  1. Tebrikler!!He shouldnt have a problem with returning with the letter plus expired GC. Regarding the Citizenship paperwork personally I would prepare and mail it after he is back in the US. There is a section in the Naturalization form which requires the total number of days youve been out of US in the last 5yrs and other such questions with dates and countries visited. It is always safer to fill it in once back as you know with traveling the unexpected may happen and the vacation can be extended or shortened.

  2. I just received the text message we have been waiting for "your case has been updated" I sign in (nervously) of course, and it says "YOUR CARD HAS BEEN ORDERED" WOO HOO :energy::dance: !!!

    I have a few questions, my husband is leaving this sunday to visit family in turkey for a month - it's obvious he wont' have his new greencard and will have to use his old one and the letter extending it a year (good until Jan 2013) Does anyone see him having any problems when he returns the beginning of november?

    Also we can file his citizen papers after October 11, would it be us to have them complete and then me mail them after that time, even though he is going to be out of the country? or should we wait until he returns and then file them?

  3. Kathryn41 thanks for your input - he said he had all the paperwork there, so he was surprised as well. He said as soon as he saw it was a woman, he knew there was going to be a problem!! hahaha

    NickD - he was working for the company that sponsered him - he recieved his greencard, at that time his lawyer stated he could work anywhere now - so he decided to open his own business - he's been self employeed now for over 5 years now. And of course he is/has filed taxes, it was never stated that he didn't file his tax - the question is did his EMPLOYER PAY TAXES on him during the few weeks he was employed with them.

    Hopefully once the IRS transcripts come in this will be solved and he can continue with this Oath Ceremony and be done with USCIS....

  4. I posted earlier, but haven't had any feedback - maybe no one has gone through this before????

    I'm trying to help my brother-in-law out - he went this past week for his Citizen Exam and Interview - he passed his Exam with flying colors, looked like he was getting approved BUT THEN, the interviewer asked him about a company that sponsored him back in 2005, they wanted to know if the company paid federal taxes on him, unfortunately the company is no longer in business, and my brother-in-law only worked for them a couple weeks. He had pay stubs from that time that show federal taxes were taken from him, he then became self-employed after that time. He placed a call yesterday to IRS and is having his transcripts sent to him, and trying to contact a Immigration Attorney to help with this as well. He asked what will happen once he gets these documents and he was advised to get the docs to come to the next interview which is 2 months away.

    From my own experience in the past year with my husbands AOS - I thought if his file was reviewed and documents were missing, shouldn't they have sent a request for this document before he went for his interview and actually take the exam???

    Any help or suggestions would be greatly appreciated...

My husband recently had his AOS appointment on January 13th, at which time we were APPROVED :) but prior to that we had a similar problem with his EAD card, in our case, his last name was first and his first name last!!! We called the 800 # and were told we needed to refile, if it was their typo we wouldn't have to pay, but if it was ours we would have to pay the $340.00 - so we started to complete the new form, and recieved a letter in teh mailed that our I130 & AOS were DENIED due to a no show (we had asked for reschedule) so we scheduled an InfoPass appt - at which time they REOPENED our case - and then also advised us to send in the form for the name change... so we DID (along w/ $340.00) :bonk:

    Now it brings us to our interview on Jan 13th, we were told by the agent who was conducting our interview, that we should have never sent the form in and that his GC replaces the EAD card - and that the agent back @ the InfoPass told us the wrong informaiton about re-filing the EAD..

    So my advice is along as you don't have to get your license renewed (the problem my husband is having) or you are starting a new job - WAIT for you AOS appt. I wouldn't want to see another VJ friend out of money like we are in this case...

  6. Well after my husband called USCIS yesterday, they rescheduled our appointment, so now we will have to wait for another appointment.

    And this time I will keep the papers here at the house. I brought the last one to his brothers as he was there and we were going for dinner, I wanted to surprise him with it. So he must of left it there at his brothers and since then his brother moved - we searched through everything at his new house - with no luck :(

  7. I appreciate all the replies - I have been stressing about this all day long - my husband was suppose to call USCIS and ask them what needs to be done - apparently he must not be worried or they told him some good news as to what to do as I haven't heard from him all day.

    I just hope we bring enough paperwork with us, so there was a list of all the documents they requested us to bring and I don't remember a thing on it.

    I will let you all know how it goes tomorrow :unsure:

  8. Are you referring to the letter of appointment? That's all you will need, the letter on greenish paper telling you what to bring with you and when to be there.

    If that's lost, you will probably find them (security) helpful when you get there. Just make sure you are carrying what was requested on the letter.

    Thank you for replying - that is the whole problem - we can't remember what was requested on the letter - we have both been stressed trying to locate it :(
