  1. If you haven't been to a lawyer yet you are way overdue. I'm the one who always tells people they don't need a lawyer

    but this is not a visa issue it's an issue that can only be solved by a COURT ORDER for him to pay you support which

    you have an absolute right to. The shelter will provide good services and may even give a referral for a lawyer but YOU

    have to meet with one ASAP.

    While a divorce or separation is pending, the court will order support for the non-monied spouse.

    You don't have to prove anything except you have no money.

    That can only happen with a visit before a judge after the initial divorce papers have been filed.

    The lawyer should take the case on contingency because your husband has enough money to support you both;

    that was the deal when he brought you here.

    Im going to meet my lawyer this coming monday. We took care of everything thats necessary first. But, now everything is rolling and I don't want my husband to go in jail or lose his job but he also needs to learn a lesson.. I don't know what's gonna happen next. Pls pray for us..

  2. Thank u for all the replies and advices. That day when i posted my situation i found a nice shelter for me and my daughter. We went there that night and now were in a safe place. Im so thankful about this and my case manager were working so much to help us. It's so amazing how God's wonder works. After i called the hotline number they sent a cab to pick us up and while waiting i seek for God's guidance to give me a sign if that is the right thing to do coz im so nervous where is that cab taking us. Then when i turned around i saw a man standing infront of me and turned around towards me then on his shirt is a big bold written "Go Get Help". I ran with my inlaws and told them about it and they saw it..and They said God is with u and ur daughter. Isn't that amazing?

    And now the only problem of the shelter is they dont have enough trasportation for a long distance places.. But overall everything is good... And one thing i dont have money right now.. my daughter is having a toothache but i dont have money to bring her to the doctor. and she keeps on crying about it. i already applied for the free check up but still i need to pay 85 but i dont even have a penny.. Im getting crazy about it. I wanted to work but where im going to put my daughter i already answered all the applications for free day care but i dont know when theyre gonna approve it.. Oh God!!

    Thanks for giving me this site and i called the number associated with domestic violence.. and they gave me number to contact but the problem is they can only offer me overnight stay.. i need longer than that while im pulling ourselves together..but where im gonna put my daughter now?

  4. Hi I'm already a GC holder and went back home to get my daughterand after all those headaches from her medical finally she is now with me in US. We arrived last May 23rd. Now, my problem is im goin to adjust her status also. She is 5 yrs old. What kind of requirements aside from I-1485 doi need to file?? And how much is the fee for filing her paper? Thanks

  5. If you have had your interview it is probably your green card or if you applied for EAD it could be EAD Card

    Yesssss!!!! It was my GC.. My GC arrived by mail.. I dont have interview after my biometrics. Thank u lord...

  6. YUP!!! Shirr's arrived about 10 working days after we got this notice.

    My mom in law sent me an email that they received a welcome to america notice from uscis... Im so happy.. And since im still here in Phil since Feb 25. Is it safe now for me to stay here until May??? Coz im still waiting for my daughter's medical result.. I left US with advance parole last Feb..

  8. yes, you can have it amended when you come back to the US.

    no, you won't have a problem coming back if you have our AP (i assume you have it coz it shows in your status that your AOS is still pending?)

    just make sure you show both your old and new passport

    Yes i have my AP with me.. By the way my biometrics was just done last February 17th and until now i havent hear anything from USCIS and my mother in law is checking our mails everyday for me since im here in PI. What's next after the biometrics??

  9. I got married last year and last Feb 2010 the consulate gave me one year extension with my passport. Since im already here in my country i decided to renew my passport this afternoon while i was there i encountered some problems coz of my dumbness i didnt know that i need to file the Marriage Contract and get it authenticated here in Philippines.. In short i still dont have a record that im already married here in Philippines coz my MC is registered in US.. And theyre asking me some papers too if i want to use my married name. But since im running out of time to process everything again plus i need to go back in US asap i just decided to renewed my passport with my maiden name again with still "single status". Can i still amend it later on?? Am i not going to have problem goin back to US? My old passport will goin to expire on Feb 2011... and right im jz waiting for the delivery of my renewed passport..

  10. I have a problem and it made me really worry. Last week my daughter's sputum smear tests was all negative the doctor confirmed that to me. Then the assistant told me to call them by monday for the immunization schedule. When i called them they suddenly told me that we need to wait for the result of culture test which will be on May.. My problem my daughter's upcoming K2 visa interview will be on monday.. March 22nd.. What will happen then??? Isnt it unfair to tell us to wait for the culture test? When her 3 days sputum were negative. I thought 10 yrs and younger were allowed to travel once theyre result on smear test are negative?? My daughter is jz 5 yrs old.. Im getting nervous with the US interview next week bcoz of this.. Pls give me advice..

  11. Well primary complex could lead to TB (as it is an infection caused by Tuberculosis bacteria), does not have to lead to TB. Even if she does not pass the medical, she can get a visa and she will have to follow up with a doctor and take medication in the US.

    So even if she fail to pass the medical she can still go with me to fly in US???

  12. Hi im already in Philippines to get my daughter she already have sched interview this march for k2 visa. When i got home i found out that my daughter has a primary complex and started medication first wk of February she is jz 5 yr old. Nobody told me about her condition when i was in US coz her guardian said that they dont want me to worry about it, last wk i got home and surprised all of them bcoz no one knows that im coming home. That is the only time i found out that my daughter has a primary complex. my problem is she have medical at St Lukes and tomorrow will going to comeback to read her tst. What is the percentage that she will pass the medical at St Lukes?? Im really worried about it coz the one year time to get her in Phil will end on Last wk of May.. I need advice pls...

    I already called the Embassy in Manila and they told me to just give them a call a month ahead of my departure here in US.. They said that i just need to bring all the papers and thats it.. Im so relieved now.. Thank u so much for all the supports. you're so helpful guys.. Cheers and Thanks

    True enough, but the date should be one and the same. It would not be a bad idea to allow for sometime to correct any errors or omissions if that is a concern.

  14. hullo confusedgal - any news from the IV unit in Manila ? Did you call them ? wassup?

    I tried to call them last night but then i hang up the phone again before i can even speak to the Customer Representative because

    1. I do not know when i can possibly fly back home since we are still waiting for my AP.

    2. I also don't know when i should schedule my daughter's appointment.

    3. What if i schedule her appointment and i am still here and havent gotten the AP.

    4. How can i apply for an emergency AP?

  15. Not true. The K-2 must be issued prior to one year from your K-1 issuance. It is not necessary that you adjust status first, but you can if you want. We have two sons. One came with Alla at the time she got her K-1, the other came 10 months later after she already had her green card. The AOS has nothing in particular to do with the K-2, if you were to go for the K-2 now you would need to show your status, applied for AOS, that is all.

    Thanks to all of you. I am waiting for my biometrics on Feb 17th, 2010. Then also for the approval of my advance parole. the moment i get it im flying back home to get her.. And, also is there any chance that they will give me the result of my advance parole during my biometrics? Thanks

  16. The fact that you have applied for AOS does not affect your daughter getting the K-2 visa.

    What is important is that you must obtain the K-2 visa within one year of the date you received your K-1 visa. If you came to the U.S. in June, then your K-1 visa must have been obtained prior to that, which means you have around 3 months to get the K-2 visa.

    You need to contact the office where the K-2 interview would take place to ask them what you need to do to start the K-2 visa process. We had to fax the Vancouver Consulate Form DS-230 to start the process, and then began gathering the necessary documents, such as the Police Certificate and we had her medical exam done.

    Before you leave the U.S. to go get your daughter when the time comes, make sure you either have Advance Parole or your Green Card to make sure you will be able to get back into the U.S.

    I recieved a notification that they might release the answer for my advance parole on Feb 17,2009 during my biometrics.
