  1. I just came back from China. After the 5 hours wait and the 3 minutes interview, my wife's green card had been approved. Apparently I sent enough email to the consulate about my wife's 2 years rule, everyone at the consulate is awared about it.

  2. At Guangzhou now, my wife and I went to the consulate this morning and we were told our interview was CANCELED!! We never received anything saying the interview was cancel. We sent a few email requesting a reschedule for May and was told to request it in April but never given a new date. Now we are planning to request the reschedule in April. Anyone has any idea how long does it take for the consulate to schedule an interview?

  3. I have no experience with the reschedule but my opinion is never do a "no show" to an interview. I hold that opinion because no good can come from a no show.

    I agree. I don't understand why they can't just simply give me another date.....

    how does the blue slip work? We are trying to make just one trip to Guangzhou if possible.

  4. I have the interview set on March 14 but the problem is my wife previously entered the US with a J1 visa and the 2 years rule will expire in May. We have stated that in every email we sent to the NVC but they still scheduled the interview in March. I sent an email to the consulate and asked for a reschedule, but received an email from them saying I should send them a request in April to request the interview. So my question is should I just not showing up on my interview date and then ask for a reschedule? I kinda want to go to the interview cause I think they may give us the visa even tho it is 2 months early and we don't want to go there twice. But I do not like the idea we just not showing up on the interview date and I don't have an interview date till April, so the case is in limbo for the 2 weeks of March. I'm still trying to get an answer from the consulate....

    If anyone had any reschedule experience, please let me know how it works.

  6. Happy Holiday everyone. I have the following question regarding my wife's petition.

    My wife came to the US in 2007 with a J1 visa which is subjected to the 2 years rule. She has been stayed in China for 19 months. The 2 years rule will be expired in May 2011. We have filed her partition back in June. We completed I-130 and the AOS and have not filed the DS-320 yet.

    Here is my questions:

    We are using electronic process so NVC is going to schedule the interview with the consulate. If the interview is prior the 2 years expiration, can she still be able to obtain the immigrant visa (with a later date may be?) and enter the US AFTER the 2 years expired?

    We are planning to get the police report and birth certificate the next few days. Do we need to get it translate and notarized in China or can I bring them back to the states to do it?

    I filed the I-130 for my wife and received the NOA1 a month ago. I've been reading the forum and it is very helpful. However I have the following questions (I believe they had been answered already but I couldn't find the answer.)

    My wife is living in Beijing and we want to prepare all the documents early, or at least know where to get them. But I have a few questions.

    Where can she get a police certificate in Beijing? She lived in Boston from 9/2007 to 4/2009, does she need a police report from Boston as well?

    She does not have a birth certificate, what other document can she use?

    I was a J1 visa holder but not 2 yr rule. If you got married in US, why did you allow her to go back to china without applying for a waiver and adjustment of status while she was there? I believe, with that policy, you cannot enter US if you are within the 2 year rule or if you don't have a waiver.

    She came to the states as a trainee and is back home now for her promotion :) She can still enter the US with the traveler visa. What we want to know is if she can apply for a green card prior to the 2 years requirement or she has to wait for the 2 years before she can apply for it.

    I'm a US citizen and my wife is a J1 visa holder. We got married in Feb, 2009. She went back to China in April, 2009 before her J1 visa expired. She is subject to the 2 years residenct rule. We know we can file the I-130 at any time. We would like to know if we have to wait for the 2 years before filing the immigrant visa (IR-1/CR1), or we can file it about 6 months before the 2 years period since it takes few months to get the interview. By the time we are scheduled for an interview, the 2 years rule will be expired by then.

    I searched the internet and asked the attroney and they all gave me different answers. Some said I need to wait two years to APPLY for the green card and some said I need to wait 2 years to GET the green card so I can apply earlier.

  12. Hi all,

    My wife is a J1 visa holder with 2 years Foreign Residency Requirement. She has to stay in her home country for 2 years before applying for immigration visa. We got married in the states in Feb. 2009. She went back to her country in April, 2009.

    Our goal is to get her the green card as soon as possible :) It is almost impossible to get her a J1 waiver. We are planning to follow the path for a K-3 Visa which is a non-imigrant visa. Once it is approved, then we will wait for the 2 years to finish. We will then apply for CR-1 and Adjustment of Status at the same time to see which one is faster.

    Here are the questions:

    1. How long does it take to adjust the status?

    2. What should I do with the I-130 since she cannot file for immigration visa before the 2 years expired?
