As you all may see in my timeline, I applied for my wife's residence conditional removal on August 2012, she did her fingerprints in September, and did not hear anything else until April when we got a RFE. We submitted more evidence, including our son's birth certificate (born in Dcember) and on May 16, 2013, I received both, the approval letter dated May 10, 2013, and the actual permanent residenc card, on a separate envelope. Now we are planning to apply for citizenship by July 19, 2013. Best regards!

  2. Hi guys, I am in the process of filling out my wife's I-485 application but I have a doubt about her I-94. Going over the instructions it says that I should send her I-94 along with a copy of her NOA2 and our marriage license. But then, in another spot, I read that she should keep her I-94 for her interview date. So, what is the right path to follow? Should I just send a copy of her I-94 along with the I-485 package, or should I send the original and keep a copy of it for the interview date?

  3. When I sent in ours, I sent in the Tax Transcripts for 2007 and 2008 as well. You can get tax transcripts free, by calling the IRS 800 number. I had mine within 3 days. I can't find the number, but I know someone on the main threads would have it.

    I think the form only said you needed one year if you met the guidelines, but I sent three just in case.

  4. hey jenn, i'm not sure what your particular "strikes" are, but i was worried about a few things for our interview as well - we're both divorced, my fiance has kids, and my divorce was not final until way after we met and even after he proposed. (not sure if anyone else has gone through divorce but it takes a long time).

    anyway, yes they did ask me questions and it was a very good thing that i was there. i'll post in more detail a review this weekend, but i'll try to put the basics. My honey got called up to the interview window three times. the first time, we went up there and they guy at the window wouldn't let me stay with jose, he made me go sit down. i was worried at this point because i had put together all the paperwork - but luckily we had gone over everything the night before and jose luis knew where to find everything. the consul asked him just a few questions - what's my name, when did we meet, they asked if he'd been to the US (no), if he's applied for visitor visa before (yes), and if he had family in the states (he said yes, but distant cousins and he doesn't know where they live). the last question was important because it was info from his visitor visa interview and of course that had to match. the guy took jose's birth cert, marriage/divorce cert, police record, passport photos, payment receipt, medical envelope, ds-156 & ds-156k, and the affidavit of support stuff. i'll detail that out separately. then he gave back a few items from my original packet (don't know why) and then he asked if we had more photos. jose luis gave him the 3 books. the guy asked where they'd been made and jose luis told him i made them in the states.

    okay sorry this is longer than i expected...the second time jose got called up, it was with the same guy and again i was not allowed to join. it was basically some followup questions centered around his kids. if he had kids (yes), how old are they (9, 13), are they coming (no), why not (they live with their mom) and then jose mentioned he hopes they could maybe come visit him someday in the US.

    then the third time it was an interview with someone else and we both went up there. (btw both the previous interactions were in spanish). as soon as we got up there the woman asked jose luis in english what year we met. i think jose was nervous and not expecting to have to speak english so he didn't respond. the woman quickly asked again, annoyed, and then turned to me and said a bit angrily "ma'am, what year did you meet?" so then i jumped in and started answering stuff. she asked me what year we met, then what month. then she asked me if i speak spanish (i'm guessing she assumed jose luis couldn't speak english since he sort of froze up when she spoke it to him. i was definitely worried about this.). i said yes, some. she asked if we communicate in spanish, and i said that when we talk, it is usually in english but when we write each other it is in both spanish and english.

    then she asked me what was the reason for my divorce. she asked jose luis the reason for his divorce (now she was asking him questions in spanish). he was not specific and she pushed him for more. then she asked him what countries we have traveled to together. then she asked me how many times i have been to ecuador. she asked me what our plans were for the wedding. she seemed interested when i mentioned wanting to get married on the beach so i babbled for a second more about that. then she asked jose luis first and then me if we had kids. (though she had already asked me that after the divorce question). she asked jose luis for a second time if he had family in the states. then she asked me what i do for a living. jose luis says she totally changed when I talked about my job (in a good way) but i didn't actually notice. after a moment or two she started shoving the enormous volumes of paper i had included in the original submission through the window slot, and then finally she said "your visa is approved" and gave us the wonderful purple paper. i was so happy i kissed jose luis and i think i might have finally seen her crack a smile.

    i can detail out everything evidence wise we brought, if that helps. let me know.

    as far as the financial support evidence, this is what they took (i had brought more than this):

    - I-134 form

    - all the paystubs i had provided (i get paid weekly, so i included all weeks of dec, plus the first week of sep, oct & nov)

    - my w2 and tax transcript for 2008

    paciencia y fe, my interview is on March 29 and as far as the financial support is conecerned I will have by then my w-2 and financial transcripts for 2009, paystubs for the last 3 months, a letter from my job stating the natur of my work and how much I make a year ($32,000), a letter from my bank stating how much I have deposited within the last year, and a letter from a live insurance policy that I have from my job in the amount of $64,000.00. Do you think that will suffice, or should I also take with me the taxes from 2007 and 2008 also, plus bak statements for the last three months? Thanks in advanced for you answer!

  5. They don't log K-1s in their automated system. It's not that it's not updated, they just don't log us.

    Kjenkins86, the fact that Cuba and USA don't have normal relations kind of benefits me at this stage. Keep in mind that we don't have neither an embassy nor a consulate, but an "interest section office" only. So, in the case of us Cubans once we have the HAVANA Number we could go to the U.S. Interest Section website, print out packets 3 & 4 and schedule the interview. In my case, I had filled them out long time ago and took them to my Fiancee in December when I went to see her. So pretty much right now all she has to do is date the documents and do her medical, whci she'll have plenty of time to do before the 29 of March.

  6. I called the National Visa Center today and they finally gave me the Havana Case Number and with it I called the U.S. Interest Section in Havana and they gave me the interview date for March 29. The NVC said they had received our file on January 7th (we were approved on the 4th), and that they still had it. I asked them when would they be forwarding it to Havana, and the lady said it was hard to tell and asked me to call towars the end of this week. I'm planning to call on Friday again just to make sure they already sent it to Cuba. I'm praying to God that it won't be put in administrative review!! It's important for you out there that are planning on calling the NVC to actually speak to a living rep, and not just go by the automated system. Even today when I first called it said the NVC had not received my file, but when I actually spoke to someone they told they've had it since January 7th. So, definetly their automated system is not up to date. Later!

  7. Today at 12:46 PM, when I least expected it I received a text message from USCIS saying my case had been updated. I rushed online but then the system said that my password had expired. I was so nervous thinking it could be a RFE or worst, that I even forgot my old password. I had to try it a couple of times before it finally allowed to sign in again to watch my portfolio. And YES, my petition had been approved!! I was so happy it almost brought tears to my eyes!!! I'm dying to get home to call my girlfriend and let her know. I'm calling NVC on Wednesday to see if they already got the file. Anyone has their number handy? What do you guys think, will they have it already?

  8. Well, well, well I must be one of the few September callers whose case hasn't even been touched since my I-129F was received by USCIS in Vermont. Why am not suprised? Kjenkins86, I told you that you'd be luckier than me. Aand D don't you worry about it, you'll see you'll get it soon, definetly first than me. It's always been the same story with me and USCIS. It's gotta be something with my last name, and to make things worse my fiance shares it with me even though it's not very popular in Cuba and we are not related :blush: The only good thing is that I went to see her from Dec 4-13 and we spent some of the better days of our lifes together. I was wishing so much to have an approval by the time I got back, but it just didn't happen so I guess all it's left to do is just to continue waiting, at least until the 5 month waiting period has passed by in my case. Congratulations to everyone who have been approved and I wish all the best and a speedy process until you are finally together with your loved ones.

  9. Congratulations paciencia y Fe on on your NOA2! It was about time you'd get rewarded for all the statiscal work you've done for all of us. It's really great to know that another September filer is approved.

    kjenkins86, don't worry about it. Keep it up. Yours is coming, too. No one could have worst luck with USCIS than myself. I havent' heard anything from VSC either. The only thing that keeps me going is that I am going to see my girl on December 4. I just hope to be approved by then, but if not, we have to continue to wait. What else could we do?   11. kjenkins86 and paciencia y fe, I am in the same boat as you guys. I sent my I 129 F on 09/19 and I got my NOA1 on 10/05/09 with receipt date as of 9/25 and it hasn't been touched since 9/29, so I continue to wait impatiently. On Igor's list the other two people that received their NOA1 with reipt date 9/25 too have already been approved, so it's kind of frustrating not to be approved yet, although I'm very happy for them as well as for those who continue to get approved.
