  1. I need couple of information..

    1.What's actually the date of immigration petition became current? Is this the date same as the Priority Date given on the approval notice letter?

    2.According to the CSPA age calculator, length of my immigration(F2A category) petition pending time was 11months and 3 days, but I couldn't find anyone else with this much shorter pending period. And they approved my case and forwarded it to NVC back in May, 2006 after we showed USCIS all the proofs of relationship between me and my mother who is U.S. LPR .. and the case was filed on June 2005. My birth year is 1986.

    3.According to the CSPA Age Calc, only if I am correct about the #1 thing that I mentioned above, my age for CSPA purposes is showing as 18 years 8months 23days. So it seems like I am almost 2years away from my 21st, and when we called NVC regarding this matter.. they are saying stuff like I'm not eligible for the CSPA. Is there anything we should do about it?

    Please help me out with corrections and suggestions, and thanks a million in advance! :)

    Simply get a lawyer. You do qualify for CSPA. Why even youc alled them if you were alraedy in F2A categary.

    Give some time line here.

    When you received approval?

    your pty date?

    list all dates here.

  2. It depends where you will be coming from but if you get to bus stop at 6:00 or 6:30AM then you will have enough time. They used to have this bus stop at convention center before buth now they moved it to Bara kahoo side. it better to be early for an hour than coming 5 min late. Good Luck

    will they hold passport while doing AP? or will give me bacnk. I work in kuwait and i will need passport to go back.

  3. You can always enter into the US, return to KSA, and just have your husband's family send you the green card by Fedex. As long as you have your green card, you can return back to the US. However, you can only stay outside the US for up to 1 year.

    Many of my co-worker's wife's simply make one trip a year to the US just keep their green card active.

    I need your help.

    My brother went to police office in kuwait to get police clearance letter from kuwait police office and they are asking for a letter from embassy which state that you need police clearance certificate for visa. He is paklistani but working in kuwait from last 1 year.

    how & where i should i get that.

  4. My brorther is currrently working in KW. It is his 10 month there. We are ready to send DS230 out with 2 other police reports where he resides in past. Should we also get police report from kuwait even if it is less then 12 month but it could be more then 12 at time of interview?

    a very close family friend came to US last april 2006 but just the couple... they got to leave their 2 kids in the philippines since they already aged out... and heres the case... the dad was being petitioned back in 1993 by his US citizen father that is here in the US. around 2005 their papers started coming in with the kids' names on the documents... joseph which is the eldest was already 24 when their petition was currect and marie turned 21 few month before the interview...

    when their interview date letter arrived, marie's name was still included.. so marie went to all the medical and interview process with her parents which she passed all the test! when they picked up the VISA 3 days later.. they were told that marie's name is not included in the Visa since she already age out and already turned 21... visa are just available for the parents! now auntie Lorna and uncle Orlando is been here in the US since april 2006 and didnt know about CSPA at all.

    now, i dont want to give both of them false hopes till i refer it to you guys.... are the kids compatible for CSPA regulations?? marie was 8yrs old when the petition was filed and im guessing Joseph was 11.

    if there still hope for the kids to come over what is the first step to do??? or do we need to get a lawyer to process all these?

    i know VJ family is more than a lawyer.... and its even totally free... pls...help us in anyway about this case.. we can all relate how to be away for our loved ones... and if they have a chance, why not... thank you very much and looking forward for anykind of help

    A good lawyer may be needed in this case.

    My opinion is based on the facts that you have presented is that CSPA will not apply in this case. Even though Marie may have been able to benefit from CSPA at one point (depending on her CSPA age calculation AND her being unmarried), she is not longer covered because a beneficiary must attempt to adjust his/her status within a year of the priority date becoming current. Generally, this means a separate DS-230 for the child. I don't know if there was any official paperwork on Marie. Listing her on dad and mom's DS-230 does not count as an attempt to adjust.

    Your facts are incomplete and probably difficult to ascertain on an online forum. Your best bet will be to contact a qualified immigration lawyer.

    Navigating the immigration process can be tricky, and I would suggest that people do not attempt to do when there are beneficiaries who may age out. The potential risk for not getting a visa is too great in light of the money it would take to retain a lawyer.

    well, to make the story short, Marie was very young when the petition was filed? and she aged out months before they had their interview... so mom and dad are the only ones that made it here in the US.

    so you suggest we have to get a lawyer?

    Go see a lawyer. I expect that he/she will tell you that CSPA will not apply because Marie did not attempt to adjust her status within a year of the PD becoming current. If you don't understand this then you will need a lawyer's help. The DS-230 is the Immigration Visa Application. Each member must file his/her own DS-230. For example; a family of four would need four DS-230 - one for each member. All other members are listed on each DS-230. It doesn't matter if someone is listed. To benefit from CSPA, the aged out individual must have his/her own DS-230. If one was not filed for Marie then CSPA will not help her.

  7. :blink: I didnt know about ds230...I already paid the 70.00 then mom got a letter saying to represent someone or non as an agent.

    and the last page of that letter said she would be getting a package in 4 to 6 weeks. Maybe thats would be ds230. I am going to hold on and see if I get a package too. But my forms i864/864a are ready. How did you knew about this form? I think when I immigrated; they game me that form at the border immigration dept. before entering.

  8. My knowledge about CSPA finally culminated in a successful application of CSPA to my sister's family. Her son just got visa under CSPA, despite being over 25 on date of visa issuance, because his CSPA age is just over 20. This is a second successful application of CSPA in two families in 2 weeks period.

  9. Basically, CSPA is applicable to many children since it was passed in 2002, as long as the child was under 21 when petition was filed and is still unmarried. It removes the period between priority date and petition approval date (in some cases, as much as 5 years) from current age of eligible child.

  12. Tax returns are fine. Although if you want instead the transcript they send them via fax a.s.a.p

    Youb did add yourself to your mothers i864 as additional income; right?

    On i864 part 3 #8 is checked and yes on that. But no info needed on a, b c d etc because intend imm is already on #2; right. Unless person is comming with add immigrants.

  13. Did you figured out how to fill out i864a on part 2 #13 is sponsors name (extra income) then 1 (one blank) on table a. the name of the principal intend imm. and last part 3 name again of sponsor and one on blank or should it be a. Only one person is intend imm.

    I am stuck on that one.

    My mother filled for my brother who was under 21 at time of petetion. now he is 23 and we have received DS3032 & AOS. My question is when we need to notift NVC that CSPA rule applies to him. we did calculation and his estimated CSPA age is 19y & 6 month.

    Visa # is not current yet but we receive DFS3032 & AOS. currently they processing june,2005 and my brother date is OCT,2005.

    1. should we inform them now via e-mail that CSPA applies to him but cant do exact calulation since do not have current visa # date.

    2. or should i wait for visa # to be current and then notify but by that time DS230 & i-864 will be alraedy mailed to them.

    advise please.

    The AOS and IV bill tells you how to contact the NVC when a beneficiary ages out and CSPA may offer relief. Read the first page of that letter. Follow the instructions there.

    It all depends when the priority date becomes current. No one can make a guess at CSPA application because no one can guess with any accuracy when a priority date will become current. During my time on this forum and others like it, I've seen people miss the CSPA cutoff by a few days.

    The I-864 is a contract, so I am pretty sure that the government wants an original signature. You can e-mail the form to the petitioner, but he will have to send it in with an original signature.

    I mailed the AOS for my brother in with the bar code cover using the US postal service. I don't think there is an option to e-mail it.

    Rushing all these documents in is not going to make the case go faster. The priority date will have to be current before the US embassy/consulate can act. Even if they receive it before hand, they will not make an interview appointment until after the priority date becomes current. My brother's PD became current on Aug. 1, 2009. I checked with the US consulate in Vietnam and they had his paperwork back in July. However, I was informed that nothing could be done until after the PD became current.

    Don't rush and make a mistake. Read the instructions for the forms carefully. A rush document with mistakes could result in a RFE that would delay the case far longer than taking a few days or weeks to get the correct documentations.

    What will be your advice when to notify NVC that CSPA will apply to my brother. at this point we have received DS3032 & AOS. AOS paid and still preparing i-864.

  15. Is there anyone in here who received DS-3032 and AOS bill based on category F2A? I'm already received the confirmation letter from NVC regarding NVC # few weeks ago but until now did not receive those docs.

    Can you guys tell me how long do I have to wait after I received NVC # based on category F2A?

    yes. we received for our brother (under 21 but he is 23 - CSPA will apply) on 09/15/2009.

    here is time lines.

    06/1/1986 1. Son Date of Birth:

    09/15/2009 (DS3032 & AOS received)

    My mother (petioner) filled for my brother and now we received DS3032 & AOS. We paid fee online and sent DS3032 via regular mail & email.

    We are gerring ready for Affedivit of support.

    MY Question is: my mother has no income and she done no jobs since she came to USA in 2005. no tax retrun. no bank account. she live with me. i have a job and i take care of her. Who should fill i-864?

    1. should she fill i-864 and i fill also i-864? or

    2. she fill i-864 and i fill i-864A? or

    3. she fill nothing and i fill i-864 as "only one sponsor"

    please help me with this.

    Your mother files form I-864 and an explanation as to why she was not required to file tax returns.

    You file form I-864a since you are living with her in the same household.

    Only one fee of $70 per case.
