  1. called their 1-800 numberto check today.

    They said they are currently processing petition submitted 21 days ahead of me. So apparently it's not behind

    the average processing on this site shows 59 day instead of 150. Where did you get this number?

    Chris, it sounds like yours isn't late and should be processed soon. Good luck to all of us

    Went through the same thing last year..... don't worry, there are just some cases which take longer than others.... keep the faith, and everything will turn out fine!

    I think your looking for an answer which I don't think anyone can give you until you actually either try the process, or contact an immigration lawyer about your situation. Even then, the decision will be made by the people who are reviewing your case.

  3. I'm so happy for all you guys. It's good to hear that things are finally starting to improve for some of us stuck in this dreaded limbo.

    I can't wait to get done with this and be together with my fiance.

    What do you guys think we should do. We haven't gotten anything from them except this email, which seems to suggest that we should just shut-up and wait for another 6 months.

    What is that supposed to mean. My fiance went and got an infopass appointment and they told her they don't know anything and we should just wait.

    We are in the process of writing a letter to her Senator, anything else we should be doing.

    Our lawyers tells us all of this is useless and we should just wait.

    Anyone else get a similar email and what did they do?

    PS: we got touched on Sept 18 (two days after the email) nothing after that. :(

    I received the same email, and have gotten it actually 3 times. I involved my congressman, and received the same response. Don't get me started on lawyers, they haven't the authority to do anything, that you can't do your self. The only time they really are useful, I believe, is when you are actually in front of a board of immigration appeals, or some other authority in order to argue your case.

    After following up with the NCSC via email, I have actually gotten a dialog started with the officer who has taken my emails, and hopefully it will lead somewhere.

    Other than that, just waiting..............

    I just looked at your timeline, you most definitely are in the same boat as us. What did the officer tell you about the email and its meaning.

    The thing that bothers us is that we have not even received an RFE or anything yet. It almost seems like that no one has looked at our file yet and that email is is sent to justify the delay on their end.

    I hope that you're case is resolved quickly. Its sad that we are still stuck at this initial phase and still have many more of these government obstacles to go through, just to be with our loved ones. :crying:

    Whatever you do, no news is good news..... don't assume anything! I did let my mind wander a bit, and thought there were problems, and was trying to figure them out, in order to solve them, but there weren't any...... just "stay the course", and everything will turn out fine.

    The officer / congressman / senator basically all got together and said the same thing..... "Pending until background checks are completed"..... IMO: Getting the congressman / senator / dialog with CSC officer involved did nothing for my case, and it was just going to run its course, and get approved when the background checks were completed.

    BTW: NOA2 as of 10/15/09 :dance: ...... USCIS website still showing RFE status of 7/17/09... no email / text message....... just received a hard copy in the mail yesterday that the petition was moving on to the NVC in NH..... Way to take advantage of all that "state of the art" technology! :bonk:

  5. Sending money is of no concern to USCIS. I would suggest that USCIS was just starting to review your petition when it sent the RFE, and then it got put back in the pile.

    That is what I thought too, and guessed it would have ended up in a "smaller" pile, instead I might have gotten pushed back to the end of the line~~~~

    I don't think sending money would be a big issue as well, especially at the USCIS level, maybe something at the interview level?? But I do agree it would tie into the affidavit of support at the consulate level.

    I have been in my relationship for 4 years now, and we chose to get married, so we started the K-1 visa process in March 2009, CSC. Anyways, It has been a long time, and still waiting on NOA2, and it seems that my background check is causing a problem, of which I have no idea. Clean record, no arrests, nothing. Then I was talking with a friend, and they asked about if I had sent money to my fiance. So, yes, I have sent money directly to my fiance on many occasions. Mostly when I was travelling on vacation, wiring the money there and taking advantage of a good exchange rate was a good idea at the time I thought. There were also other times when I sent my SO money just to help make life easier for her.

    So has anyone had this "Sending Money" issue come up at any time in their visa journey? If so, big issue, no issue, anything?

    You said it seems as though your background check is causing a problem? What would make you think this? Were you sent something, or is this just a simple assumption?

    If you have no proof or have received nothing regarding your background check, then there is no reason for you to think this has anything to do with the delay in receiving your NOA2.

    In regards to wiring money to your fiance, I have never heard of this being an issue. I myself never did that but I have met people on here who have (LOTS of people) who have had NO issues with that whatsoever. Some people argue it's a good idea to include Western Union receipts showing you sending her money because it shows you're attempting to provide for her and take care of her, while others say it's a bad idea because it shows your fiance is relying on you for money and we both know there are too many stories out there regarding a foreign person taking advantage of and using a U.S. citizen for their money and a shot at coming to America.

    I will not say either side is right, but it's up to you as to whether or not you want to provide this information.

    I am not sure if you SENT the receipts to show that you wired your fiance money, so it'd probably be better if you included this in your response.

    If you did not send receipts showing that you sent your fiance money, then this is a non-issue, as there is absolutely no way for anyone to know besides your fiance and you that you sent her money.

    I did receive an RFE back in July, sent it back in right after. I guess the money issue was an assumption on my part, because couldn't think of anything that could possibly cause a delay as long as this. Also, did not mention sending money or provide receipts when filing the K1 package.

  8. well, i just got an email yesterday informing us that USCIS has received our RFE response. according to the timelines, many applicants get their NOA2 very soon after the RFE response, so we're keeping our fingers crossed!!

    just for the sake of record keeping, which dates do we use for the RFEs in our timeline? currently, i used the date printed on the letter as the RFE date, and i used the date that i mailed our response as the reply date. i know it's nitpicky, but good data makes for good stats.

    I used the date I actually got the RFE in the mail. I think that would make more sense. The reply date is the date you mail out which is correct.

    Seems like your approval is coming shortly. I am still waiting for someone to pick up mine from the post office. It got delivered on Saturday and they left a notice.

    since the uscis email last sunday, we've had 2 more touches - yesterday and today. i added email and mobile alerts to our case, but i still find myself checking the website nearly every hour. what more do they want???!!! i feel like the last march filer still waiting, and according to the timelines, that's almost true!!

    Well, don't worry. Your not alone, at least there are 2 of us March filers still hanging around. Totally sucks when you feel singled out. :angry:

  9. Well, I guess you can add me to the long list of frustrated March 09 K-1 filers with the uscis..... You take your time, fill out the petition, and cross your t's and dot your i's and then just pitch it into a big black hole..... hoping with any luck it will find its way out the other side, so you can get on with your life. :angry:

    So sorry to hear about your frustrations, guys. It is insanity that USCIS has so much power over our lives. I know how hard it is to stay strong, but you have made it this far, you can make it still. Kimbear, I went through the same thing with my fiance where we were snapping at each other over every little thing. It is definitely the uncertainty that makes us this way. Hopefully now that they have found your case and it is back at USCIS, they problem can be resolved quickly. Most likely it was some box USCIS forgot to check or something they didn't include. Aeb2009-have you contacted your local officials? Your RFE should have received a response by now! Did they even acknowledge receipt of it? Good luck to you both. Good news is right around the corner. I'm sure of it!

    Hi Menina, yes they received it (the RFE), and I have contacted all of my local officials. Thanks for the well wishes..... I wonder how the process would run if people who actually went through the process were running the show over there at uscis?? I bet a lot of the timelines would definitely be shorter! :D
