interview in 2 weeks. I think it’s a good thing in the way that any mistakes we felt we made we can try and fix plus it is not a denial. But for a second interview to be asked for it means that they are unsure and thinking about denying us. Any opinions or advice for those of us who are afraid of losing what they want the most.

  8. I know my postings on here seem Ultra Stressed and that’s because I am. Before I started dealing with immigration for my husband and our pursuit of his green card I was a rather carefree person.

But he being a HIGH stressed individual and constantly claiming the gods have given him such bad luck that we are cursed and this won’t work he is not destined to be happy and he might as well prepare to be sent back to India right now plus many other wonderful rants of craziness, well it has made me the person I am now. Funny thing is I have amazing luck, I always tend to get what I want so I tell him that well if there is a balance between us then my luck will of course win out just with his luck it will just be harder than anything should be.

Sadly this has proven to be true. So with stupid stuff happening left and right down to even managing to chose a lawyer who hates dealing with immigration law and got stuck with it from her previous law firm (before they went bankrupt) as a specialty. I find myself at emotional wits end.

    So I have 2 questions.

1.) How long does anybody think it could take from when the USCIS receives the packet for the Request of Evidence they asked for on our interview? I know its only been a week since they have received it but I am just curious as to a base possible timeline.

2.) Does anyone know of any support groups available for this stuff? Because I talk to my family and friends and they tell me its all going to be okay but really they don’t have a clue what’s going on as my last family member to come here was over 140 years ago and most of my background comes from the initial people coming over on the mayflower. I have no history of immigration troubles like the beaurocracy of today and my lawyer is almost useless.

Sorry for this to be erratic but well its where I am at right now.

  9. Our green card interview was on 5th Jan 2010, the officer was a black lady, she demanded few documents and asked few questions.

Then she gave us a document which shows what other documents we need to send to USCIS through Post office. As per document they need

My W2 for the year 2008. We still provided few more documents to prove our marriage as she didn’t seem convinced at the first place but demanded only W2.

We collected documents, arranged in a proper manner with an explanation of each additional document and posted it on Saturday 9th Jan through a priority mail.

We kept checking online status on USPS website but it wasn’t showing the delivery. I called the post office on 19th Jan (Tuesday) to verify it and officer said USCIS in Fairfax has their own zip code and also only picks up their mail on Mondays but this being MLK weekend and no delivery was available Monday so they would most likely be doing a Tuesday pick-up , according to the man I spoke with at the USPS on Tuesday 19 in the afternoon, he personally checked the package with our documents were still at the post office that afternoon but said that once the package was picked up the system would update with a delivery confirmation.

So we checked the online status on Wednesday 20th Jan morning and the status was changed to "Your document is delivered on 19th Jan, Tuesday, at 6.46 AM.

Now I am confused that if that officer saw the package in the post office on 19th Jan afternoon then how status can be "Delivered on 19th Jan at 6.46 AM "

We called him again and he said, document is definitely delivered and no need to worry and you can print the online receipt as a proof.

I am worrying about the delivery and there is no way to cross verify it with USCIS. If USCIS has not received the package then they will close the case saying required documents have not received. Our last date of submission is 16th Feb. 2010.

Has anybody faced such kind of problem?

Can anybody give some solution or suggestion?

We honestly had the most boring year of my life but we were newly married and didn’t mind staying home.

So what the heck can I do??? And should I be as freaked out as I am by this request for information??? Also what my husband and my lawyer suggested is that because I am overweight and taller than my husband and he is shorter that maybe the rep was biased against our physical appearance judging us that maybe since we aren’t matched that way how could we be matched in the long term on a mental scale?

  11. My husband’s interview in on the 5th and just a week away now and suddenly I am freaking out over everything. The thought of losing him is too much. I am worried because I am 6 years older than him and he is Hindu and I am though raised Catholic I have no religious following. I am 2 inches taller than him. I am worried that his name isn’t on the lease because he didn’t have a social security card when I applied. I am worried about proving his residency and that we live together. I am worried about all the things that are real and true in our lives but not sure how to prove it’s a fact and not a sham marriage. I talked to my lawyer and her prepping us actually made it scarier not a calming effect she is telling me (with a week to go and no previous warning) that his name should be on the bills there is no way to do that since we have no credit cards only use cell phones and the utilities are tied up with the apartment and he wasn’t on the lease. How do you prove someone is there when the things we use to make you there were not available until he had a SSC (he got his card only 3 weeks ago). Some of my freaking out is valid some foolish. But seriously I think the only thing I have going for me is the month I spent in India meeting and staying with his family. Why would people go to that kind of trouble just for a sham marriage? I really need him and I to get this. I want my future with this man…

Not sure if I am looking for advice or just needed to freak out and be heard.

  12. Is this walk in biometrics only available in Alexandria, VA? I filed AOS for my fiancee early October and we only received NOA 1, we havent gotten appt letter for biometric. How long does it take to receive the appt? If we can do walk in biometric without appt is that possible? thanks for the info and help

My husband didnt recieve his biometrics so after almost two months I posted a question on here and was told to call the customer support number 1-800-375-5283 and put a service request in. With in a week of doing this we recieved a letter in the mail stating we had missed our biometrics appointment already. So thats why I found the office and did a walk in so I can get back on track as our case was then put in suspense. (it is now out of suspense) So if it has been over 30 days I reccomend that you do the same and put a service request in.

  13. I went for a walk in this Morning. My husband’s biometrics appointment letter never arrived in the mail and we had missed the appointment we discovered after I had submitted a service request. So the letter we received informing us of to mail in an appointment request and we would get another one. I had no desire to wait and go through this so after reading about walk-ins on this Forum I decided to go for it.

Awesome experience!!! We were in and out within 30 minutes and I think that a high estimate of time. They were well run and efficient which is shocking for a governmental office.

There hours have changed from the first post and they are now Monday - Friday 8 Am to 4 Pm

  14. Hello… I have been searching through this forum and have not seen this answered I may have missed it if so I am sorry.

I am a US born citizen and my husband is from India. We received the receipt from the USCIS on September 2, 2009 and we were told we would receive a Biometrics interview within a month and now it is October 26 and no word or change yet. How long does this tend to take??? Also what happens in the biometrics?

What’s the average time for receiving the Employment Authorization in I am working but it would be nice if my husband could work he is going nuts with the boredom of staying home all the time.

Any help would be great this is to important to me to Not be stressful...

    Regards

    Meghan
