  1. I just came back from my trip with 10yr GreenCard, When I started checked my email, I received this email from USCIS...this is very strange...Should I just ignore this?

    I already received Approval Letter/10yrs GreenCard.

    Request for Evidence

    On March 1, 2010, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    I wouldn't worry so much for myself but I woudl call them and let them know since it looks like it is someone elses's RFE... They will loose the approval for not submitting the RFE they have never gotten the notice in the first place. probably a typo in the A# or something.....

  2. Thanks Candelari, I am trying to do this without a lawyer. Everything is very strait forward except for getting the 'reciept' for her acknowledging the papers.

    By the way, it is actually against how Russia interprets the Hague convention to serve someone papers. It has to be done through the courts in Russia, and there actually has to be a pending case to get them to do it. It is not as simple and strait forward as it seems.

    The embassy option may work, thank you for the advice. However, it is another logistics problem :)

    Oh Got it.... Serving it quite difficult then. She just needs to sign the acknowledment or the waiver.

    When I filed for child support and custody of my son that was my lawyer's advice. If you can get your ex' signature from him then you will save money by not saving the papers.

    same with another friend of mine, she filed divorce last year and instead of serving him, she asked him to sign a waiver and get it notorize (she did it w/o lawyer too)

    the only complication is to get it notorize which embassy seems the best options:)

    After both our numberous predictions....

    This morning i was having a heated arguement with a co worker :angry:

    Then I get a text message from USCIS saying case update..

    So I logged in and It said on march 11th we ordered production of your card......

    Thank you for your prayers....Prayers do get answered.

    VSC beat me to my prediction by 4 days...

    I am hoping for approval Yurika&Jim next....

    YAY!!!!!!!!! Dancing, rocking and rolling......

  4. You are in a pretty unique position for a guy. Make sure you have copies of her bank statements, and ask for a no-contest divorce, or you will be asking the judge for your 1/2 of the mystery money.

    You don't have to ... If she doesn't agree, you will hire a lawyer and send discover request. She has to answer correctly otherwise you will supena her bank records and that will be a way to revoke her green card (lying to the court is a felony and crimanal record is not a favorable thing in USCIS book during ROC period)

    I suggest don't go down that road; threads, blackmails etc... Just file for divorce, then talk to her, tell her this is over and you want divorce and no more headhache. If you have a change of heart of course you can withdraw (I hope you won't)

    If you talk to her before you file for divorce her friends may give some bad advices to her to place you in a bad place such as ripping of your bank account, calling police with false claim, emptying your apartment, moving her money to someone elses name to look like she never had it, getting into a huge debt to make you liable(at least half of it) for it, sending e-mails to her friends that you are abusing her etc... Once you filed it, what ever she does will be accounted as false accusation...

  5. Mixing things is not going to help you...

    Let's start with original question; you do NOT need VAWA. You will need ROC along the way one way or another. You are not abuse, you will need to prove you entered into good faith. I don't think what more proves good faith more than trying to get rights over your step daughter and all the help you are giving her.

    You need a good (and nice) divorce lawyer. If your step daughter's father agrees to waive his parental rights because someone is ready to adopt her (this will relise him from child support and you will be liable if you can not get full custody of her) court will more likely grant you with adoption. If you get written statement (affirdavits) from grandparents that mother is not suitable for custody and also they testify during divorce, court also may grant you with full custody (you may need to sign for extensive visitation rights for the mother).

    Otherwise no court will will take the child away from the biological parents. There might be some visitation rights for your situation but I am not a lawyer that's why you need a good and nice lawyer to lead you through. Court usually assign mother as primary care giver unless her parents testifies or there is a SIGNIFICANT abuse going on... If you don't want to go through with all these drama I don't blame you. Just collect your financial, common life evidence, prove your relationship was real and move on. Florida is one of the easiest place to get divorce; 20 days for uncontestant?

    After you are done with divorce apply for ROC with waiver. Submit your evidences with one page of summary of your relationship. Expect to have an interview. USCIS is not looking for Abuse, drama, threat etc... Mainly they care about; is it Fraud or not? Did you enter into marriage with the sole purpose of gaining a green card or not? If you are confident you loved this women once, and believed you were going make a life together and you have a proof of that you are good to go....

  6. she doesn't need to be served. She needs to sign and get it notorized by the U.S embassy. Or just sign a waiver and get it notorized by the U.S embassy. Your lawyer should have told you that. Purpose of serving papers is getting her recogniizing the divorce process. It dosent't have to be done third party. You need to serve her if she refuse to sign it her own. Notorizing will make it offical so in case if she change her heart and claims that it wasn't her, U.S embassy seal (notory) will cover that.

  7. MY IO officer told me that I was definetely going to be interwieved while I was getting my biometrics done. yes I freaked out because it takes FOREVER them to schedule interview etc... Everyone in this forum told me relax. I got my ROC done without an interview as everyone said.

    a- randomly selected

    b- IO is not satisfied with the info (including RFE) you have provided

    chill out everything will be o.k...

  8. File for divorce, change the locks, and don't look back. Trust me, arguing with her about settlement or a ticket home is pointless. She is only staying put until she feels secure or finds something better. Pull the chain now - don't wait until the hook is set deeper. Sorry for your troubles.

    You will be suprise to see what people are capable of doing it when the need occurs. I am quite postive that when she needs a place to stay and food to eat she will start working and she will make it. No offense but not all the low wages workers are always the smartest but somehow making it.

    You are so caught up with, guilt , anger, disappointment. You feel helpless and can not set your prirorities. You are afraid of another (bigger) problem to face... My advice

    - get rid of the relationship which is not working- completely disconnect from her (safely)

    -She is a grown women, if whe can manage to come home with a stranger and find friends she can survive w/o you.

    -start working on the divorce with a lawyer and move out.

    -ask divorce lawyer to cover your financials and try to incorporate your financial sponsorship to be her burden in the final decree if it is possible

    -She wants more and you don't have more; sorry but there is song " you don't always get what you want...."

    -Whether she wants to stay in the U.S or not : NOT YOUR PROBLEM..... Let her to deal with it.

    don't you want your own apartment with peace of mind????

    waiting for ROC paperwork will produce approval end of 2-4 months (VSC)

  10. Selected for Interview

    This came as no surprise as my wife posted prank on Internet regards child abuse: Local police and County Division of Family Services did make a formal visit and reports. Rule #1. Any police report increases chance for Interview.

    Letter dated Feb 23, 2010 for California Service Center advised that our case has been selected for an interview. This case was transferred to the Kansas City Field Office to await a time when an appointment comes available. This letter was received in the March 3, 2010 mail.

    QUESTION: I have an important Business Meeting in California in first week of April: How long does it take to receive information for a schedule date for such an interview???? Interview date be weeks or months? :unsure: :unsure: :unsure:

    Wife misplaced her green card as our 20 month old child played with her wallet and lost in house. We torn the house a part but I think that he put the wallet in a wall duct vent. Accidents happen with children.

    Waiting???? No card, nothing on USCIS as progress of petition for Change of Status

    interview is about your whether your marriage is good faith or not. You will not be judge over how good or bad your marriage is. (yes you may be questioned over the incident but Interview is more about the common life, financials etc...). If you lost the green card, you lost it. You can not apply to replace expired green card so you will just tell them that...

    Yes I noticed their RFE...but I did send all the important evidence already and dont have much else to send.

    Tax transcripts for the last 3 years

    Credit card bills

    Phone bills

    Medical insurance cards

    Cards from family and friends addressed to both of us

    A few photos

    Joint bank account statements

    and some other stuff I cant recollect....what else can i send.

    We dont own a house so no papers in that regard, but can send a letter from our landlady.

    I wanted to send it that time but we had to get it notarized and she was undergoing surgery so couldn't come to the notary office.

    But for my AOS I did send a letter from her indicating that she knows both of us and that we live in her rented apartment.

    So if they do send a RFE Im not sure what else to send.

    Your DNAs from the pillows maybe??? I am sorry I can't help it... YOur package looks perfect, no RFE expected....

  12. I log into USCIS 2 times a day once at about 10.30 am and then again at 5 pm...but its always the same old INITIAL REVIEW....now Im scared that they lost my papers.....a lot of people after me have been approved.

    If they had to ask for RFE they would have done it already...right???? or are they waiting for the 6 month mark to ask me for more evidence..i sent everything possible.

    NOA dated Nov 4th, FP Dec 10th and Not a touch or update since dec 11th after Finger printing.....

    I am starting to lose my mind now.....

    your bio is around the time with mine (early bio) or recent approvals... You should be hearing soon. this wednesday maybe...

  13. so candelari, how many times have you logged into the USCIS online and checked your status??? heheheheeee I did it a million times before I accepted that it is not a prank!

    I hope the weather is not causing too much delays for everyone else!!!

    Let's see; I heard the phone from our bedroom at 5:40 am . My husband tought that I completely lost my mind because the phone was by the entrance in my purse!!!!!!!! Got up, saw the message logged in to see my mail first,then USCIS to confirm, then looked at the mail one more time then USCIS, then made him confirm I am seeing the right thing... I am not checking the USCIS anymore but looking at that beautiful e-mail every other hour or so....

    I already accepted the fact it is not a prank but I have a hard time to relax... you know ROC was big part of my worries " did I send every pages for our tax returns, or just a few pages, my old cases haven't got any touches, what if I am getting RFE and not aware of it?, what if I am one of those cases being dragged around for months w/o logical explanation, I didn't list my USC child but I didn't state he was USC......" Paranoya goes a long way........

    Speaking from someone elses experience;

    she was married when she was 16 and got divorce 2 years later with a kid in MExico. She got married to USC in mexico and immigrated to U.S. Couple months later the alcholich husband took off and she had to go thru a lot to get a divorce and complete green card process and everything else. Third marriage came with 2 more kids. Husband already had a greencard so no immigration headhache for neither one of them.... 18 years later divorce again. met another guy live together almost 6 years married for 4 more years and applied for green card for him. Immigration GRILLED that women!!!! especially about the marriage she had it almost 30 years ago.... Since the marriage and their relationship was real, she got it at the end but she doesn't wish even for her enemy to go thru for that....

    PS: couple months later the guy got his green card (unconditional of course after 4 years of marriage), he took off... 10 years of emotional investment went down the drain...

    We made choices hoping we won't regret at the end...
