Hi guys, we received RFE yesterday. We need your insight and advice on what should we include in our response.
What we sent in July, 2012 was:
1) Joint tax for 2010 and 2011
2) Lease for the period of 04/2011-present
3) Joint savings account opened by our landlord with our rental deposit in it
4) Bank statements joint savings and joint checking accounts but only for the 3 months prior to July, 2012
5) Phone and cable bills. Phone bill shows both of our numbers, but both bills are on my husband,and he is the primary user
6) Copies of our state ids, showing shared same address
7) copies of our bank cards
8) photos from various occasions
In the RFE it is said that we did not send sufficient evidence and they need more evidence for marriage of good faith.
My husband and I married in 08/2009 and had lived together ever since. We changed address once. We rented apartment which was his uncle's property; however, we did pay rent and we had an original lease. I do not have a copy of the lease, as I gave the original to the lawyer we used for filing AOS, and she submitted it with the paperwork. I never thought of making a copy of it(huge mistake).USCIS is saying that we did not provide information for living together for the period of 08/2009 to 04/2011.
Another issue is our tax returns. We did file jointly and married, however the address we used is my mother-in-law's. It is the address my husband has been using before he met me, and we never changed it(we do taxes with the same person every year). USCIS concluded that we lived on this address and we never provided information about it.
USCIS also wants bank statements for the period of 2009-2011. I already went to the bank and ordered copies of our statements from 2009 to present.They said it will take a week(both banks).
My questions are:1) Do you think if we have our previous landlord(his uncle) write a letter saying that we rented for the period of 06/2009-04/2011 would be enough evidence?,2) Taxes- would writing a note in the package we are going to send explaining why we use my in-laws address be fine?
We do not have any life insurance together. We do have family care with the state at the local hospital though, would this be something I should include?
Also we just bought a car, which is on my name. My husband has a very bad credit. However, we are both included in the car insurance. My husband was added to my credit card account in 10/2012. I was not able to add him for 2 years,nor was he able to get one on his own due to his credit.This is why we never had joint credit card account.
I apologize for the long post. I do appreciate your time reading, and hopefully some of you who already went through RFE can give us some advice and help on how we should handle our RFE and what evidence would be appropriate to send.

Thank you Vanessa&Tony! You gave me some useful info. I did not know you can change the filing to a waiver.
I just do not want any troubles with USCIS, he is the one saying he will file for divorce.
I will be making an appointment to see a lawyer as well possibly, sometime next week.

Hi guys,
I have been married for 3 yrs and 4 months, I love my husband to death. I forgave an affair that he said he ended, but now he wants a divorce because he is in love with the other woman. I will give him divorce, but i don't know how to handle my ROC. I have NOA dated July, 21 from VT Center. I do think i need to get a lawyer and try to maybe stop this application and file again once the divorce is final. I would appreciate some advice. Thank you!

aleful and besaangel thank you for the clarification for a sponsor and co-sponsor( honestly i didn't know the difference until now). We live in my in-laws summer house and we pay them rent, they are always here for the weekends, I don't know if this is of any importance or will change something. But from what you said I understand that my husband will have to fill in I 864 and his mother as well.
smiley1 on my visa it is said "bearer is not subject to section 212E.Two year rule does not apply".Thank God at least this is all right.

I don't remember anything about the competency or the history of the American Citizen being an issue when we filled out the paperwork. As long as you, the intending immigrant, have a clean record, I doubt your husband's rehab is a big deal.
In addition, as long as you meet the 125% poverty line (or your co-sponsor meets the significantly higher requirements) of the I-864, I'm not seeing an issue.
thank you for your quick reply.I guess we will be able to do the paperwork ourselves then.Our sponsor meets the requirements.I have medical and vaccination exams next week.So i guess our journey for AOS will soon begin.Thanks once again

Hello everybody...thank you for reading my post.I'll be really grateful if you can give me some advice.I came to the USA on J-1 visa and got married last august(08/09) and haven't applied for AOS yet.Me and My husband(an American citizen) hired a lawyer last September and everything was going fine until the moment my husband was sent to a long-term rehab.The lawyer called off my case and said she cannot proceed before he comes home.So now he is coming home soon. I'm wondering whether we should use a lawyer or we can do the paperwork ourselves.I'm worried that because he is on probation this may cause problems with my AOS.He has almost no income for last year. That's why his mom will be our sponsor.What do you think is better to use a lawyer or do it ourselves.I'm really confused and some advice from you guys will be greatly appreciated.Thank you.

If your J-1 visa is subject to the 2 year residence requirement, you will not be able to adjust status without a waiver. Check it on your visa, that would probably be the first step to take before you can even start to adjust status.
You will need a co-sponsor, since your husband does not have any income. But you said your parents in law will help you in this regard?

Betti, my J-1 visa is not subject to the 2 year residence requirement.Yes his mom will be our co-sponsor. We've talked to a lawyer and she said we should not have any problems, but she wants too much for her services.We plan on filling out the papers and sending them on our own.Hopefully there wont be any problems.Thank you!

thank you familguy and Old Dominion for replying me...his parents are going to sponsor us, and once he is out of the rehab he will have a job in the warehouse where his dad works.I know everything is messed up..but i do believe that he is a better person and he learned from the mistakes he did in the past.

Hello everybody...i came to the usa 2 and half months ago on J1 visa and got married to a US citizen on August 8th.We've been together more than 2 years now and decided to tight the knot.I would like to ask you guys for advice because my husband and I are totally lost.My hubby is on drug court and next month he is going to a 30day rehab.My visa expires Oct 1st and we dont know what to do about the papers for AOS.We've talked to a lawyer but she wants 5000 $..(amount we cant afford).Can I do all the papers by myself while my man is in a rehab or we definately need a lawyer.As well he stopped working last month due to problems with court and cant prove affidativ of support..Thank you in advance everybody..and God bless you

Thank you for the response bigdog!We do not have many of the things you sent. Right now we are gathering all our bank statements for both accounts from 2009-present. We asked several people to write affidavits, and we asked our previous landlord to write a letter explaining that we did rent with him for 22 months. I do keep some of our rent receipts from 2009 and 2010, so I will be including this as well.
