  1. Has any one had any experience in going through the naturalization process with absence from US over 6 months. I know someone who is applying and they have 1 trip that lasted about 10 months. Will their application be thrown out right away? They have proof of property/taxes/relationships in US during that period. Will they even be considered for processing?

    You need to clarify the situation about what happened in 2003. Was that when the petitioner file the I-130? Was that when the I-130 was approved and forwarded to the NVC? Was that when the PD was current and the beneficiary applied for an immigration visa? Without know which of these events occurred, no one can properly advise you.

    What were the fees paid for - the I-130 or the DS-230? Were fees ever actually paid for the DS-230s and I-864?

    Their case must've been filed in early 90s because in 2003, they were at NVC stage. PD must've been current then as they were receiving all communications from NVC. They paid IV fees. No AoS fees were paid I believe.

    So, in summary, PD was current in 2003. Question now is: Can they reopen the case & what's the procedure? Seems like its been 8-9 years since they last communicated with NVC.

    Another related question to further complicate the situation: older daughter is not even listed as a dependent beneficiary on original petition. Can she even be added now?

  3. Here's how the story goes:

    Brother (US citizen) applied for her sister's immigration. Sister had a son (11 then, 20 now) and daughter (15 then, 24 now). Case was at NVC stage, Case number assigned and fees paid, etc. Something happened in family and there was no communication between petitioner/beneficiary and NVC for over 5 years or so. Case was closed. Now they want to reopen the case (Case number from 2003). Questions:

    1) Is it even possible to open a case that old? What is the procedure?

    2) If open, can children (now 24 and 20) benefit from CSPA? (Case number was assigned at NVC in 2003 I believe, which would mean they were current at that time, right?)

    Thoughts?

  4. My mother-in-law is LPR and has filed a petiton for her <21 son. Does she have to maintain status/domicile in US in order for her petiton to be approved in future?

    Also, I am US citizen and would most likely co-sponsor on this petition as a household member. I might take up a job in Saudi Arabia. Would I still be able to co-sponsor or the fact that I am no longer maintaining domicile in US will disqualify me?

  5. My mother-in-law just recently recieved her brand new visa (IR5) and will be traveling to US within couple of months. She intends to apply for her son as soon as she receives her green card.

    I have 2 questions:

    1- What are the latest wait times for son/daughter applications. Her son is 17 years old. Does he have a chance of approval before he turns 21?

    2- Can she apply for her son and leave the country? or does she have to stay here on permanent basis? Will that have any affect on her son's petition?

  6. My wife had submitted original documents (birth/marriage/police certificates) to NVC alongwith DS-230 forms for her mother last month in a single packet. We recently received a checklist asking for police certificate and petitioner's birth certificate. When we called NVC, the operator said the same thing that these documents are required as they were not submitted.

    How is it possible that they have received some documents in the same packet and did not receive the others? Anybody has a clue??? What should we do at this point? Anybody been thru similar situation? The only thing I can think of is to send a letter to NVC alongwith copies of requested documents and explain the situation. Any suggestions?

    Are NVC saying they got the DS-230 but not the Certificates or are they saying they have not got anything in reference to the DS-230.

    When exactly did you mail the papers to NVC and did you get delivery conformation? It does take them a while to input the DS-230 into the system. We got a Checklist email as well, that was after we had sent the DS-230 and it had been deliverd to the NVC but was not yet in the system.

    Have you spoken to a NVC officer on the phone? if so what did they tell you?

    I spoke to NVC operator and was informed that these two documents are missing. He did say DS-230 packet was received which makes me think they have other documents.

    We're getting ready to file AOS for my wife's mom. I will file I864A as a household member as my wife doesn't work. I know she has to fill out I864 as the primary sponsor. My question is: Does she have to send any supporting documents alongwith her I864, as I'd be sending supporting documents with my I864A anyways? Our taxes, assets, etc are joint.

  9. You just need to fille I-130 for your sister and include her husband & childrens' names on the same form in section 17. When a visa is available for her, they will all automatically get included in the application. This is taking about 11 years or so, I believe.

    Regarding the documents, all you need to submit at this point is the birth certificates of yourself and your sister. They might ask for additional proof such as school record/certificates etc at a later date.

    My wife just became US citizen. She is interested in starting the petition process for her family members ASAP. As a strating point, I am posting these questions:

    What forms does she have to file?

    She has to apply for her parents, one unmarried brother over 21 and two unmarried siblings under 21. So, should she start by applying for parents and file separate petitions for siblings OR let the parents file for their children once they become permanent residents?

    Also, what supporting documents would she need to file for her parents? Would birth certificate alone be enough?

  11. Ok....guess what guys.......they never asked for the passport :D .

    First thing she was asked for was photo ID and she showed state ID plus green card & that was it! they never asked her to show passport. That's all. She's a US citizen now.

    Did your wife report any trips?

    Yes. We had 4 trips together. She was asked in detail about the dates which the USCIS officer kept writing down on the form. We had reported 2 trips on N-400 form already, and the remaining 2 were after we sent in the application. So, she was more interested in those.

  12. I've heard and seen that sometimes they ask for the passport only for identification purpose. I am sure they pre-investigate all the overseas trips beforehand and use passport info to see if there are any inconsistencies.

    We'll see how it goes. Three more hours to go before we find out!

  13. Ok...This is a stupid, probably fatal mistake, but it has happened and we've done it. I just wanna know if anyone else had this situation:

    My wife has her naturalization interview TODAY. At the last moment we realized that we need to have old Pakistani passport at the interview (I just mailed it to our travel agent this Saturday as we're going out of country in 2 weeks or so.... :wacko: ).

    Question: Was everyone asked for PASSPORT at the interview?

    (I know it says on the checklist that you MUST bring greencard, passport & birth/marriage certificate, etc)
