    This (pardon my french) sucks.

    I'm not going to try and council you any more on this, cause i really (luckily) have never been in a situation like the one you describes, so good advise from me would probably not cut it.

    Therefore i'll only respond to one of you questions:

    Do i know a really good Immigration lawyer?

    I had a very good experience with a San Francisco based Immigration lawyer. While my case was pretty vanilla, i don't think i have actually asked him to defend a challenging situation though, so i'm not sure how he would do in "difficult cases".

    However, feel free to look at some of his reviews on yelp, his website and decide if you want to drop him a mail, give him a call.

    I am in the almost same situation as you guys but with some complications, I will try to be as brief possible here

    Firstly I am looking for a very good Immigration Attorney as its been 2 (End February) that I was given the permanent residence in the US with the condition of being married to a US Citizen.

    Unfortunately, when my wife and I got to the US things started changing specially with Her. I was working in the UK when she asked that we move to the US, I mean United States with no specific ... I work in a field which job can only be found in some area mainly such Silicon valley, Austin, Boston and some others ... My Wife and I were clearly aware that the town or State she was living in at the time we were processing the Immigration to the US does not offer possibility for me to work. Obviously this has been debated and as work around we agree that we open the options to move where we can both work

    strangely enough the day I landed in the US at the airport, She told out of the blue (please tell me if that s true?) I quote: "... Now that you are in the US, let me tell you the laws here are in my favor"

    Note: I am Black and she is white

    Pretty quickly as I mentioned she changed completely in her behavior towards me arguing all the times, becoming my boss at Home rather than simply being a wife to her husband and me a husband to his wife ... there were some moment of hope but mainly moments of pains and disappointment... I have tried all avenues to find reconciliation , her requirement at some pint was that I completely give my career and stay home or work in a store

    One during a marriage counseling session the counselor asked her when she makes such request is she willing to share her salary ? her answer was no

    Things not getting better and before I loose my career with a deadlock situation , I took a job offer in California. she did not want to come or ask for transfer from St Louis to California. Note she has no family in St Louis

    We have a child together, we are going through the divorce and Child custody (which battle is not looking good for me as the court refuse that my Son comes to spend time with me, the court(the GAl) refuse does not sanction her at all when she violates court order even with the proof and facts that i provide... that s another issue ... I am the one taken the financial burden

    Anyway if anyone knows a really good Immigration Attorney please let me know i fair that my ex-wife wish is to have me deported so she can have the kid for alone

    And perhaps some evidences that i can produce to the Immigration for my complicated situation ?

    I have given here enough information so someone could guide me to the right

    Just went through the same and got conditions successfully removed. To answer your questions:

    You are correct. You are eligable to get your conditions removed. There is no specific time requirement concerning how long you have to be married in case of a divorce. Let me put is this way: if you get divorced after 1.9 years, meaning close to the actual 2 year deadline, it looks somewhat more like a real marriage than getting a divorce one week after entering the US. Having said that, this statement of course is only taking into account the time aspect. If you have of course tons or documents as proof the time aspect is not as important. Every case including evidence is somewhat unique.

    Having a child together is great proof / evidence in your situation. The birth certificate should certainly be included in your evidence. Nevertheless, you only need to mention the child as evidence and not for application purposes as the child is a US citizen and therefore has not green card and or relevance for the proceedings (unless used as evidence as aforementioned).

    "Could anyone tell me what sort of proof is required to show that the marriage has been entered in good faith ?"

    Any documentation showing somehow and somewhat that you maintained a real marriage.

    - Insurance Certificates (Car, Life, Property, what not..)

    - Birth Certificate of Children

    - Car Titles

    - Car Loans

    - Mortgages / Rental Agreement

    - Bank Statements showing joint ownership of bank accounts

    - Credit Card Statement

    - Health Insurance Documents (Invoices, Claims, etc)

    - Flight Tickets from previous trips

    - Hotel Booking Confirmations

    - Rental Car Receipts, showing your or your spouse as add. driver

    - In your case: AFFIDAVIT OF YOUR MARRIAGE COUNSELOR (I did the same!!!)

    - Affidavits of friends, etc

    - Affidavit from your former spouse (if he/she is willing to do this)

    - Copies of Driver Licenses showing same address for both of you

    - Family Cell Phone Plan Invoices

    - Any other term based financial documentation / agreement

    - Official IRS Tax Return Transcripts, etc

    - etc etc etc

    Send me a Private Msg if you need more info.

    Note: I got my conditions removed without request for further evidence or interview. This is great, however unexpected and not the general rule. Nevertheless, if you need help let me know.

    I heard that if a divorce occurs, the residency condition can still be removed(!?), does anyone knows if the law puts any requirement on how long the marriage needs to have subsisted in order to be eligible to apply for the waiver ?

    We have a Child together do I need to mention that in my application ? would it that be ok ?

    Could anyone tell me what sort of proof is required to show that the marriage has been entered in good faith ?

  6. Sorry this is so off topic, but this statement just made me laugh! Yeah, we go "where the military sends us" but often enough with lots of hesitation, debates and fits. But we go anyway. LOL

    The important point though: We go together and we make a home anywhere. Yepp, as long as we are together.

  7. To be honest, I am not sure how I would react if my husband told me he'd move to a different place and leave me behind. I guess I wouldn't threaten divorce right off the bat, but I sure wouldn't be happy about it either.

    I guess you'll have to decide between your marriage and your job. And again...don't you think it's possible you will get a joboffer in YOUR State at some point and working something else would only be temporary?

    It seems like your actual problem has not much to do with romoval of conditions but rather if you and your wife can find a compromise with your jobsituation and I am not sure if you want peoples opinion on that.

    IF you decide to split from your wife though, you'd have the chance to file for ROC with a waiver after divorce. So, you still have options.

    I understand your point of view before i moved to the US i did mention to my wife that it will be pretty much impossible for me to find a job in my field in the state where she is , her answer was that we could always find a solution ... hence the huge change in her attitude since I have moved here has been shocking I could barely recognize her , she has become controlling , wanting to decide for my life not open to any sort of discussion, she does not treat me as equal in the marriage - as she og=ften mentions that the law here will always be in a favor

    I guess thinking about all that down the line giving up on my career appear to me as a mistake that i could regret (no saving, no asset...) - no insurance that , I am not the one wanting to divorce - am just trying to preserve a little bit of safe option

    I read about the ROC after divorce but how reliable is that ?

    I guess at this stage I would accept any advise on my situation

    By the way I have offered that we move together where we can both be working and happy, she is refusing

  8. Yes, you can file for removal of conditions during the 90 days prior to the expiration date on your greencard. NOT earlier!

    As far as your job situation goes: I am sorry that you can't find work. I am sure you are aware of the fact that many, many people have to give up on finding a job in their desired careerfield, at least for now.

    Hopefully better times are ahead for you and I tell you what- for many, a job at Starbucks is a whole lot better than having no job at all.

    Removal of conditions is not such a terrible thing, as you will recieve a 1 year extension letter that will allow you to stay and work in the US until a decision is made and you -hopefully- recieve your permanent (10 year) resident card.

    I too am a little confused about your last statements about you feeling trapped and it being "sad". You won't need a lawyer for ROC unless there are circumstances you haven't mentioned in your post.

    For everything else (divorce?) I suggest going to maybe the courthouse and ask what is required in your state to file for divorce and if you and your wife agree on the terms, you can just file the paperwork yourself.

    But yeah, I am a little unsure what you'd want a lawyer for...

    i feel trapped because me moving in the US it never crossed my mind that I will be giving on my career.

    First, read the handy guide about removing conditions. The earliest you can send it in is 90 days prior to the expiry date of your 2 year GC.

    I'm not sure I'm following the second part of your post. What do you mean you're 'trapped into this conditional green card'? And what legal advice do you want - to help you file for divorce? Legal aid society may be able to help you - google it in your area.

    I arrived in the US on K-1 visa then obtained my Green card and SSN.

    i believe I am on conditional permanent residency here, my first question is do i have to wait until the last 3 months of my green card expiration date to apply for the condition to be removed ?

    Also the situation gets weird as my field of work is semiconductor and i can't find a job in that field in the state where you are now and my wife does not want to talk about my work suggesting that I give up on my career and work for Starbucks (coffee shop)- she argues with me all the time...

    I feel trapped - being forced to give up a career I love - thinking about the downside of such decision, hunt me at night

    being trapped into this conditional green card is sad ... well too much

    Anyone has an idea on what i can do legally ? i cant afford a lawyer as I am not working and she does not give me any money...

    The interview took place on the 02nd of Oct 09

    i was approved pending additional documents (they wanted a recent police certificate less than 6 months)

    sent documents on the 05 -10-2009

    It took 11 days from that date to receive the txt from the embassy courier service

    With regards to the batch #: (quoted from the site)

    In order to check the status of your application, you will require your Batch No (found on the 221(g) leaflet handed to you at the visa interview.

    So the batch # is on the 221(G) paper given at the time of visa interview for those that are put under AP. I am assuming it is the case # as the #s do look like case #s, but I could be wrong.

  14. yes congrats ! so as MARM said we in AP (they gave no reason) though interview went well but i guess they do this on all pakistani males as standard procedures. just hope it gets cleared soon.....but still relieved hopefuly this is almost over :)

    I noticed that yr case was in admin processing for a long time have you got the visa approved now ?

    did they ever tell you why they have taken long time ? is it because yr fiance is not EU/UK citizen

    Hello :)

    Yes, my fiance is still in Admin Processing. I received a letter upon my inquiry to DOS and my fiance received a phone call from the embassy saying that the Administrative Review is complete now for my fiance and that they moved his file to the Non-immigrant visa unit a couple of weeks ago, which is where the K-1's are issued. They also asked my fiance to re-submit DS-157 which he did a week or two ago, and then they sent his case to Washington for mandatory AP, which is what we are going through right now. They never told us why they have taken so long, but I have been very active throughout this whole process trying to find out as much information as possible, and judging from the way my fiance was grilled at his interview and then the way I was grilled in a phone investigation done by London, and the fact that my fiance was in AR by choice of the CO at London and that it took so long to complete, I beleive that it has taken so long (and is still taking so long) because he is not a EU/UK citizen AND because he is a Pakistani citizen in the UK on a student visa. Other than that, there seems to be no other reason as my fiance has a very immaculate immigration record and has only been in two countries in his whole life: Pakistan and UK, and he does not have a common name, neither is there anything unique about his case, also, both my fiance and I are of Pakistani background, we share the same culture, same language, same religion, he is only a few years older than me, both of us are young, so no need for scrutiny there. So it all comes down to the fact that he is not a UK citizen in the UK and that he is of Pakistani origin, which are the reasons for the fact that we are still waiting since his May 12 interview. Hope this info helps you.

  17. We have some time before the planned wedding, it's just frustrating as we've sent it twice!

    How could they have 'not' received it?

    I wonder what the time for processing is....because if they haven't gotten the first one for whatever reason, they should have most definitely received the second!

    But since the 2nd was only sent on August 24, maybe they just haven't opened it yet?

    Did nothing other than what was asked of in the instructions, sent the forms and the IV-15 together. I was quite surprised to have the interview date back so quick too.

    I had my K1 medical at Knightsbridge Doctors yesterday and I just thought that I'd share my experience.

    Location

    The doctors office is located about a 5-10 minute wander from Bond Street tube station. Exiting the station, I crossed to the north side of Oxford Street and headed west (towards Selfridges) turning right into Gees Court and heading all the way through the pedestrian area to Wigmore Street. Across Wigmore and then into Jason Court and onto Marylebone Lane. Bentinck Street, where the the office is, is a few yards on to the right.

    As you turn right in to Bentinck Street, the office is located in the first building on your right (Bentinck Mansions). The building appears to be an apartment block and the office is on the ground floor to the right (Flat 4). You will need to buzz the intercom to get in.

    Check-in

    Spoke to the receptionist, who was very polite, and handed over the questionnaire (from the information contained in Packet 3), my passport and a photo. I was asked to go through to the waiting room. The receptionist appeared a few minutes later in the room and handed me an Embassy medical form which I was asked to complete along with an HIV screening authorisation form.

    I filled everything out and the receptionist came and collected the forms and told me the nurse would be along shortly. And she wasn't wrong!

    Nurse!

    After a couple of minutes the nurse came along and took me off to her office. We spoke about vaccinations and she explained about the K1 requirements. I didn't have any records and she told me that I would be able to get the required shots done at my GP for free. I opted to have the shots done there and then as my GP had nicely taken me off their books as I hadn't been for so long!!!

    The nurse and I chatted about things and before I knew it first shot was in my arm and done, a blink at the realisation that it had been done and the second was in there and done! This nurse was a first-class professional! It was all administered is a very cheerful and pleasant way.

    I was given record of the batch numbers of the shots and the nurse checked to see if the radiographer was free. Bing! Oh yes he was!

    X-Ray

    This bit was a little odd as it happened so quick and I didn't see anything happen! The radiographer was very cheery and he asked me to strip off my top. He then asked me to turn around and place my chest against a large square plate, place my chin on the top bar. He put my arms behind my back and gave me a, what I guess was a lead sheet to hold in both hands. And we were done before I knew it!

    The chap asked me to get dressed again and off I went back to the waiting room where I waited for about ten minutes.

    Doctor, Doctor

    My name was called and the Doctor introduced herself and led me off to her office. She was very polite and chatty, asking me about my day, my job, where I live etc. She asked me basic health questions about a previous operation and the she was ready for the physical exam.

    I popped my shoes off and she checked my weight and height, then she checked my eyesight (with glasses on). She then asked me to sit on the bed and she checked my breathing with her stethoscope, checked my glands and took my blood pressure. Then she took a blood sample which was very painless and asked me lie down on the bed. The doctor then proceeded to prod various organs while chatting away and finally asked to have a quick peek down below.

    A couple more questions, one of which was have I ever been in trouble with the police and have I ever been caught for drink driving. I thought they were a bit odd for a medical but then I guess they may reveal underlying problems.

    And we were done! 10-15 minutes top with the doctor.

    Conclusion

    So around 45 minutes after arriving it was back to reception and pay the bill. I feel that I was treated well and everyone I came into contact with was very friendly, but then I should hope so for such an expensive (but necessary) escapade!

    If anyone is worried or nervous, I found from my experience that it was quick, painless and not unpleasant at all.

    I have noticed that you have sent your P3 on the 25th of August 09 and already you have been given an interview date

    I have sent our P3 on the 27th August 09 and we still haven't had the interview schedule would you mind telling me what you did to have yr interview date set already ?

    I think you can call the embassy and find out if your letter has been received

    Once they check it they should update their system saying they have checked the Packet 3 and if ok or not

    I am not sure but that is at that time the application is said to be qualified or not

    No, have the USC call DOS. - they can answer the following questions:

    Has the embassy received my petition packet?

    Has the embassy sent out packet 3?

    Has the embassy received the beneficiary's packet 3 response?

    Has the embassy assigned an interview date, and if so, what is it?

    Has the embassy printed my visa? (for those in AP)

    Oh, and it's free, which is nicer than the extortion line prices. :)

    I had confirmation from the DOS yesterday on the phone that the P3 has been reviewed on the 9th of September and that the Embassy will inform us of the interview date

    What that does that mean ?

    is there anyone in the same situation ?

    has the embassy changed the way it proceeds , seems like there is a further waiting time to only find out about an interview date ?

    Anyone knows anything ?

  22. Returned forms 156, 156K, 230 etc around 2.5 weeks ago and have heard nothing - flowchart on this site suggest 1 week for interview date.. is this sent via royal mail here in England?

    Visa type is K3.

    we used Royal mail but was special delivery so next day delivery

    Although Ours is a K-1 Visa , we sent all the forms more than 2 weeks ago and no date yet has been set for an interview
