So you have some options.  You can purchase a short term policy (90days) from a website like this https://www.***removed***.com/new-immigrant-insurance/   This is short term catastrophic insurance in case of a major illness.  As a new immigrant you are eligible to purchase insurance off of the health insurance exchange  https://www.healthcare.gov/immigrants/immigration-status/   here is some information on the Oregon exchange as that is the state listed on your profile.  http://healthcare.oregon.gov/Pages/index.aspx  While you are single you will be eligible for premium support based on your income.  Once you are married you must include your husbands income for the purposes of figuring a subsidy if any.  The cost depends on your income and the choice of benefits you choose.  It can be free up to $1500 per month.

The Maryland MVA is difficult.  My wife is from Ukraine and she had a valid Ukraine DL.  They required a translated certified copy of her birth certificate, her passport, her green card and SS car, two proofs of Maryland residency and a certificate of completion for a 3 hour drug and alcohol class.   The letter addressed to her at our residence from the USCIS was 1 document and bank statement was another.  You can sign and date an affidavit for a parent.  They then had to send off to the State Department to verify that the green card was valid.  They did this in writing by snail mail and it took 8 weeks.  They then notified us by mail and she went in and took her written test.  We went to the Frederick MVA and they had a copy of the test in Russian.  She then took her vision test, paid her fee and was issue a "learners permit" until she passed the driving test which we had to schedule online.  The first appointment was two weeks later.  After taking the driving test she was issued a full licenses.  It is my understanding that any licenses issued on an IR5 will expire on the same date as the IR5 and he will have to go back before it expires with his greencard to get it extended.  Here is a link for the drug and alcohol classes  http://www.mva.maryland.gov/drivers/schools/3-hour-alcohol-and-drug-education-program-providers.htm. 

    I want to further caution you that your fathers Russian DL and international DL will not be valid to drive in Maryland.  only visitors are allowed to drive on a foreign DL and since your father is an IR5 visa holder he becomes a temporary permanent resident as soon as he lands so if he is pulled over Maryland State Police like to write tickets for driving without a valid licenses in theses cases.  That can complicate his status as well as his ability to obtain a Maryland DL.  The other issue we ran into was car insurance.  My insurance company would not insure my wife while she still had her Ukraine DL and international DL even though it was valid until we were married and applied for AOS.  

  3. Maryland is tough or incompetent. You choose. We went through this a few years back and they demanded a Employment Authorization or Travel Document. They would not accept the NOA. When we recieved the EAD they said they could not electronically verify the authenticity of the document so they had to do it via mail it took 8 weeks. After the verification came back they said they could not verify the social security number either so they had to do it via mail as well. After another 6 weeks I lost my patients and called my US Rep and State Delegate. We recieved a call from the MVA 2 days later telling us we could come in for her licenses. It will get worse wait until your insurance company finds out your spouse has not been licensed to drive in the USA. They treat them like a new 16 year old driver for premiums. It reduced somewhat after 2 years. Good luck

  7. I think you are cinfusing the requirements. This rule is not for people who CHOOSE to live abroad but for people who are "Stationed Abroad". If the military or private company sends you there and you must go for employment that counts. If you choose to move to another country for a job that might fit a catgory but that you are not stationed at by a US company or government you will not qualify. Simply working for a company abroad that selld goods for the US Market will not work. If it did anyone who lived abroad could sell Hershey Candy bars and claim they were promoting goods for the US market. You have to alter your situation to follow the rules you cannot twist the rules to fit your situation.

  8. At the end of the day a green card is for an alien who wishes to live in the US, it is not meant to be used as a multi-entry tourist visa that you can whip out whenever you feel like coming here for a few weeks and looking around.

    You make some valid criticisms of the current US immigration process, but these are the confines of the system as it stands today. You should take it up with your elected federal representatives if you feel that the law should be modified.

    The OP's wife is not currently in the US, is (presumably) not abroad on US government business, has only ever been in the US for a fortnight, and so based on the totality of the circumstances is not entitled to a green card. This does not necessarily mean that CBP will move to have the green card invalidated, but at the same time they don't seem to be doing any of the things which people who take up residence in the US usually do (maintain a home, bank account, etc.).

    The OP's motivations are his own, I do not doubt them (especially when he said that his original plans changed, necessitating him to stay in Vietnam).

    Amen! If an alien wants to enjoy all the rights and priviledges associated with US Greencard then he or she needs to live here and contribute to the USA not a foreign country. I think it is absurd that the pervious poster would indicate that the op is "promoting foreign trade" when they are clearly gaming the system. Oh and "Navigating the Immigration System" should include following the rules not doing what is easiest for you.

I am not suggesting this but a friend of mine lost his job while his wife was pregnant and she went to the state medicaid office and they suggested that if they were temporarily separated and she had no job she would qualify for emergency medicaid. They filed and legal separation the next day, she recieved medicaid for pregnency and after the baby was born and he foun a new job with insurance they dissolved the separation and maedicaid. Just what they did.

  10. Actually that provision is delayed for a year...the requirement for employers to provide health insurance....but the individual is still required to have health insurance. So when he is required to buy health insurance no later than 1 January 2014 his wife will also be covered as will the pregnancy/delivery. We just need to get him to that point.

    His employer already provides insurance so the delay has nothing to do with him. The delay is for comapnies that do not privede it currently and have more than 50 employees or who do not cover employees over 30 hours a week. He said his company already provides insuarnce so they have to accept his wife and the policy has to include pregnency.

  11. It is not so much whether public or private, it is size of business. No penalties will be assessed against small businesses of under 50 employees. http://101.communitycatalyst.org/aca_provisions/employer_requirements If more than 50 employees, then by all means prosecute if the insurance fails to cover your wife's pregnancy. If greater than 50 employees, certainly apply for Medicaid which has lower requirements than Medicare (for pregnant women and children under age of 21) based on income and need - pregnancy is considered a need and not a disease or "pre-existing condition." Human beings are beings and not conditions. I really hate insurance lingo, even though I work in the field. Besides help for the pregnancy, depending on income level, look into other forms of nutritional assistance such as Women-Infants-Children (WIC) assistance. Also, look for free clinics and Community Service Boards where physicians pretty much work for minimum wage.

    ALL insurance policies must include pregnancy coverage after 01/01/2014. It makes no difference what size your company is. If the company is under 50 people it is not required to provide insuarnce but it cannot pick and choose who to give it to. If ANY business covers 1 employee it must cover all employees no matter how many work for the company. So again he will be able to get a policy that covers pregnency through his emplyer starting Jan 1 and if not they will be fined because they offer insurance period.

    This is not true. I just went through this with my MIL. The CBP said that a return ticket is not required but that a tourist could be subject to secondary inspection upon arrival and must provide an answer as to when and how they plan to leave the country. I had no problems with CBP it was the airline that actually tried to hold us and not let us board. Funny I am a USC so I am not sure why they thought they could refuse boarding to me. In the end she boarded and CBP had 0 issues with no return ticket.

  13. Why would the private employer have to cover her with a pre existing condition? (PS - HIPAA states pregnancy is not a pre existing condition but insurers have ways around it. )

    Obamacare sets up exchanges, etc. It mandates certain big employers to provide coverage, but no where does it stipulate private company insurance have to cover pre existing conditions. If they want that coverage, then they have to buy insurance through Obamacare.

    You are incorrect Obamacare require all new policies(ie-annual renewal of employer policies) after Jan 1, 2014 provide basic materinty benefits as part of the insurance policy not a rider. As far as pre-existing condtions if your employer will not provide coverage then you fall into the catagory of an individual who cannot get employer health insurance and would be entitled to purchase from the exchange and recieve a tax credit if your income allows and your employer would be fined for not providing coverage.

  14. After January 1, 2014 pre-existing conditions can no longer be excluded from insurance policies by federal law. Thank you President Obama. Your employer will have to cover her and if not you will be able to buy her a policy on the new insurance exchanges and they have to cover pregnaency and you could get a tax credit because your employer refused to cover her and they would be fined. I am not sure how old she is but here in Maryland the premium will be about $250 per month for a 30 something non-smoker woman for full coverage halth insurance including pregnancy.

  15. The problem is that the alimony is tax deductible for you because it is taxable for her. It would be no different than if she lived here as a LPR won the lottery or earned a pension and then moved back to her home country and gave up her residency. The lottery winning or pension ares still taxable in the US because that is where they are payed from just like your alimony. If she were allowed to collect the alimony tax free you could divorce, stay together, pay her a huge alimony payment and deduct it from your income therby reducing your tax burden to zero and have your money tax free. See the problem it would be a huge loophpole for tax fraud.

    Ukraine does not recognize dual nationality. Local authorities will treat dual nationals entering the country on Ukrainian passports as citizens of Ukraine.     I have never heard of anybody getting fined for not relinquishing Ukrainian citizenship, or ever heard of anybody have any trouble upon entering or leaving using either the Ukrainian or US passports. You might have trouble if you're a male of conscript age.

    I think the most important points are that you will be treated as a citizen of Ukraine when in Ukraine and a US Citizen in the USA. So for example if a dual citizen were arrested in Ukraine they would have no right to speak with an embassy official and the same is true if in the USA.

    • On a previous visit, you stayed in the U.S. longer than you were authorized.
    • On a previous visit, you came as a visitor, but engaged in unauthorized work.
    • You were previously denied entry or a visa to the U.S. (See "Answers others found helpful" below).
    • You answered incorrectly to another VWP eligibility question. (See "Answers others found helpful" below), or
    • You are using a passport number for a passport that you previously reported lost or stolen (but later found).

    In the first four examples, you may not be eligible to visit the U.S. under the Visa Waiver Program, but you may be able to come with a visa. If the problem is with your passport number, it may be resolved by getting a new passport with a new number.

    If you believe you were incorrectly denied ESTA authorization you may go to the DHS/TRIP Web site and file a redress request through the DHS Travel Redress Inquiry Program.

    The VWP eligibility questions help us determine whether or not you require a visa to come to the U.S. In some cases, people check "Yes" to one of the questions without realizing that their situation is not a disqualifying factor, (in particular questions A and B). For instance, sometimes people answer yes to the question about communicable diseases if they have Pneumonia or a cold, when they should only answer yes if they have one of the diseases in the highlighted link.

    Another common error is to answer "Yes" to the question about having been arrested or convicted for a crime involving moral turpitude (CIMT). You can look here for a more detailed description of CIMTs.

    If you think you may have answered "Yes" incorrectly and were denied as a result, we advise you to contact us so we can review your application. Send us an email (instructions below) explaining why you selected "Yes" to that question, (in other words, tell us what you were arrested and/or found guilty of, as well as the sentence you received, or what your communicable disease is) and we will advise you whether or not your denial can be reversed.

    Reapplying with false information for the purposes of qualifying for an ESTA could make you permanently ineligible for travel to the U.S.
