If you don't respond to the RFE in time then the petition will be considered abandoned, and the file will be closed, usually "without prejudice". The same thing will essentially happen if you send the withdrawal letter, except that the reason for closing the file with be that the petition was withdrawn. In either case, it shouldn't affect her eligibility to get a future visa, though they may ask her about it at the interview

Hello guys does anybody here knows what do I need to do to cancel the AOS petition? I just got an REF on the mail last Monday, my wife and I have decide to cancel the AOS and move out of the States for some time. Do you guys know if when I cancel the AOS would we get our package back with all the documents we sent? we lost the fee obviously right?

Ummm hmmm well usually if the cheque's wrong they'll return the package so that's strange... and you might not KNOW its being cashed. I didn't know for a couple of days but the cash date was the same as my NOA1 receipt.

Or maybe they will try to cash the check once arrive on the National Benefit Center for processing. Who knows let's see what happen.

Your cheque is probably being cashed as we speak. You will receive NOA1 which is your receipt of payment. Stress less.

Check hasn't cash yet and I'm little worried because I wrote with letters diferent amount that show with numbers. Bank said it might not be cash, so I think I will get a diferent response ?

From what I remember from my business law classes. The written part of the check takes precedence over the numeric. It will depend if the USCIS or your bank catches this has takes exception with what happened.

So if they don't like the check, would they just return the check and I have to resend the package with the correct check?

I have never used transcripts only return copies... you should be fine

Hello guys our AOS package was receive last Monday the 24th checking our copies today I realize I wrote the check for $1010.00 with numbers but in letters I wrote $1000.00 and 10 cents, So obviously a huge mistake, do you guys think the check would still cash? or can I send another check? would I get my package back?

They usually take about a week, IE they recieved my AOS on thursday the 18th check cashed thursday the 25th. Most seem to be within a day or so of this. :sta
