  1. Hafa Adai from the Island of Guam!

I have filed my I-751 last April 2012 and had my biometrics in May.

Todate, I still have not received my new green card. Does it really take 6 months for USCIS to process?

Also, my son who was granted a CF-2 is about to file for his I-751 as well by December of this year.

Can anyone help us on how to prepare the letter of explanation why his Adjustment of Status was not filed with mine?

I sure need a sample or template, if there's any. My son "Followed-to-join" me. Is there any particulars on that letter of explanation?

What joint documentation should we produce to support his I-751?

    Thanks in advance.

  2. Hello folks!

I just need some clarification concerning K-2s. I got my K-1 visa issued last 29June. My 2 kids (1 just turned 18 last July and the other is 12) are still yet to apply for their visa as my derivative. Have married my husband last 11Aug, which is within the 90-day period, but I haven't filed my AOS yet due to some financial difficulty.

In case, since they have 1 year to follow me, can my kids still file for the application for visa under my approved petition within the prescribed period as my derivatives on my I-129F?

Will my current status affect their application for visa?

Is it advisable to file for their visa application first so they can follow me, then we can adjust our status altogether?

Thank you so much in advance for any input/s or clarification. I desperately need advise on what's the best thing to do and what options I have.

They have to apply for the visa within one year, that is a hard line.

In our case we did a K-2 at the time of my wifes visa and a K-2 to follow 10 months later. For the K-2 to follow, we had to include a copy of our marriage certificate and a copy of my wifes green card OR I-797C that she had filed to adjust status. My wife had her green card by that time, so we just gave a copy of that, That was for the Kiev consulate.

You need to write an email to the Manilla consulate and ask them specifically what is needed for the K-2 to follow. They will give you a list and you will need to present everything on that list for each child. The children will each need an I-134 fled for them and the income will need to be sufficient for your family size.

Thank you so much for your replies...they are very helpful...Thank you really...God Bless...

  5. Hello everyone...I came in to Guam on a K-1 visa...got married within the 90 days period...but unable to file for the Adjustment of Status yet due to financial difficulty...How long am I given the time to file for adjustment of status? Is there a time limit to adjust status or file for residency?...Please, I would appreciate information as we also can't afford an immigration lawyer for now. Thanks.

There's isn't any timelimit. Just apply ASAP. Unless you have other than normal circumstances there is no need for a lawyer. You just have to pay the $1010 AOS application fee.

Thank you for the information. I appreciate it very much...but will my inability to adjust my status affect my kids application to follow me here just in case? They still are in the Philippines and are still to apply for visa under my approved I-129. They have until June 2010 to follow me.
