  1. Hi,

    I am a little ashaned to be asking for help on this, however I am really starting to stress out over it. Any advice would be most appreciated.

    My now Husband and I have just recently been married. He lives in the US and I in Canada. Prior to getting married, we have been in a long term relationship for 5 years. He lived in Canada for some time and recently moved back to the US. We had plans to get married and recently decided to do a brief ceremony here in Canada. With a few phone calls we had someone available to do the ceremony for us. We did obtain our Marraige Liscence as well as the Marraige Certificates. My issue is that with all of the excitment we did not think nor obtain his previous divorce decree and proceeded to be married.

    Now since I have pulled the I-130 forms so we could get the paper work started for the CR1 Visa, it states this inf. must be provided. What should I do? Should I leave it as is and hope they do not do a Public Records to see if either of us has been married before? Or is there something I can do to correct this mistake we made?

  2. Haha that's what I read too which is why I want to stay far away from the K3...

    We just got married here in Canada on Monday! We have been in a long term relationship for nearly 5 years prior to us getting married. I am a Canadian Citizen and he is a US Citizen. He lived in Canada for some time and recently moved back home to California where we would like to reside.

  3. I did read through the Guides yesterday and maybe this is where I got confused. When I look at the Guides it gives a link to apply for the CR1 visa, however when the link opens it looks like it is in reference to the K3 Visa? So I would now assum after reading the guides again, that I need to file the I-130 form along with the G325A and wait for a response? How do I let them know I want to proceed with the CR1 at that point? I do not want the K3 or to be told to submit an I129 ect.

    Just straight forward I know how I want to file and don't want any unnecissary paper work or forms that might only confuse me more?

    So I am happy to say that my Fiancee and I were married this past Monday!!!

    My question would be if I should start the process for CR1 Visa or see if I can get a job Sponser in the US were we will be residing? My now husband will be going back to California where he is a US Citizen on Friday. He may be able to get a job lined up for me? So we are wondering if it would be quicker to have someone Sponser me for work or if we should just be patient, apply for the CR1 and then I can start work once it's approved? Ideally we just want the quickest way that we will be able to be together? Any advice would be greatly appreciated!

    One more thing, what is the difference from a CR1 and IR1 Visa?

    I am filing for the I-129F For the K1 Fiancee Visa. I need to provide them with details of our meeting along with proof or documents of relationship. I have a number of pictures to send, however some of them are my only copies which I would not want to lose. Is it ok if I photo copy some instead of sending my single original copies? Or should I only send originals?

  6. I am hoping someone that has filed for the K1 Fiancee Visa can assist in answering some questions for me. I would like to determin the forms that I will need or even a step by step guide. I realize there are steps noted on the Guides, however I would like to be sure I have all of the forms printed out so we can start filling them out, even if it is in advance.

    I so far have the following forms printed out. If someone can confirm I have all the forms I will need, or let me know if I have in fact missed some, it would be appreciated.

    I-129F to Apply for K1 Fiancee Visa

    G-325A x's 2 Biographic Inf. forms to be completed by both myself and my Fiancee

    I-134 Affidavit of Support

    I-765 Application for Employment - Am I able to request a work Visa in advance? I don't particularly want to sit around for 3months until I adjust my status once we are married? I read that you may request to work when coming into the US in order to marry. Sometimes it's approved?

    I-131 Application for Travel Document

    Lastly the Adjustment of Status Form which I have yet to print

  7. Hi, I am going to apply for the K-1 Fiancee Visa. I am trying to determin all of the forms and costs that will be required from start to finish. I checked the search field as well as the guides, however I have a feeling something is still missing? I have the following

    I-129F Petition to be filled out & mailed in by my US citizen finacee. Cost for I-129F is $455.00

    G-325A one form to be filled out by each my finacee and myself - No cost for G-325A form

    Once the I-129F petition has been approved an appt is set up for me to attend the US Consular office for a meeting. I will bring the I-129F approved form along with the I-134 affidavit of Support form? Cost for I-134 ?? Is there one?

    Do I need to fill out the DS-3025 for recent medical exam? Is there a cost for this? Or is there a cost to file this form?

    How about the AOS. Once I enter the US and we marry, I will then apply to adjust my status correct? What form will I require and what is the cost? Do I need to fill out any forms for wanting to legally work? What form is required and what is the cost?

    Sorry for the questions. I am hoping someone can assist me as this is a little confusing to me. I would like to print off all of the forms at one time so I am aware what is required. I can then sit down and fill them out one by one. Even if I get some filled out in advance, I would just prefer to be pre-pairded then waiting. Thanks in advance.

  8. Yes it seems that I am more confused then I thought. So looking at the Guides for the different types of Visa's, I think the CR-1 Visa seems like the best option. Sounds like a one shot deal as in once it's approved, your all set. No need to do an Adjustment of Status ect. And I would be able to work upon arrival to the US. It will mean staying behind for up to a year before we can be together. I was concerned about the CR1 process as there was a comment stating: Applicant will most likely "Not" be able to enter the US during this time?? So I wouldn't even be able to Visit or anything for up to a year? It almost doesn't make sence? If this is the case, I might have to go with the K1 Visa. I just want to be certain that once I arrive in the US I can start work right away. That is very important to me. From what I read the K1 Visa will allow us to get the paper work processed, I remain in Canada until approved and then I can move and commence work in the US?

    So if I go with the CR1 Visa, do I have him file the I-130 form and they will advise what else needs to be done as things progress?

  9. So if he moves back to the US after we marry, he will need to file via the CSC? I gather that stands for California Service Center? Or am I able to process all of the paper work prior to him moving and then file it myself in Calgary? I was under the impression that he had to file this on my behalf?

    Is filing the I-130 the quickest method for us to use? Or should we not get married yet, wait until he moves and the apply for a Fiancee Visa? Or can we just get married as intended and then have him file for an adjustment of status?

    When I checked on the Vermont Service Center's website, it noted there that the I-130 form takes approx. 5 months to process. That didn't sound so bad, however a year is a really long time to be apart especially just after being newly married. It doesn't seem like a nice way to spend the first year of marriage.

    At least I have a better understanding as to what we need to do.

    So step one: Get Married! Step 2: He has to submit and file the I-130 form on my behalf. If we are just filing the I-130 without applying for DCF, are we appling for a immigrant visa or a change of status? If you can offer a suggestion to the best method of filing based on our circumstance, it would be greatly appreciated. I would like to be able to start working in the quickest way possible.

  11. It may have been the fact that he does have a son here in Calgary? He also owned a home here? The first 2 years he was residing in Calgary, it was on a work contract. In total he has been here for a little over 5 years without issue? I think we will start off with getting married. Then fill out the I-130 forms and bring it to the US Consulate in Calgary where they can forward it over to Montreal on our behalf? I am wondering if it will get rejected because he was not an actual resident on Canada? If it is rejected will this hurt us in then having to apply for a Visa ect?

  12. Well here I again starting from scratch. I feel like I am not getting anywhere with my process.

    Just to re-brief, I am a Canadian Citizen and am now engaged to a US Citizen. We have been in a common law relationship for 4 1/2 years. He has been living in Canada as a visitor for the past 3 years. He was initially in Canada on a work contract. 2 years after his work contract expired but he continued to reside in Canada. He would go back home for a week at a time a few times a year if that. Because he was very financially stable, he was able to continue living in Canada without having to work. We are thinking of moving back to the US in the very near future after we are married.

    Now I was informed that we could get married either in Canada or the US and file a petition for Direct Consular filing. This would enable me quick access to reside with him in the US. But I was also told because he did not have actual Canadian work residency, that we are not eligible??

    We have still been in a long term relationship for nearly 5 years? Isn't that what the want proof of? He was here legally otherwise they would not have continued to allow him back into Canada each time without question?

    I called the US Consulate in Vancouver, where the Re-directed me back to the US ConSulate office here in Calgary where I reside. When I called the US Consulate office here in Calgary, she had no clue what DCF was and told me to call the US Consulate in Vancouver or Montreal??? So I am just being passed around without getting my questions answered. If we get married in 2 weeks as we had planned where do I start? Do we just get married and I file the I-130 form for DCF anyway and hope it lands in the right hands? Or do I in fact have to take the long route and file for a Visa? I don't even know what kind of Visa my situation calls for? Finacee? Immigrant Visa?? Please help! I am so confused and really just want to start this process with a positive result.

    Can anyone help? In my search for the best method to relocate with my American Fiancee, I was advised that we should apply for DCF. I cannot for the life of me locate a contact number for the US Consulate in his area? According to the many links and sites I have been directed to - all suggest to contact the local consulate office to see if our situation allows up to apply for DCF? Does anyone know where I can get this very important inf? I will briefly explain our situation below. Any assistance would be greatly appreciated

    I met my Fiance here in Canada over 4 years ago. He is a US Citizen. He was here on a temp. work contract. After the contract expired over 3 years ago, he decided to stay. He was here as a visitor and was surviving off of savings. We have been in a common law relationship ever since and recently became engaged. We have decided that we would like to relocate back to the US where he can work and we can start a new life in California. I am a Canadian resident. So my issue now is who do I call to see if we can actually apply for the DCF? Is it the Consulate for Canada? Or do we locate the US Consulate in his area where we would be residing? If in his area, does he need to call on my behalf or will they allow me to call and explain our situation? Sorry for the long post. I apprecaite the feedback from anyone willing to help.

  14. Sorry I used the wrong terminology. My Fiancee is a US Citizen. He was born in California and lived there most of his life. Maybe if I explain the situation in better detail it will help. He came to Canada on a work contract playing a professional sport. This contract was expired after 2 years, however he had enough in savings to remain here and didn't have to legally work in Canada.

    He did travel back home a few times a year for no more then a week at a time. He did own a home here in Canada and also has a son here.

    He never applied for Canadian Citizen ship. He was always approved back in Canada with no hesitation. This is where I am not sure if we will qualify for DCF? Because he is a US citizen that has been living in Canada for the past 5 years will that be classified as legal? This is why we would like to contact the US Consulate for advice. If he explains our situation, they can at least let us know if we even qualify. Otherwise we will have to take the long route.

  15. Thanks to everyone for the links, advice and suggestions. It has given me a better understanding to the process. Reading more on the DCF this seems to be an option I am considering. From one of the links posted, I should be able to have my Fiancee contact the US Consulate in his area for guidance. It was posted that he can explain our situation in detail and they will let him know if DCF is approved for us to file. If we are denied, I believe I will file for the Fiancee Visa.

    The DCF seems to be the most convinient and cost effective method. So I hope we are eligable

    I was actually advised via the phone by an Immigration lawyer that I could apply for a work visa, then get married and adjust my status once in the US. So I am glad I found this forum as I want to be sure to get this right the first time. Any small error seems to have a long term impact.

  16. No he is not considered a permanent resident of Canada. He is still considered a US resident. I have been informed that I should apply for a work visa. Enter the US for supposed work purposes only. In that time frame, we get married while I am there and then apply for an adjustment of status. I would think because we have been in a common law relationship for so long, they wouldn't really pose a problem with why I want to reside there, however I don't want to take any chances being denied. He is planning on moving fairly soon and we need to be pro active and do it right so I can join him as quickly as possible.

  17. So should we get married here in Canada? And would we need to get married before he goes back home to the US? Or would I need to proceed with this Direct Consular Filing first before we do anything? Would it be wise to ask about a job transfer in advance or would it be in my best interst to wait until we are married? I like how simple your recommendation is. Is it really that easy?

  18. I am looking for any helpful advice!! I am at a complete lose on who I need to contact and where to start. My Fiancee is a US Citizen. He arrived in Canada 5years ago with a Contract to work. We have been in a common law relationship for a little over 4 years. We have recently became engaged.

    He is now wanting to move back home to the US {Los Angeles, California}

    My question is since he is currently living here, should we get married here in Canada? Or should he move back home and in the mean time I apply for a Fiancee Visa? If I can get a job transfer, is this the best method? Then we get married during the time I am there to work? I just don't have aclue on where to start or what we should and shouldn't do. What Visa's do I apply for? I have been in touch with a few immigration lawyers, however the cost is much more then I am wanting to invest. Approx. $2000.00-$4000.00 I would really appreciate any help and advice
