    I'm seeking some expert advice for my best friend of ten years.

    He entered the country in March of 2001 with a tourist visa from Mexico. He never returned. He's a very honest person and is really reluctant to marry only for papers. I know before you were able to adjust legal status because of time spent inside the US, is this still the case? I'm going to seek advice from an immigration lawyer, but wanted to know if you guys knew of any options I can walk in with when I have the meeting with him/her.

    He has worked the entire time he has been here. He started using a fake name and now uses his real one since mid 2007.

    I'm here for some quick expert advice.

    Here is a quick run down of my situation: Married since June, 2005. Have a daughter born Jan, 2006 (honeymoon baby). I did voluntary departure Jan, 2007. I came back with an IR1 visa on Oct, 2010 courtesy of my wife. Unfortunately, the time away (almost 4 years) put a strain on our relationship. She claims she no longer loves me and is currently seeing some other guy. We currently live apart.

    Now, is there a certain time period we should wait before filing for divorce? I have been in the country for 3.5 months only, and all though our marriage was legitimate and based on love, we dont want immigration to think otherwise and give us any hassle in terms of my legal status.

  3. Ok, but embassy told me that each parent has to file an individual I-864a along with my wife, so my question is who fills out the Household member portion? wife or parent?

    The first time we submitted this, it was filled out with dad as household member and mom as sponsor and they both just submitted copies of returns, but embassy said that because they all live in same household (6 people total in one house) that wife has to fill one out with each.

    I did a search for this here on forums and could not find anything relevant to my situation, maybe mine is somewhat unique.

    My wife petitioned for me but she does not meet minimum income requirement so my in laws (her parents) are sponsoring me. Now because they all currently live in the same household the embassy here in Costa Rica told me that 2(two) i-864A forms have to be filled out, one with each one of my in laws and my wife. My question is a simple one.

    My wife needs to fill out the Household member portion on both forms right? My inlaws just need to sign that they are sponsors (Part 2, Sponsors Promise) and provide each their 1040 forms as well as W2's. Am I correct on this?

    I know the i-864a needs to be originals, but can the 1040 and w2 be copies?

    I appreciate any help you can provide. This is the last thing I need to submit to embassy here. Once submitted I get my passport stamped within a week. =)

  5. My questions are really quick. I have my interview tomorrow for Green Card through marriage and I have to take an original 1-864A because my in-laws signed where they should have printed name, and vice-versa.

    Anyway, There are two or three parts which were left blank. Here are my questions:

    1) On Part 2. Sponsor Promise. In that paragraph there is a blank spot which underneath says (indicate number). Which number is this referring to?

    2) Part 13. Household Member's Promise. The very first paragraph also has a blank spot that underneath reads (Number from line 13). I guess the answer from my first question will answer this one.

    3) Part 10. My current individual annual income is: $. She left this area blank. Will this be a big deal if its blank? My mother-in-law did specify her income for the last three tax years.

    Thank you for much. I hope it is not too late for someone to respond since my interview is tomorrow.
