Thanks LA, that's a big help. I spoke to a lawyer but he wasn't anywhere near as helpful as this. I think I will also do option 3, although as we are renting our house here, we're going to have to use a family member's address & will only have that and tax returns to show. I hope that will be enough evidence that we want to return.
I feel the same way as Himher, I don't want to put this on hold...I think what I will do is this:
We leave US in Feb 2010 on return flights, come back June.
Submit I-751 in Dec 2010 (my 90 days) & return when biometrics appt is scheduled (I'm assuming that will be sometime between Dec-Mar when GC expires).
Return again once new GC is in hand (hopefully no more than 6months later) & apply for I-131, which should then cover me for the remaining 2 years we are away.
I know that at any point when I return I run the risk of being denied entry, but I guess I'll just have to take the risk. It seems crazy that USCIS don't make better allowances for people like us.
Meanwhile, I'm still trying to find where I read about being out of the country for more than 180 days. I think it said that if you're out beyond this time it puts a red flag on you or something. Anyway, if I find it again, I'll post it.

I'm also a conditional status. I been out of the country since, I got my 2years visa but I have to go back to states every six months to avoid problems and so far I have no problem traveling back and fort. I am working in one of the US Army Contract in Kuwait. I filed the petition to remove my conditional along with supporting documents on 16th September of 2009. Received my extension one year green on October 2009 and also, done my fingerprints. This year I received another mail from USCIS says "MY CASE IS PLACED ON OVERSEAS HOLD" so, I have to go back to US later this August I'll see what I can do.. I'll keep you guys posted on my case...

Is your job for a US company? If so, you could apply for expedited citizenship for your wife under 319b. (Search forums.) If not, you should have to demonstrate that your job is temporary in nature, and apply for a re-entry permit, although that would only permit your wife to be out of the country for 2 years before she would have to come back to the US and apply for another re-entry permit. If you apply for removal of conditions while living abroad - assuming she is able to maintain her permanent residence in the US, possible, but not easy - it is likely that you're case will be put on overseas hold. (Again, search forums.)
Bottom line, it would be much easier if you waited for your wife to be naturalized before looking for work abroad. If you don't want to wait, you'll have to weigh the hassle of all the re-entry permits and overseas holds and possible loss of her GC with just going and then re-applying for a new GC when you guys decide to come back. Of course, it is rather difficult for the wife of a USC to get a tourist visa to visit the US, but it might be easier for Japanese than for other nationalities, ie Mexicans.
If you can get a job with the US company in Japan that is "engaged in the development of US foreign trade," I think 319b is your best bet. It is mostly used for military service, but there are also possibilities for missionaries and employees of US companies.

HELLO EVERYONE!
I was busy for couple of months and I just got back to normal routine :-)
Please I need some input from you guys. I filed my Petition to Remove Conditions on Residence(Forms I-751)due to divorce on 6th September 2009. Received my NOA 21st September 2009 and done my fingerprint in US Embassy in Kuwait and I mailed to Vermont Center Service on 11th November of 2009. on 2nd December 2009 received another mail from USCIS says;
"USCIS records indicate that your parent filed a Petition to Remove the Conditions on Residence and that this petition was forwarded to your local office for an interview. For that reason, your petition has been forwarded to the district office so the your petition and your parent's petition may be adjudicated together. Your parent's will be informed of the interview date in a separate notice, local address is in Houston TX"
When I read this letter I was confused why my parent filed a petition to remove the conditions on my residence. My parents are both passed away and their not US citizen so, I called USCIS about this letter. The operator I talked to said to disregard and to wait the notice for interview. But then, I still didn't receive any mail since 4 months. I made another phone call again. The lady was very helpful and she says in 60 days I will receive mail from USCIS. On 06 April 2010 got another one saying that my case is currently under review and I should receive a decision or notice of other action within 60days. Finally on 06 May 2010 I received a letter from USCIS Vermont Service Center that my petition has been placed on Overseas Hold and adjudication is still pending by this office.
My questions would be why the USCIS is unable to process my petition if I'm outside the country? I am working in one of the US Government Contractor here in Kuwait. Why I need to return to the US before it held the process? Thanks for your advance input. I do much appreciated.

I think you said you got divorce last August. Then, you should not file the petition jointly. You need to have it waived. Here is the link for you, you need to download & read the Instructions for Completing Form I-751 USCIS FORMS
Thanks. I filed the l-751 based on marriage in good faith/ divorce on 9th Sept 09 and received the NOA (I-797) 1st Oct 09. My question, if I still need to submit the documents their asking for. Below are the documents need to submit;

: Tax returns
: Birth certificate(s) of any children born from the meriage

If you have your divorce decree file your removal right away. Don't wait for the 90 days prior to your greencard expiring.
Yes, I already did and received my l-797, Notice of Action three days ago. I am waiting for the biometrics appointment. My concern heres if I need all these documents below? Since, I filed waiver..

They need you to prove that your relationship was real. You have to prove the validity of your relationship. You have to show them documentation that you entered the marriage in "good faith" and it just didn't work out. You have to show them that you were "merging" your lives together. Joint banks accounts, joint credit cards, medical insurance, renters insurance, anything with both your names on it, leases, affidavits from family, friends neighbors... anything that can prove that you were both married and you are not here to commit immigration fraud because you entered the marriage in "good faith". You have to prove to the USCIS that you did not intend on coming here simply to get a divorce and get your greencard by marrying a US citizen.

If you have submitted all of this then you are fine. If something is missing, mail it to them and also bring a copy with you for biometrics as well. It's not an RFE, it is a notice stating they are taking action on your case and you will be receiving a biometrics appointment letter soon. Get your documents in order. Make sure you have everything on that list there. Don't worry it's just a processing letter to confirm they have received your documents and they are processing your case. *hugs* smile
All these right here I haven't send them yet, the only thing I can provide is the tax returns and medical insurance. The rest I don't have it because we're both working overseas with different areas. His in Iraq and I'm in Kuwait so we no joint account support. We got divorce on 22nd August 2009, Do you think the USCIS still need all of these documents?

This the letter says.
Your conditional resident status is extended for a period of one year from the date of expiration on your form I-551, conditional status resident card. During the one year extension you are autorized employment and travel.
In order to further process your petition, you will be receiving a biometric appointment notice with a specific time, date and location to capture your fingerprints, photo and signature. You MUST wait for your appointment notice before going to the Application Support Center (ASC) for biotmetric processing.
Please Note: Conditional residents who are residing overseas pursuant to military or official goverment orders will not receive an ASC appointment notice. However, you must send two passport-style photographs.
If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. Please include a copy of the receipt notice with any supporting documents you submit. Such evidence may include, but is not limited to the following items;
: Lease of joint tenancy
: Joint mortgage agreement and/ or property
: Joint ownership of asssets
: Tax returns
: Birth certificate(s) of any children born from the meriage

I just got email with my ex along with the divorce decree. He filed divorce in texas last month and was approved 18th of Aug 2009. I am extremely happy that he still willing to help me. I filed my I-751(based on extreme cruelty and hardship because I was not divorced at the time of filing in April 08...then I got divorced in December,08 and I withdrew the previous petition and then Filed for the new one with Divorce and good faith marriage in the last week of January,09 to VSC. My conditional residence is based on my marriage to a U.S. citizen, but I am unable to file a joint petition and I request a waiver because I feel that my husband is not going to provide me with proper documents needed to complete residency. He works at the US Army Contractor in Iraq and I am currently working in CSA, Ltd, Kuwait. I feel that my husband is not coopertating with me on anything.
