  1. Youre referring to the "Visa USA act" it was legislation that was proposed but never enacted. In it foreigners were suppose to get a visa if they purchase $500,000 or more in American homes, but there were a few catches, they had to reside in them for 180 days through out the year, and they did not get work privileges in the US and the visa had a max term of 3 years. However like I said, it was never passed.

    As for the letter you already sent your in-laws. Oh my. You do realize there are residency requirements when you have a GC? I understand they bought a home in the US but do they intend to make it their residence? I suppose they could obtain GCs through their son (your husband) but they wont be able to keep them if they are not residents of the US. A greencard is a permanent resident card- you must be a resident of the US, not a tourist.

    You also can not have a US passport if you are a LPR/GC holder.

    VERY INTERESTING!! lol

    What can they do?? Traveling visa??? I don't know anything about that!!! All I know is everrrrrrrything for a K1 visa!! They do NOT plan to live here....only for visiting here and there. Maybe after they retire, living in the florida home during their winter in France. I just worry if they come to the US alot, they could be denied entry after so many visits. That almost happened to my husband!!!!

  2. My Husband and I have been together for 5 years. Married for over 3 years now. His parents just recently bought a house for 200,000.00 in Florida

    On August 3rd, 2013 Franck can apply for US Citizenship. It takes 2-3 months to receive.

    (Franck is able to apply for his US Citizenship earlier because he married me, a US Citizenship....otherwise if it was for work related purposes he'd have to wait 5 years)

    After Franck receives his US Citizenship, he can apply for both of you to obtain a green card.

    The cost is approximately $1,500.00 for each person, so $3,000.00 total.

    (Takes approximately 4 months for the both of you for this process, every country is different)

    Both of you would have to go to the US Embassy in France, do the medical testing, interview process and etc.

    After that process, you will receive a green card, and after 5 years you would be able to apply for a US Citizenship and get a US Passport.

    Having a green card would give you a better experience going back and forth to the US.

    Also, if you wanted to stay here for more than 3 months at a time, it would not be an issue; you could stay and go as often as you would want to.

    My mother in law replied back stating she only wants a US Passport, not the greencard! LOL Not sure if that is possible!!!!

    However, I heard if someone buys property for 500,000.00 or more, they can get an automatic greencard. Is that true???

  3. My Honey just had his interview last month, AND they did ask for my divorce decree. They looked at it, and gave it back to him. I also had a copy of it in my original K1 petition...but with us our case my be different, cuz they grilled him a little bit, cuz I was divorced, and just a day later filed for the K1 Visa. (that was a red flag for us!)

    IF they didn't ask for it, you'll be fine.......if they did ask for it, and she didn't have it, then I would email or fax them a copy possibly! I wouldn't waste your time calling....we got nowhere by calling.....they did answer us when we faxed and emailed them. GOOD LUCK!!!!! What questions did they ask your fiance? Tracking the Cronopost is a good thing to do too......I know 5 couples in France that went through the interview process around the same time as we did.....one took only 3 days, and of course for us it was 10 days! If her interview was a Tues....it seems like people that I know from here.....received their visas faster......the 2 of us that had interview on Thurs....for some reason....it was 10 days.

    I just found out my divorce papers in here (USA) . and she went to the interview yesterday. she didnt have them.. i though i left them with her...

    Now im freaking out.. what should i do? i called the embassy in paris and the wont give ME an answer.. can they denied her visa? they took her passport and in about 10 days they will give it back to her...

    im this close ~~> ! <~~~ TO buying a ticket round trip to paris and drop the papers.

    can anyone help me....

    GOD!! if her visa gets denied because of it... I really going to fall apart.

  4. When My Honey came home from France he wasn't able to take a direct flight to Chicago. He had a stop in Dublin, Ireland. This is where his port of Entry was. When he came into Chicago....he didn't have to go through immigration. Is this going to be an issue at all for the adjustment of status. Do we put that his port of entry is Dublin.....cuz that is what it says on the stamp. Or is it where he landed (Chicago?) Just confused! LOL

    My Love came home December 22nd.....Wow.....what a lonnnnnnnng journey this has been, but finalllllllly he's home! We submitted our K1 Visa April 4th, and after RFE, and the embassy losing our checklist we are finallllllllllly together again! 4 months without each other was just awful. But, now things are just awesome, and our Wedding day is January 16th!!!! It's sooooooo wonderfuly having My Love home!!!!!!!! It's just FANTABULOUS!!!!!

  6. OMG....LMAO!!!!! You kill me! Thanks for the laugh (although I'm thonkin that you didn't really mean for it to be Funnny!!!) it just sounds like something My Honey would say! Except he calls me a different name! You need to relocate to Chicago so we can hang out together!!! Yes, I'm sorry he forgot the number! My Honey made it sound like it's already on a piece of paper that they give you at the post office! I better remind him and just stress him out just a little bit more!!!

    LOL... sadly my dear virtual buddy, we didn't think about capturing the tracking number before he gave the chronopost away. When I asked him about that this morning, he's like "willl youuuuuuu just stay still and be pretty and wait for your le petit poulet to come home?" Hoookhaayyyyy I shut up in the corner and just well... be pretty. :angry:

    Oh I'm being funny..lol. I'm sure your honey is a lot more immigration savvy than mine.     Did they ask him that? Where you were born? That is a dumb ? But I know that is one that might be asked! And my honey knows the answer! Lol. Today will be good! He will get an awesome letter in the mailbox! Yes... I'm up! Missing my honey... Trying to make myself sleepy! Plus my feet are flippen cold!

  7. Did he get his medical done and sent in his checklist stating he has all the papers ready?

    I was told to wait to schedule the medical until after he has an interview date because the medical is scheduled very quickly there, and the interview dates are usually given several weeks in the future (from recent experience with Madrid Embassy). That is also who mentioned some sort of checklist that should have been in the packet. He has no checklist. I have now been searching and found this DS-2001 form. I thought maybe that was what should have been in his packet. I am thinking there must have been something missing. I don't know Spanish that well, but I do not recall a checklist with a place for a signature, and I know there was not the DS-2001 form. I did write down all the DS... documents mentioned in his packet before I left. The papers we received were in Spanish, they did not look like the official forms on the USCIS website at all. The instructions also included reference to an invalid website for further information (I found the website through VJ instead). The website referenced included the word 'state' which is not actually in the address.

    The checklist you reference, is that different that this DS-2001? and if it is, can we get to a copy online to print ourselves and mail?

    This happened to my honey and I except the embassy lossssst our checklist!!! They would not schedule our interview because of it! We faxed and emailed the embassy (called...that was useless!) after they received 3 faxes and 2 emails they finally called my fiancé in France. He told him that he sent it! They trusted him and scheduled the intervie finally which put us another 2-3 weeks away from each other cuz they lost it!!! Argggggh

    I wouldn't send anything to them...I heard from someone here that it just prolongs things. If you have already...email and fax them! Tell them that the dos told you that ur missing a paper....and that you have everything for the interview if in fact you fo of course. Hope this helps!

    My fiance had his interview today in Paris and he's been approved for a K-1 visa. :D

    It's my understanding that embassies normally give out either a blue or white or pink or green slip(s). He didn't get any of that and was simply told he will get his visa in 10 days. Question is -- should he be getting a slip to confirm it's approved or no slip is good enough?

    I will post his interview experience shortly. He's on his way back to his hometown and I'll be speaking with him tonight to get the scoop but it looks like we're all set.

  11. For those who have gone through the interview process, what is the best way do assemble and carry your documents? Did you use 3 ring binders with page protectors, an accordion portfolio,...? Any tips would be greatly appreciated. :blush:

    My Honey is bringing that as well, but I read sometime (depending which consulate) doesn't allow cases in the embassy....so he has everything in file folders in large white envelopes as well......just in case he has to take everything out! He will have it in envelopes so there won't be papers flyin everywhere!

    You were free to marry when you submitted the 129f petition.

    Now it's down to the evidence supplied to the CO. If you prove a bona fide relationship you ought to be fine.

    Oh that we have but will they take the time to look at it all? 100 pictures from our visits together, (my Honey was here 3 Times once for 89 days and I went to France once for 9 days) ticket copies with immigration stamps, tons of phone bill records that we talk 2-3 hours everyday, letters and cards from me, gmails, printscreen on our skype correspondance, letters from 3 of my closest friend who have seen us together, myspace, facebook...I'm thinking this is good...

    Probably they won't. Probably they will not need to. I brought a TON of stuff. They looked at exactly FOUR photos and nothing else. Visa approved without a single question, NONE.

    I carried all that stuff back out with a big smile on my face and did not regret bringing any of it.

    I could say "yes" actually. Alla was divorced 5 years before we met. When we started to gather documents we got out her divorce certificate and found that on this one page document they had mis-spelled her name 3 times and NONE were correct. She took it back to the proper ministry and paid a bribe so we could get the corrected document that day rather than wait the normal "Ukrainian 3 weeks". $10 to the clerk got us the document in about 20 minutes and we walked out happy campers. But then...HORROR>>>Alla sees that they dated the new, corrected, divorce certificate for that day!!!!!!!! Saying she was divorced February 22, 2008! I said "good enough for government work, the name is correct and you are free to marry" We sent the petition a couple days later and never had a question. As far as anyone in the government knows, or could prove, she was divorced Feb 22, 2008

    Thank You Gary!!!!! So, they really didn't hassle you with this then........I really don't see why this is an issue.......you're in a dead marriage......you divorce so you can be with your love!! I don't see why this should even be an issue with the consulate.......I'm not worried now!!! Thank you for posting your history!!! You are always helpful with information!

  15. My Love has his interview soon...but we have 2 major red flags. A 13 year age difference...petioner being older but I really don't think this is a big deal cuz if they request pix they will see we are perfect together. Ok....is it awful to have gotton divorced, flew to France the same day to be with My Love, and the next day my lawyer mailed away our k1 petition! I simply divorced from being in a dead marriage soooo I could finally be getting my Honey here with me! Please tell me why the consulate would look down on this? Interview is in December! Alllll I want for Christmas is my Love to be home!!!!! Thank you in advance for your comments!!!

  16. Tax transcripts are more valid as they show you filed. Returns ans W2s don't.

    Easy to get and less bulky to submit.

    800 829 1040. Free and takes about 7-10 days.

    You can also have them faxed to you. Free service also.

    That's not true at all. As long as they have the tax returns with the corresponding W2s, they're fine. Tax transcripts are the exact same thing except they come in one page and the W2s are not needed.

    Many of us decided to use tax returns with W2s and they're still valid. Not more and not less than tax transcripts.

    Makes me feel better.......I read on someone elses topic, that If you make 125% over the poverty level that you don't need the bank statements as supporting evidence or a letter from your bank. Is this true...? The paperwork......is just unbelievable!!! LOL

  17. For the I-134, 4 current pay stubs, letter from employer, I have a letter from my bank notorized of the balance that was in my account.....and how long I've belonged with them.

    Do we need the last 12 months statements of deposits?????? from them?

    For the last 3 years I have copies of the W2 and taxes from my tax preparer guy... ....is what they are looking for too......I didn't contact the IRS for anything......Am I supposed to get something specifically from the IRS, or is this what they are looking for?

    Just freaking out a bit......just want to make sure that I have the proper papers for My Love!!! Thank you for anyone who can help us!!!!

  18. I am getting all the documents needed to send my fiance the documents and formas needed for packet 3 and

    I have all the documents including the bank Letter when I went to my bank the personal banker told that she isn't able to give the amount deposited in the last year the it would have to be researched and I they would charge for each hour of research. I wanted to know is it necessary to have the amount deposited in the last year?

    I wrote the letter myself, though my bank doesn't charge for reseaech and if they did the next thing they would get from me would be a withdrawl slip! My banks' "branch President" researched my account, typed my letter into her computer, printed it and signed it before I could finish the coffee she offered me while I waited. Why do people tolerate being treated like dirty monkeys by their bank?

    Option 1: write the letter yourself, do your own research and let them verify it, it ought to take them 30 seconds or so, what is the charge for 30 seconds?

    Option 2: Attach 12 months bank statements and add the deposits your self.

    Option 3: Do you earn enough money to qualify? Forget the bank letter, it is not necessary anyway

    THEN look around for a new bank. It is absolutely ridiculous to conceive of "personal bankers" and then charge for their service. Frightening really. We have run most of the manufacturing out of the country with draconian tax laws until we are now a service based economy and we are LOUSY at service. Really, this stuff needs to be stood down by everyone or they will choke us to death with fees for everything anyone does. Customer service is a cost of doing business and the banks need to accept that. Mine does.

    I currently make 31,200 and its just me I don't support nobody else. but I think i'll just attach my bank statements along with my letter

    do you really need a bank letter and bank statements if the Cosulate doesn't request it? I did a bank letter, but it just says how much I had in the bank, how long I've been a customer with them......and they notorized it. If you make enough to support Fiance, do you need all of that really?

    Just an update!!!! The Embassy lost our DS-2001 and called My Love today!!!!! We are good to go now for them setting up our interview date!!!! We are now eligible!!!!!!!! :dance: Damn.....they are just killing me!!!!!!

Everyday we call the DOS, (Department of State) and their response is that the embassy received our DS-230 and has it in their system as of October 27th and we mailed them this on October 7th......and that my fiance is not qualified for an interview date yet. I ask "why?" and they reply, "they may need more information from you, or they are back logged." I know of 4 couples here from VJ that sent their packet 3 a week to 2 weeks after us. They are all from France, and they received their packet 4 already with their interview dates next week. So.....backlogged.....hmmmmm why don't we have ours yet? We have faxed, emailed, faxed, emailed the embassy inquiring our case and if they do need additional information. Haven't heard anything from the embassy....NOTHING. So, my question is....if they are missing something (because of their misplacement) do we re-send the DS-2001 and DS-230 part 1 with a paper that wasn't attached of my fiance's additional visits to the US that he wasn't able to fit on the Ds-230 form? Or.....sit and wait???

  22. I was advised by my lawyer to call my senators office regarding my case....just wondering if I do if it would delay further or help things move. We should not have to wait 5 weeks for the arrival of packet 4. We sent our petition April 3rd, 2008 and we just want to be together finally, and this waiting time is just ridiculous already!!!! It's been almost 8 months........my God......2 people that just want to be together....are made to suffer so long.....Just NOT FAIR!

    I know I'm not the only one........in this situation......that's why I'm here on VJ!!! I just wish that I knew about this website a lot earlier than I did, because there has been soooooooooo many helpful people here!!!!

    Call DOS and ask them. I emailed the embassy at 2am here which was around 8am in paris, and then Called DOS today around 11am and they told me that our P4 was mailled out today, and that our interview is 12/9 at 1pm. maybe you should try that too. email then call DOS.

    DOS (dept of state) is FREE and can give you the same information, so it is highly superior. It's a US call so you might want the US petitioner call it, but here it is:

    202-663-1225 press 1, then 0 to speak to a live agent. You may have to call a few times in order to get through because it's a busy line. Open from 0830 to 1600, M-F, eastern standard time. Have your LND case number ready along with the foreigner's birth date. You can ask them if London has gotten P3, processed it, or have an interview date set.

    I called them every day waiting for NVC to get the case, lol. Now I'm just waiting for my fiance to send them P3. Good luck!

    crikey, that sounds like a better prospect than the embassy number! thanks a lot for the replies, i was a bit down after what the dude at the embassy just told me but ive perked up a bit now :-)

    I feel your pain!! It's been 5 weeks since the Embassy received our Packet 3 in France. I saw mannnnnnny timelines for France taking 2-4 weeks to receive packet 4.......it's been flippin 5 weeks now.....I call the DOS every day.......they say, "pending" Our DS-230 part 1 has been processed October 27th.....and no interview date as of yet......Arrrrrrrrrrrrrrrrrrgh this is soooooooo frustrating! I know you are from the UK.....and me from France!
