    Again, the USCIS website will answer you that... They have a "Locate an office" feature that will tell you what your local office is... If Atlanta is the closest that's where it will be...

  2. Hello Everyone!

    I am a Graduate (Ph.D) student on F1 VISA and my wife USC we both got maried in Aug-2007( I came to US on F1 VISA in Summer 2003 for doing MS and later continued towards Ph.D) and we recently filed the AOS at the Chicago office. We received the Receipt Notice (Form I-797). My student VISA expired in Aug-2008 but I was continiously maintaining my F1 status till date.

    My question is I am on a Research Assistantship(RA) and I am getting paid for that which is our only source of income (my wife is stay home mom), now my status is pending AOS that means I should not be getting paid since my status has changed and I dont have any EAD yet? Also, should I let the School know about this? I am worried If the school say's that I cannot get paid since I dont have an EAD yet? What is the right thing to do? How long will I have to wait to get my Biometrics and EAD ?

    Also, We stay in Alabama where will I have my biometrics and interview most likely be? Please give me your valuable inputs or comments.

    Hi there,

    As far as I know, you don't need to stop working while your AOS is pending.... The best thing to do, however, is to call your International Student Advisor and ask him/her what the procedure is in these cases (I'm sure this is not the first time a F1 student has getting married while working on his/her degree). I'm sure they'll know what to do... Please keep us posted!!!

  3. Hello, I am new to this forum. I just need some help. Hopefully, someone on this forum can help guide me in the proper direction.

    I just got court marriage in Manhattan, NY this past week. We have been dating for a year.

    1. I am a naturalized US Citizen, never married before

    2. My wife is a canadian citizen, never married before. Currently on a student visa that is NOT expired.

    I was wondering if anyone know how long this process would be for her to get permanent status?

    Would I file the I-485 first and then file for the I-130 ? or would I apply for both of them?

    Any additional forms I would need?

    Finally, Should I just hire a lawyer for this? or would I be able to do this myself? If by lawyer, how much do they cost usually?

    Hey Darren,

    First of all, Congrats! You should definitely check the guides that "Krautlaus" mentioned in his post and you should file both I-130 and I-485 at the same time...

    As "SaraDee" said, how long it takes depends of the office that will be responsible for your case. The USCIS website gives you a pretty good estimate of the "Processing times" of each of its offices... You should check it out!

    Yes, you'll need a few additional forms (G-325A, I-864, etc) --- it's all explained in the guide...

    Most Adjustments of Status are done without the help of a lawyer; however, if you feel that you need one you should get one (at least have a consultation with one)... If there are not any problems that might affect your wife's AOS process, a lawyer might charge you anywhere from $1500 to $3000 (depending of the lawyer, his/her experience, etc)... If there are problems the price might increase...

  4. Not that I know of. Is it a must at the interview? Do they ask for it when you enter the building or something?

    Hi there... I haven't had my interview yet so I really can't say anything about that... I can, however, refer you to a section on page 4 of the Instructions for form I-130 titled "What if a document is not available?". The section explains what steps you have to follow in those situations... Hope that helps... Good luck!

  5. Well I can't answer perfectly because you don't have a timeline or signature so fill in the blanks... but...

    If you HAVE an A#, then put it there. You may have one from a student visa or something.

    If you don't have one, then put none or N/A.

    Just do what it says, don't complicate it :)

    I think this is right. Please, anyone more in the know, correct me if i am wrong. If this is AOS from a K1 visa, then your A# should be on your second NOA(notice of action)for your I-129F petition

    Our package for AOS is almost ready!!!! We think we will have it ready to go by the end of next week... I have, however, one more question: What's the best way to send it to the Lockbox? My wife and I have been thinking about sending it to the P.O. Box using the USPS Express Mail but I would like to know what services you guys used...

    I have another question. I'm working on my I-131 (Request for travel document) and I'm a bit confused about a couple of questions... In Part 3.1 they ask for the "Date of Intended Departure" I don't really have an specific date... I just want to have it in case I have to travel out of the US... What should I write?

    On Part 7 it asks to "explain how you qualify for an Advance Parole Document", etc... What should I say here? That I'm applying for AoS and that I might have to travel out of the country? In the same part, they ask how many trips I'm planning to take... How should I know now? What do you think I should say?

    Also, on Part 1.3. It asks for my "Class of Admission"... Should that be B-2 since I arrived as a visitor to the US or F-1 (Since I later changed my status to student)?

  8. Hi everybody... Sorry again for being such a bother but I'm trying to get all my paperwork ready and there are a lot of things that I'm confused about... Any help will be greatly appreciated... Here are my questions: (FYI: I'm a F1 student applying for AoS thru marriage to a USC)

    1. The VJ guide says that in my I-485 package I should include a photocopy of my passport (bio page and entry stamps), a copy of my marriage cert and a copy of my I-94... In the instructions for the I-485 none of these documents are listed. There is mention of the passport page if a visa was obtained in the last year but my visa was obtained a few years ago... Should I send these documents anyway? Will it hurt my application if I send them?

    2. A few of the posts in the forums say that students should send a copy of their I-20s... I couldn't find anything about that in the instructions either. Should I send them too?

  10. Hi everybody!

    After a few months of craziness I'm working on my immigration forms again... I'm still working on my Adjustment of Status thru marriage to a USC. The question I have now is regarding the I-130... On number 14 I answered "Visitor" since I entered the country with my B-2 visa. I'm not sure, however, what to write where it says: "Date authorized stay expired, or will expire, as shown on Form I-94 or I-95"... As I said, I arrived as a visitor but then I changed my status to F-1 (Student)... When my change of status was granted I received a new I-94 that had the same number as the one I received when I entered the country but establishing that my stay was authorized for the "Duration of Status"... I'm still in status so... Should I write the date in my old I-94 or D/S?

    Any answer will be greatly appreciated...

  11. I'm sorry but what is RFE?

    RFE means "request for further evidence" or something along those lines. If USCIS needs more information for your case they will send you a letter known as RFE letting you know what, where and when to send it... Receiving a RFE, however, usually does not mean that your case is having problems but that more information is needed...

    Hope this info helps...

    I have, however, a question for you guys that is related to the PO's question. I arrived at the US as a visitor (B2 visa) and then I changed my status to Student (F1)... In the question that asks about the expiration date of my I-94 should I put the date that was stamped on my B2 I-94 or should I write D/S?

  12. Hey guys... A few quick questions... I'm working on the I-130 and on question 15 it asks for the "Name and address of present employer"... Does that mean the petitioner's or the beneficiary's current employment?

    Also, on question 10 of Part C (Information about your relative) it asks for the Alien Registration Number... Should that be left blank or should I write N/A?

    One more... In Question 17 of part C asks about the relatives of the alien... Should I write the name of the beneficiary as well?

    Visacheck, I agree completely with your position: Lies are not the way to go under any circumstances. I think, however, that his question was mostly to satisfy his curiosity about the whole process. As far as I'm concerned, I've never heard of anybody being asked about "unauthorized employment" directly on a family-based AOS interview but I might be wrong and I would like to know what the experiences of other people are.

    A classmate asked me a question today and I couldn't answer: Do USCIS ever ask you about "unauthorized employment" during a AOS interview if your case is family-based?

    I tried to do a search on the web and on VJ and I couldn't find a satisfactory answer. I figured out that USCIS could ask you about it if they wanted to and also that if you are a immediate relative you won't be denied residency if you have worked illegaly but nothing about the actual question showing up on the AOS interview.

    If you have gone from a B, J, F or M visa to family-based residency... please let me know.
