  1. My mother file for her daughter as LPR holder and now she is wanting go back home for family illness matter. Priority date is December 18, 2010. It’s fixing to be up current. My question is does she have to be in USA when the child schedules the interview or can she be there to return together. Do we need let the Embassy know these or it could be a question will be asked where the mother resides. If you have the same instance please advise the outcome. Your kindly advice will be greatly appreciated. Thanks

  2. Do you claim your mom as a dependent on your taxes? Do you have a spouse? Children?

    Likely it's better that mom and you both complete an I-864. With mom having no income the adjudicating officer will want an clear picture of your household. The I-864 will give this.

    Yes i have a spouse and one child my spouse dont work. and I have file my mom as dependantin 2010 tax income.

    Now the Question i have is..

    1. on the form I864 filling this for my mom as sponser what do i answer for # 23 (My current individual income) and # 24 (My current Household income) my mom didnt work so dont have any income and the househould is mine so can i put my household income then?

    this is the situation My mom who petitioned her un married daughter and she required to fill the Affidavit Support but she never work in US nor claim Tax return.I am a US citizen and work with sufficent income.I figure i can be her joint sponser but which form do i need to fill just I-864 or I-864A or both. My mom lives with me.

    1. If i we fill I-864 what does i need to put for Incame return for my mom?

    2.If i fill 864A in part one do i put my name or mom name?

  4. OK based on my understanding on form I-130 that your mom is gonna be petitioning for your brother. If your mother already petition for your brother yes she needs to fill out on your sister's petition I-130 ...( I-130 22 SECTION D. OTHER INFORMATION) your brother info...

    But, if she is not petition for your brother yet. Only your mom if she is going to petition for your sister only. She need only to fill out on I-130 22 SECTION D. OTHER INFORMATION she needs to say "NONE"

    Your petition for your sister nothing to do with your mother petitioning but petition for your sister both you and your mother is a great idea. Your mother would be more faster. I wish you the best, good luck!

  5. it depends on what is her priority date. did you file for her recently? then yes if she is unmarried. a person can have more than one petition filed for them. she can file for her. probably in less than 2 years if she is under 21 if your mom files for her.

    Thank you for your reply. her age is 16 and i think i will be a better off if she just files her for visa avaiblitity. I applied the form in March 2009.The case is at NVC it already approved from NCIS. Not sure

  6. This my sitution.

    I already files for my sister I-130 for brother/Sister of US Cetizens. And the Case is approved from USCIS and moved to NVC.Is any one know how long would it take before the visa available. Would it be faster if my mom Files for Doughter under 21 with Green card? Will it affect the process i already started?Opnion or answer will Greatly Appriciated.Thank u in advance
