  1. 15 months Finger Print Rule.

    Hello all, please help me regarding 15 months rule

    I got my 1751 approved in July 2009. However I lost my 10 year green card in mail.

    I have to apply I-90 ( replacement of green card ) with following time lines

    Applied for I-90 : September 2009

    Finger Prints Done : October 24, 2009

    Card Received : January 16, 2010

    Applied for N-400 : 15 Feb 2010

    Notice received : Feb 27 ( with priority data of Feb 17, 2009 )

    Finger Print Notice : Not received

    Now my question is I have to go emergency outside the country. I am waiting so bad for my finger prints NOTICE so that once I receive I WALK in for Finger Prints. I checked all the others people with my time lines in (Hartford, Ct ) office all of them got Finger Print Schedule Letter. I have not received any thing except receipt ( online status is same as the day I received receipt )

    By reading in this forum I got to know about 15 month rule, can any one help me if they have accepted my October 24 Finger Prints since based on 15 months finger print rule ??? Can any one direct me where is this 15 month rule is listed. Any other suggestion will greatly appreciated

    I am ready to file my N-400 through attorney. Through a lot of posts i read we need to send supporting documents with N-400. But my attorney is saying he will show them supporting document during interview and will not send with N-400.

    Can you guys please suggest me should I send supporting document right now or should with application, does it matter if I send supporting document during interview.

  3. Hello Every One, Here is my case Background

    My I-751 was approved on July,20009. However I never received my GC in my address at Mass.

    In September 2009 I filed i-90 for replacement of GC at same time I got a project in Arizona. At time of filling I-90 I gave my Arizona Apartment address in order to avoid traveling during week days to MASS for biometric appointment. I done my biometric in AZ and also changed my address from MASS to AZ through AR-11.

    But my permanent address is still in MASS with license , lease and bills as proof , however USCIS have my address of AZ.

    I still have not received my GC through I-90 and I am expecting in week or two, But right now I am trying to file N-400 and I want to file form MASS.I am thinking the day I get will get GC I will change my address back to MASS in USCIS and will apply N-400 from MASS without waiting 3 months since that is my primary residency ( just not in USCIS records ) .

    Is it possible I can file right after I receiving GC without waiting 3 months resident requirement since I live in MASS in same district more then 3 years.

    I will appreciate suggestion and help.

    I am having some tuff time with my attorney, he is saying Permenet Residency starts ( the day you remove conditon on your GC, or in other words the day when you get you 10 year GC ) . Based on that he is saying I am not qualifying for applying N-400 and I have to wait 3 more years

    Am I eligible to aplly n-400

    Here are my details

    Married US Citizen in March 2006

    Conditional GC arrived November 2006.

    Condition removed on July 2009 ( Got 10 year gc approve )

    1. In N-400 instrucetion is said ( 3 years from permenent residence ) when Permenent residence start, does it satrt from first day of conditional GC or 1st day of 10 year gc ( after removing condition )

    2, Based on above time lines I am eligilble to apply n-400 ( 90 days before 3 years living with US citizen spouse ) ?

    3 - Do I need to bring my spouse for N-400 interview ( based on 3 years marriage rule )

    4. My Condition on GC was removed on July 6, but I lost card in mail. I think I can apply N-400 on ( Aug 1 , based ) based on 3 years - 90 day rule but I dont have GC ( since i lost in mail, never recieved ) - I applied for replacement of GC by I-90 but I am still waiting. Can I apply N-400 without having physical card even though my GC is approved.

    Question 1 - Do I need to bring my spouse for N-400 interview ( based on 3 years marriage rule )

    Queston 2 - Also can some one confirm 3 years rule with US citizen wife applies from the day we receive Conditional Green Card or after 3 years of receiving permenet GC
