  1. My friend has an interview for the DV Lottery Visa in August and is trying to schedule an appointment at IOM in Kenya. What is the best way to get through to them? I have tried calling but am not sure if I have the right number. Does anybody else have a number I can try or experience with this? Also, how long will it take to get his results? He is traveling from Uganda so I want him to know how long he should expect to be in Kenya. Can he get vaccinations before going or is it better to wait until he gets there?

Any information will be helpful. Thanks!!

  2. The child must be certified as an orphan, in this case both parents are alive.

Plus, the child has not been adopted, per the OP. They are looking for a waay to bring a relative to the US, and they wish to try using the adoption angel. Go to USCIS. gov and read up on the process of international adoption.

Yes, both of his parents are alive but they have basically abandoned him. Wouldn't that be grounds for adoption?

  3. My husband came here on a K-1 visa and now we want to adopt his nephew and bring him over here as well. We didn't put his nephew on any of the paperwork during the K-1 process because he wasn't adopted yet. Is this even possible to do? His nephew has both parents living but his mom is out of the picture and his dad could care less, and in fact will have no problem releasing parental rights. My concern is about USCIS and how that will all work. Any ideas? Any info will be helpful. Thanks!

  4. My husband's poe was at JFK and they did put a stamp on the back of his I-94 that says "work authorized until 12/5 (he entered on Oct 5)". Does this mean that he can work until december?

Whats your husbands point of entry? Some POE (NY) give work authorization for 90 days (till K1 is valid). This is free. It is valid only for that 90 days, if your husband will not have regular EAD by that time, he has to stop working. This is just my opinion, but I think it is not his right to receive this 90 day work permit.

Then once you are married apply for AOS, EAD and AP. Total cost $1010. I recieved my work authorization card in mail 59 days after I mailed all paperwork to USCIS.

Ignore this information it is outdated and incorrect when it comes to K1 visas.

Since when they do not do it anymore?

the I-9 form was changed 2-2-09 and they began enforcement April 15. The k-1 was never a valid work visa and the stamp was never valid for a k-1, however the wording of the I-9 was vague and the prohibition was not enforced. The wording has now been changed and the K-1 with stamp is no longer acceptable for the I-9 form.

  5. Ok, I know this is probably covered somewhere but I have been looking and seem to find different answers everywhere. I have some questions:

When we apply for the Green Card we apply for the EAD as well right? Do we have to pay the extra $400 for the EAD or is that just automatically given if you apply for it? green card and EAD have different forms, if you filled out the EAD form and sent it in along with your green card then yes, you applied for that as well, it is not automatic and the cost of Permanent Residency, EAD and AP is $1010

Once we are married and we have the wedding certificate in had and have applied for the green card does my (husband) have to leave the country to wait until he gets the Green card? If not, what exactly proves that he is here legally? Also, about how long does it take to get the EAD after its applied for with the green card? He does not need to leave the country, once you file I-485, you acknowledge that you have completed the requirement to marry within 90 days of arrival into the US, You should file for Permanent Residency, EAD and AP all together. After you file it takes about one ore two months to get EAD. green card might take another month or two after you get the EAD.

I would really appreciate any kind of feed back that I can get from people that have gone through this already. I know the info is out there somewhere but I need straight answers so please don't just tell me to go look elsewhere. I'm really kind of nervous about these things. Thanks!

Looks like you just got your NOA2, you should do more reading about the AOS stage.

Actually, he has his visa, has a plane ticket for October 5th and we are getting married october 9th so we are just trying to figure out what we need to do after we get married. I'm just kind of #######-retentive about all this stuff and want to make sure we do everything right and get him to be able to work as soon as possible. Thanksfor the help.

  7. So, I just want to share my excitement with everyone. Our interview and stuff went really fast. He had his medical on Monday (sep14) and he didn't even have the packet from the embassy yet. On the 15, tues he picked the packet, got the results from the medical and paid the fee. On Wednesday he had his interview and was approved!!! And then on Friday he had his visa in hand. Now we are expecting him to arrive here in the states on the 4th of October and get married on October 9th. Crazy fast but I'm excited and just wanted to share with everyone. Pray that everything goes well wth tickets and travels and stuff!

  8. Which would be best: for me to buy a ticket from him from here (say from cheaptickets.com) or for him to buy a ticket from his country?

I really can't decide what to do and what is best. Please give me some adivce on what you think is best.

    Thanks

We actually do have the visa in hand, got it on Friday!!! YAY!! But now just the stress of trying to find the best way to buy a ticket. So you don't think that it would be a problem for me to buy a ticket for him through cheaptickets?

  9. I sent the affidavit of support to my fiance and he realized that I put the wrong age down for him. Should I have him change it, should I send him a new one, which would take a long time and be really expensive, or should he just tell them that I messed up at the interview? I thought someone might have some insight.

    Thanks

  10. I sent the I130 to my fiance but he realized that I put the wrong age for him down. He is 25 but I put 24. Should he change it, do I need to send him a new one... :( or should he just tell the people at the interview that I messed up? Is it going to be that big of a deal? Should I be worried? I thought someone might have some insight.

Do you really mean the I-130? If so, you more than messed up... The I-130 is for "immediate relatives" of a USC... Your fiance is not eligible for that petition... The correct petition would have been the I-129F.

Ok, I'm talking about the Affidavit of Support... sorry, not the I130

  12. We have recieved our NOA2!! It only took less than 3 months. I was amazed at how short it was. Anywho... I was just wondering if anyone can tell me exactly what forms are needed from here on out. I know the Affidavit of support from me but what other forms does my fiance need to bring to the interview. I want to send him copies ahead of time so he can practice.
