  1. Hello, I came on a K1 Visa and married my US citizen Fiancee within 90 days and filed AOS, EAD and advance parole. My I-485 is pending with approved EAD and Advance parole. Iam planning to travel out of country for 10 days to bring our US citizen daughter back to USA.

    When I travel out of country do I need to handover either original or Copy of my Advance Parole to airlines authorities at Port of departure as we do for travellers with Valid I-94 ?( I have approved Multiple entry Advance parole. USCIS has sent me 2 copies)

    How will the USCIS know that we are travelling out of country. It says if you dont travel with an approved advance parole, ur abandoining the I-485 application to adjust status to permanent residence right.

    what shld people with approved advance parole do with their AP before they board the international flight. do we need to let someone know about it(airlines or immigration)

  2. Hi I came on a K1 visa and married my fiancee within 90 days and filed I-495, EAD and parole. I received EAD and parole. Few days back USCIS has sent me a letter initially that my Application to register permanent residence has been transferred to California service center. Now they have updated Case status again on USCIS website saying that :The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now being processed at a USCIS office.

    What does this mean! Interview coming up

    I heard recently that anyone who comes on a K1 visa, and files I-485 according to guidelines and whose file is transferred to California service center is waived off interview in most cases right.

    Well suggest me if I will have interview or no Interview?

Hi I just received a notice from USCIS stating that mY I-485 Application for AOS :::::: On January 25, 2010, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action.

    1. What does this Mean ?

    My AOS has been based on marriage within 90 days to my wife, then my fiancee. I have finished my Biometrics and fulfilled RFE for I-693 medical. What shall i expect Next. Will transferring of my case to California service center delay the process?

    Hey all, I have filed for I-485 based on K1 Visa. I have submitted the vaccination part at the time of initial filing certified by a local Civil surgeon. Now I have received an RFE stating " SUBMIT PROPERLY COMPLETED AND SIGNED FORM I-693", REPORT OF MEDICAL EXAMINATION AND VACCINATION RECORD FOR THE APPLICANT ON I-485.

    Wht does it mean submit properly completed and signed( which I did only for the vaccination part, biographic page of applicant and certification page). the physician didnt do any physical exam on me. The nurse came over and I have submitted the vaccination records and she drafted all the information onto I-693 and got it certified by the doctor. tht was my medical.

    2. Now wht should I do, Shall i repeat all the laboratory tests and physical examination along with whole vaccination inspite of undergoing all the medical except vaccination overseas.

    I dont want anymore RFE's

  5. I have arrived on a K1 visa on 19 nov 2009. I showed my passport and visa along with the Sealed packet from the Consulate to the officer at POE. He gave me 3 months and took me with him to an office inside where they stamped MY EAD along with change of ' A- number' on back of my I-94.

    My question is, when we file for AOS and EAD do we need to mention the A-number listed on the NOA2 approval and k1 Visa ! or do we need to mention the new A-number they gave me at POE ?

    fortunately the only difference between the two A-numbers is last 3 digits.

    2. What is non immigrant Visa number : is it the control number or the number in red on Visa?

  6. Hi Iam an Indian Citizen and hold a B1/B2 M/E Visa for 10 years. MY Fiancee is an american Citizen by Naturalisation and indian origin. I have a K1 visa coming up shortly at US consulate in India. we both are legally divorced and I have never overstayed any time. My question is,

    1. We have a child born out of wedlock in USA and our daughter is american citizen by birth. We didnt have any engagement ceremony either, as we wanted to keep things simple and private but our families know our situation and they accepted and support us. Its very Unusual and very rare to have a child born out of wedlock in Indian traditions and customs. Will the consular officer feel that we are hiding a marriage and give us a212 (6) (a) even when we didnt have an engagement ceremony.

    2. Will he issue us a 212 (6) (a) just because he believes it even though there is no documentary evidence for CO to prove a material misrepresentation.

    3. If at all if he issues it how should we apply for a waiver.

  7. Hi I have my K1 visa interview in Mumbai, India next month. Myself( Fiance ) and my US citizen( fiancee) are both divorcees. We met first time in person in 2008 february in baltimore, USA . We have cohabited together whenever I visited USA on my B1 visa. we have decided to marry only after we knew each other well at that point of time. My question is now we have a child born out of wedlock in USA. we have a USA birth certificate of our daughter and affidavit signed by my USC fiancee that Iam the natural father of the child . She is Indian origin like me. Willthis be an issue at US conslate here in India ? As very rarely will a couple of Indian orgin will have kid before marriage in indian tradiations/customs. will the consular come to a conclusion even without evidence that there is misrepresentation of marriage in fact when we didnt even tie the knot ( THATS THE FACT). Will he issue us a 221(g)? and cause more pain agony for myself , fiancee and our daughter?

    The only reason we didnt get married is we both are divorcees and have had traumatic experiences in both of our past lives. we both are progreesive minded and do what is good for both of us and not worry abt wht other people feel or do . we care about each other and ofcourse love and trust one another otherwise we wldnt be having a child before marriage.

    Please answer me how should i go about it
