  1. Would you mind sharing you experience during the interview, like questions asked and documents that my brother would need to bring that has not already been submitted to NVC. Does he need to bring a copy of the 'Affidavit of Support', photos with my dad, latest photo my dad etc. etc. He had submitted everything that NVC had asked for but I wanted to make sure were not missing anything here. Your response will be greatly appreciated.

    The interview was pretty quick and basic, about 4-5 questions.. i.e. (have you ever been married, who is the petitioner and how are you related, birthdate, what is the work of petitioner and that's it) 'affidavit of support is very important' you have to bring this or copies of records you have submitted to the nvc coz there were instances when some documents went missing during the interview that they'll ask you for a copy. Just bring a couple of pictures, letters. Check your NBI and if it says "No record on file" you are fine.. but if it says "No criminal record" your a bit of trouble... bring along court records if this will be the case and don't lie if you have other records as well i.e. jaywalking etc... they are very strict on this.

    And of course you have to know what your petitioner is doing for a job, how old is he, date of birth and that's pretty it... if you have nothing hide.. then, you have nothing to worry about... Goodluck.

  2. I appreciate the reply. My brother has got everything that you mentioned, unfortunately we also file for amendment on court and you're right it's expensive. We could not get any solid info on what to do from anybody so we went ahead and file of correction just to make sure. I have read a post from someone here who are in a similar situation about a year ago and mentioned that all went well for her and they did not even checked or asked about the entry.

    I understand because i've been in that same situation before, I've had this feeling that the embassy might deny my visa. I've been asked to pay 45K from the local registrar just to correct the entry and some court hearing etc that will take 4months or so... But then again, even if you just submitted the bc without correcting it, the embassy will do the dirty work of checking it out themselves if you are truly single. Tell your brother not to worry, everything will be fine. I just felt bad that you shelled out money for this... Good Luck.

    " NO CRIMINAL RECORD " on your NBI spells TROUBLE for your visa approval...

    It goes like this...

    If you got a 'No Criminal Record' on your NBI and you paid a visit to NBI for another clearance before your interview, they'll tell you that it will be the job of the embassy to make that request. So you'll go ahead with the interview and the embassy will open this issue up.. Never ever lie... tell them what happened, you must be prepared for an explanation... provide all court documents... if you have some jaywalking records or anything that will reflect to your NBI, tell the embassy.

    You will then wait for the embassy to write you a letter to visit NBI. This will take 2-4weeks. After getting this letter, go to NBI, bring all your court records and prepare xerox copies of your documents... no copiers near NBI. After that, NBI will forward the clearance to US embassy... and you just have to wait for your visa. 2or more weeks.

  4. The beneficiary is my brother who is being petitioned under class F2B. He is unmarried and over 21 but his daughters' birth certificate have a false date of marriage which was done so that his daughters can have his lastname (old philippine law). He is in the process of getting the birth certificate corrected by acquiring cenomar from the reported place of marriage and then submitting that to the local registry that can then send the corrections to the NSO. He was told that this process can take sometime and my question is will it be okay to send ds-230 even if there is a date of marriage on his daughters birth certificate. Will sending cenomar with ds-230 be enough for now to avoid any issues with NVC.

    I had read from several article by several lawyers including atty Gurfinkel that this is not an issue as long as the beneficiary is truly unmarried and that there are ways to repair the damage but nobody has offered any advice on how to. I guess you need consultation :-) for them to give you any answers. So for those of you who had gone through a similar case your advice is pretty much appreciated.

    That will be okay... the embassy will check it out anyway...

    What you need to do is

    1. Get the latest cenomar from census

    2. Get a certificate of marriage(will come up not married) from the local civil registrar where you are supposedly married?

    3. A notarized letter of explanation of what happened... never mentioned about false ceremony by a brgy captain or anything.. indicate that was just a mistake.

    4. Never attempt to fix that legally, it will cost you time and money. Embassy is already aware of this.

    Once your NBI says " NO CRIMINAL RECORD" it means that you have some past records of some sort...

    And if you knew of any records for a petty crime or arrests or have a previous dismissed case.

    Make sure to mark "YES" on your DS230 form question 31. Have you ever been charged, arrested, or convicted of any offense or crime?

    During your interview, they will dig into your past records, make sure to explain what happened. The embassy will then contact NBI for your past records and also request the NBI for a "LETTER OF EXPLANATION" declaring that you have no further records/clean. If you have more than 1 criminal record, make sure to disclose this during your interview... Be truthful, don't hide it, they will know this and if you are not telling the truth. you will not get your visa.

    After interview, you will get a 221g form that says 'for further administrative investigation'...just wait, Embassy then will send you a letter to visit NBI to get your "LETTER OF EXPLANATION", bring that letter together with your court records, dismissal etc. make sure to make 1 extra copy of the Embassy letter and also copies of your court records, dismissal etc... on your NBI visit. At NBI, you just have to sign to confirm your visit and NBI will forward the "letter of explanation" to the Embassy...

    this process will take 2-4weeks... if your nbi is about to expire, get another copy and submit it to the embassy. submission of documents from 1-4pm mon-thursday (make sure to check again the schedule. Don't bring electronic devices, celphone etc. else, you'll pay P100 for someone to temporarily keep it outside... )

  7. As of now we are still on the I-864 and Ds-230 stage so no interview sched yet. USCIS asked for my annullment since the father's name was on the kid's birth cert. and that there was date and placeo f marriage too. All i submitted was my proof of singleness like the Certificate of No marriage from NSO and the affidavit of explanation of the situation.

    Finally, got my visa.

    Here's what you need to do if you are a single person with son/daughter but b.c. of child has a date of marriage...

    1. Get a new copy of Certificate of No Marriage (cenomar)

    2. Get an affidavit of Explanation have it notarized.

    3. Get a marriage certification from the local municipal registrar where your supposed marriage was held and the municipal registrar where your child was born. The certification will return negative records.

    3. Don't try to fix the date with your local registrar since this will cost you around US $1,000.00 for court hearings and lawyers fee and will take 3months.

    Stop worrying...

  8. My kid's Birth certificates has the name of the biological father,,date and place of marriage but as of now we got the approval of the I-130 petition. The most important thing is you can prove that you and the mother of your child was not married legally.

    Anyway, did you bring the documents to prove of your singleness during the interview? to contradict that of the birth certificate? What kind of documents did you present?

    I already had my interview and they just wanted me to submit the bc of my child, however my worry is that I won't be there to defend that mistake or hand over the documents/proof since they requested the BC directly from the Census (I'll request for the b.c. then pay and us embassy person will pick it up) and they won't allow me to insert an explanation letter or other supporting documents proving that I and my girlfriend are both single.

    Is it possible to personally hand-over my birth certificate at the embassy and bring along additional documents for proof of being single? How can I make that appointment?

    I am petitioned as a single and unmarried person...

    I have certificates that I am single and my girlfriend whom I had a child is also single.

    I listed my child as "to follow later".

    I had my interview and the embassy seeks the birth certificate of my child which I didn't have with me. I guess I passed the interview.

    History:

    My gf's mother who's already old, filled-up the birth certificate of my child and indicated a "date of marriage" thinking so that the child can have my surname. But in

    reality, the child can use the father's surname even if not married.

    I signed the birth certificate and didn't notice the date, (my mistake).

    How would the embassy treat this case?

    Will i be immediately denied when I submit this birth certificate?

    Will they do an investigation first?

    Correcting this mistake will take me months... are there any faster ways to resolve this?

    Your help will be greatly appreciated...

  10. I am being petitioned by my mom (us citizen)

    I am still single and living together with my partner and we have a 3 year old child.

    I have no plans to bring my child with me now.

    Do I still have to include his name in the DS230 form?

    #19 List Names, Dates and Places of Birth, and Addresses of ALL Children.

    I plan to marry the mother of my child in the future and bring them here. but there's just no way that I can bring my child without the mother right now.

    If I list my child's name, do I have to provide his birth certificate during the interview as well though I am not bringing him?

    I hope that somebody will enlighten me about my issue.

    I just mailed NVC my requirement requirements but on my DS230 form part2

    #31. Have you ever been charged, arrested or convicted of any offense or crime) (If answer is Yes, please explain)

    I checked 'No' instead of 'Yes'.

    I was previously charged but the case was dismissed. The case was about video copyright VRB that I have in my computer shop premise, but I was wrongly accused.

    I was cleared in court.

    My question:

    Does the embassy have my record already since it was the nbi who raided my computer shop.

    What will happen then that I have ticked 'No' instead of 'Yes' of this record.

    Will this cause a denial for not disclosing everything. Or is it okay if I'll bring the court dismissal on my interview.

    What chances do I have?

    All your suggestion is greatly appreciated.
