    Lol. Thanks yeah you said you had mail. I was blind. :P How's the rest doing with the RFEs? I hope next week will bring some good news for the rest of us.

    [Phil and I have moved on Sept 1st! Everything went pretty smoothly So glad it's over with, now it's just unpacking that needs to be done.]

  3. We are still in TN, and my husband had to go back into hospital Thursday. They thought he was in rejection, but he turns out to be fine, and may be discharged again to the Lodge tomorrow or Monday.

    In other news, I had mail today from USCIS at last. Not an RFE, not a request for a police clearance, we have, after 10 months, been approved. :dance:

    Me-still waiting. RFE response almost 3 wks ago. No case updates on website or anything.Pray for my speedy approval. :)

  4. So I received this beautiful three blue pages stating "USCIS has been unable to obtain a required FBI criminal background clearance for you because both sets of FP were rejected as unclassifiable by the FBI"

    Submit the following evidence instead of a FINGERPRINT clearance to satisfy the criminal background check requirement:

    1. Your own signed affidavit regarding criminal history supported by police clearances or police records from each place you resided from the date you acquired conditional PR status to the date of this request.

    No fingerprint is required and what I need is to write my own signed affidavit-no notarized is required. Is that correct?

    3. Locally issued police clearance instead of state issued police clearance. You are required to submit locally issued police clearance from localities that do not offer state issued police clearance.

    The cities I was in previously do not issue the police clearance (they are in the same county though) but I can get the police clearance from the county sherrif office instead. Is the county police clearance will be ok / accepted by USCIS ?

    Oh well..no respond so far since I posted this. I guess no one has ever received RFE on Police Clearance or everyone are so busy these days. :(:blink:

  7. The person that took my second set of prints said she didn't think they were any better than the first set. She had no idea what they would do, only that they would not ask me to go all the way back to TN a third time. What they will do, if they ever get to my application, and the second set are deemed not clear enough, is send me and RFE for the police clearance. That will be awkward, as I am not in the state that I live in at the moment, my husband is still an outpatient here in TN following his liver transplant. We may be here well into October as things stand at present.

    Sorry to hear about your husband. Hope you would not get RFE.

  8. I haven't had that, but I am expecting it. I had biometrics done twice because the FBI could not process them. You will need a police clearance, from what I have read while searching here, I would have to go to the local police department with the letter USCIC send, and have them run a clearance on me. It would be for the time since entry to the USA.

    Got it. It says : submit your own signed affidavit re.any criminal history, supported by police clearances/record from each place resided from the date you acquired CONDITIONAL PR status to the date of this request.

    How did it go the second time? If you got it right then you don't need police clearance.

    Three BIO has been done before I got this letter today. All did not come out well due to skin dryness but isn't it unusual to get 3 bio done as what I heard here ,there would be only 2 bio before you are required to get Police clearance if the two was unclassifiable? :unsure:

    Faloak I wonder why it took them THIS long to realize there was an issue with your prints.. :blink:

    I guess what they do is to cleared up all "non-issue" cases first (approval) then the ones "with issue" just started to be cleared up now. :lol:

    I am sorry to hear about your situation too.. I hope you only have to go to your most recent city police department, as I would imagine it would be time consuming if you needed to get the background check from all places you lived in (unless you did not move much).

    Maybe giving a call to your local courthouse would give you some guidance, after all they must have some standard form that can be used to request background check on yourself. Maybe something similar they do like in the cases if you were to apply for concealed weapon's permit?

    Only from places of resident from the date conditional GC was issued to present time. In this case the County Sheriff Office would issue the clearance with no charge (checked with them today)

    It would only be from the time you entered the USA. So not like every place you have ever lived..lol..I've looked into it so as to be ready :blush

    "from the time you conditional PR is granted". Hope you would not get any RFE :)

    We're all in this together! Besides I would feel super lonely if everyone else had gotten approved and left and I was still waiting.

    Gets little paranoid though regarding the postage. Found out this week that our favorite mailman has no longer serve our area and this new guy has misplaced our postage in the wrong mailbox within neighbors aaarrgghh!! Its happened twice so far :bonk:

  10. So Phil was offered the job in NY! They understand our situation with the Green Card and we are on a lease until October 1st anyway. But we're planning to move to NY October 1st so I really hope Phil has his 10 yr GC by then as I don't want to risk doing the change of address with USCIS...

    Congrats on the job offer! let's hoping for the october vsc approvals starting monday ! and all october filer's gc are in hand soon after. wooohooo!

  11. I guess the principle of "innocent until proven otherwise" has turned into "guilty until proven otherwise" for IOs these days.

    It is not just happen these days, "guilty until proven otherwise" has been there forever.

    Instance, in applying for a non-immigrant visa: "The presumption in US Immigration Law is that every visitor visa applicant is an intending immigrant. Therefore, applicants for visitor visas must overcome this presumption by demonstrating such bla bla bla requirements".

    Thus I guess it also applied to I-751ers, that our marriage considered "fraud" until proven otherwise?

    Oh well..

    Don't worry !.. It will come within this month. Btw, You can not go to ASC without a Bio letter, they will refuse you.

    Actually I called the 1-800 number and the lady told me to just try going to the ASC and ask them wether they have recive the re-scheduling letter or I may ask them if I can have my biometric taken (walk-in)

    We have the copy of the second Bio letter though so I might just go there and we'll se what happen then.

  13. Now I am back to the States!

    When checked-in in Asia, the airline system rejected my expired GC so the staff asked me about that, then I handed her the extension letter and she entered 2013 as the expiration date and it went through.So I board on plane!

    When entering US Port of Entry, the CBP officer sent me to "Need More Review" room at the airport for more details about my status (WTH!) There were more than 3 CBP Officer in that room there but they were not doing their job as expected, they were chatting to each other , laughing and talked about one gentleman who got mad at them when he needed to be held there for I guess a very long time.

    Then I saw a woman who I believed was a supervisor then told her that I have a connecting flight that is about to board, then she said Oh ok..I will have someone to take care of you. Then she walked in to the crowd where 3 or 4 officer were chatting and laughing. But she did not appointed one of them immediately instead she also joint the chit chat and gossiping about that one gentleman.

    I started to worry if I would missed my flight. But then 5-7 mins later one officer called my name and have the information checked on the system. Then he said: Oh you have filed the I-751 back in October, then I said: Yes. After that he asked me when did I get married so I answered him.

    Then he said :Ok..we are done now. You are good to go now.

    Now I am waiting for another Biometric Appointment letter. We received another Bio Letter stated that FBI was unable to process my fingerprint card. My husband did send back the original letter to ASC office and to USCIS according to the instruction on the letter for re-scheduling. But it has been 2 weeks since he sent it off, we have not received the new Bio Appt. letter.

    Do you guys think it is ok to wait or should we just go to the ASC Office and asked them if they have receive the re-scheduling letter or have them take my fingerprint as walk-in?

  14. Taking the marriage certificate is a must, when traveling anywhere. I insisted that my wife carry it with her at all times, even when we weren't traveling.

    Did you carry the original or the copy? I plan on carrying the original ( I have also scanned the original on my PC)-just in case

    Carried the expired GC and extension letter. The airline staff didn't check the dates or the letter. USCIS saw the GC and letter. FYI - We didn't have the I-551 stamp on the passport.

    We didn't go to Asia, but it should be a problem. We just got back last week from Mexico. We had a copy of the marriage certificate as well but not the original.

    Thanks for your valuable info! I don't plan on getting the stamp either cuz I think the Extension letter would be enough. I guess it should not be a problem and I good to go and hoping when I come back my GC is in the mail or at least approved! :thumbs:
