  1. Hello everybody! :help: i really really am confused with this letter for initial evidence (i 485).if somebody was in the same situation or can help me, pleeeese !!!

    I got this letter that says:

    This office is unable to complete the processing of your application to register permanent residence or adjust status without initial information.

    X In order to process your application further , the petitionet/sponsor on form i 864 , affidavit of support must submit all federal income tax documentation submitted to the internal revenue service (irs) for the most recent tax year.

    (This is really confusing, because i (beneficiary) don t work at all and my husband is on disability and gets social security benefits every month and doesn t work at all and therefore doesn t file tax returns. i included Proof of Income letter from social security, showing how much monthly payments he gets.) He get about 14,000 a year.

    X In ordet to process your application further, the joint sponsor on form i 864, must submit all supporting tax documentation (w-2, 1099, etc) submitted to the internal revenue service (irs) for the most recent tax year.

    I have one joint sponsor and she is the one who makes more than minimum a year. She retired from her company in 1998, but her income (on federal tax return forms) is from rentals. So she gave me federal tax return form for the recent 3 years and i sent them as a proof of her income. But what kind of supporting tax documentation does uscis want if she doesn t have 1099 or w-2 (because the icome is from rentals, not job)???

    Please give me some advice what should i send uscis

  2. Did your petitioner complete an i-864?

    Secondly if you do not attach a W-2 / 1099 w/your tax return you need to submit a tax transcript. your joint sponser doesn't have 1099 from rental income ?if so call IRS and obtain a copy of his/her transcript for past 3 yrs.

    My husband my initial sponsor completed i 864 and my joint sponsor also completed i 864. I just filled out information on each of them about me (beneficiary).

    Does anybody know if I can get from social security any other proof that my husband is disabled? if my husband really should have filed tax return being disabled , there is no way i can get tax transcripts soon if he files it now:((( what to do???

    Have her get tax transcripts from IRS. 800 829-1040.

    But isn t tax documents for 2008,2007 and 2006 she gave me the same thing as tax transcripts from irs?

  6. If you have successfully file the Form I-485 -Application to register permanent residense or adjust status- on or after July 30, 2007, you can re-file this form with NO fee. You must also submit a copy of the Notice of Action notice for the accepted Form I-485 as evidence of the filing of Form I-485 with new fees.

    Do you still think I can send my i 765 just with a copy of i 485 receipt notice and WITHOUT any fee?

    NOTICE the word ACCEPTED not APPROVED....there is your answer.

    As you have been told several times - you don't need as approved I-485 to file your EAD application. Once your I-485 is approved, you will have a green card, so there will be no reason to apply for an EAD, so it makes no sense for you to need the 485 approval.

    The filing fees on the attached Notice of Action notice refer to application fee effective July 30th, 2007.

    If you have filed this form (Form i 131 or Form i 765) concurrently with the Form i 485- application to register permanent residense or adjust status- and your form I 485 was rejected as well, you can re-file this form concurrently with your Form I-485 to adjust your status as a Permanent resident, and you are only required to pay the application fee for Form I-485 ( i.e. no fee is required to file arequest for advance parole on form i-131 and/or employment authorization on Form I-765).

    That what they sent me and the last paragraph really confused me because i don t have APPROVED I-485, i just got Receipt notice saying that my next step is biometrics and they will send me a letter when i ll have it.:(((

    Do you still think I can send my i 765 just with a copy of i 485 receipt notice and WITHOUT any fee?

    I came to us in may 2007 with j -1 visa and it expired in sep 2007, but i m not 2-year subject. I got married to USC on Aug 13, 2009.Sent aos package on sep 15 2009 and on sep 23 got noa1 for i 485 and i-130. my mistake was that i sent i 765 in a separate package and got on sep 23 noa rejection notice that said that the fee for ead was not received and also it said further that if i have already approved noa for 1 485 then i don t need topay for i 765 and just need to send a copy of it. but the problem is that i don t have my i 485 approved yet:(

    i am soooo confused.... please:help: me with with this questions:

    1.does anybody know how long it takes to get noa2 for i 485?

    2.in my noa1 for i 485 says that the next step is my biometrics and they ll send me notification when it ll be. does it mean that i ll get my noa2 for i 485 only after biometrics???

    You only need the NOA1 notice of receipt. NOT approval. Send a copy in with the I-765.

    O my God! but am i supposed to get noa2 for i 485?because it says that i 485 needs to be approved? also when i called uscis they said that receipt notice i got and approved one is not the same thing????
