Hi,
In I-864EZ question #19, do I check both boxes ("I have filed a federal tax return for each of teh three most recent.." and "I have attached photocopies of my federal ..") if I include transcripts of federal tax returns for 2009, 2008, and 2007?

Hi, my wife is in Korea and she has following documents related to DS-230. Are these sufficient?
Document cover sheet
DS-230 Part 1, 2 (4pages)
Certificate of personal records
Certificate of kinship
Certificate of marriage
The former family census register
Report on Criminal • Investigation Record
Copy of report and certificate of marriage (US)
Copy of passport

Yes. When it asks what your current individual income is, you would list your gross income as its listed on your 1040.
2008 or 2009 return? And if 2008, why?? My 2009 is much higher than 2008 (2008 student -> 2009 working).

Also, keep in mind they will want the actual copy of filed return for 2009 at the interview (chances of this are VERY high) so make sure you have that together.
I used turbotax for 2009 tax. I assume what I print out from that would be sufficient, correct?
Make sure the amount of income listed matches your 2008 tax transcript, since thats the current year still, technically. That's what I did. I included my W2 for 2009, but didnt list that as my current income, 2008 instead.
I'm not sure if I'im understanding this. "amount of income listed"? is exactly what in the I-864 form? I assume that for question #18, which asks my current individual income, I would write down my current income ($/year), correct?

Regarding the AOS package:
First thing, I would recommend is that you print out the I-864 form and read the instructions about 2 times. Mark out the relevant portions and ask any questions you might have after that. I would suggest you read the guides for a comprehensive idea about how the AOS packet will comprise.
Recommended AOS package:
I-864 Coversheet (with barcode) for payment of $70
Form I-864 (signed and dated)
2009 Federal Tax Return/W2 and 1099s or IRS tax transcript.
2008 Federal Tax Return and W2 and 1099s or IRS tax transcript.
2007 Federal Tax Return/W2 and 1099s or IRS Tax Transcript
Letter of Employment
Pay stub(s) from the most recent six months
Bank Statements.
Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.
For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence.
I'm filing I-864. Right now, I have 2009, 2008, 2007 federal tax return transcripts and W2 for 2009. I also have pay stub(s) from the most recent six months as well as bank statements. I am making above the poverty line as well. So do I need the 1099s(?) and W2 from 2008 and 2007 as well?? Thanks.

So it seems like I need 3 years worth (2009, 2008, 2007) of tax returns. What is the fastest way to get them assuming that I don't have copies? I requested for tax return transcripts via phone and it's set to arrive in 10-15 days. Any way to expedite this?

I still don't get it. According to the i-864ez pdf document, it states that I should send in the packet when it is mailed to me.
So most of you are saying that I should mail in the i-864ez form along with the document cover sheets before receiving the packet from NVC?

Do not listen to anything they tell you.
If you have the barcoded cover sheet print it out and send it in.
Should I send in the cover sheet along with the I864 forms? It says on the travel.state.gov page the following..

Log on to the NVC website and print out the Coversheet for the Immigrant Visa Application Packet.
Get the Beneficiary to fill-out the DS-230 and gather the required documents.
Submit them with the Coversheet per the instructions.
Thanks. So why would the automated message from the NVC state that I should wait to receive a packet? I haven't received anything since paying $400.00.

I recently made an affidavit of support processing fee ($400, March 1).
I haven't heard anything back from NVC since then so I called NVC yesterday. According to the automated response, they said I should receive a packet from them. I have also e-mailed them and received the following information.

If you originally indicated she would apply for a visa in Korea, the case should go to NVC for Immigrant Visa processing. What did you indicate on line 22 of your I-130?
I'm not sure if I indicated that she would apply for a visa in Korea (I believe there wasn't a question like this). On 22, I indicated N/A. Also, I'm wondering if the problem has to do with the fact that she came to visit me in the US during the I-130 process.
Any other inputs would be greatly appreciated.

I am a US citizen and I have filed I-130 for my wife so that she can get a green card here in the states. Just a couple of days ago, we have received I-797 Notice of action indicating that the I130 petition has been approved.
The form also indicates that we should obtain form I-485 or file I-824 - the latter if (and only if I presume) my wife decides to apply for a visa outside of US (which she will). My wife is currently in US and she plans to apply for a visa in Korea. Should we file I-824, wait for a response, and then have my wife go back to Korea to file? If that is the case, how long does this process take? She had planned on going back to Korea in about March but I have read somewhere that a response from I-824 can take up to six months.
Any help or link would be immensely helpful. Thank you.

I filed for CR-1 visa for my wife on 9/11/09 and we have been accepted. On the uscis.gov website, it states "we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
Now, I called the customer service at this number and was told that it would take at least 30 days for the notice to arrive. Is this true? My wife planned on going back to Korea on March to proceed to the next step and we're wondering if this trip can either be expedited to an earlier time or would need to be extended. Thanks!

I have started working a week ago and I need to fill in my W-4 form and send it back to them. As I understand correctly, I should check "single" in the W-4 form due to my wife being a nonresident alien. However, is this necessarily the case? How should I go about this so that I(we) can maximize our earnings? She'll be coming to US in about 3 months. Thanks!
It is your W-4 and should be filled out as need be. You are married, therefore you should put that on your form, it has nothing to do with your wife just you. When it comes time to file your taxes should she still not be with you you can file for a tax ID number for your wife so that you may claim her on your taxes.
^ Except on the W-4 form, this is what it says. Question 3.

Hi,
I assume that question 15 (name and address of present employer) is for my beneficiary, correct? What should I put down if she has more than one job?
On a related note, should she (my beneficiary) put down a job even if it's not in the US?

I have a couple of questions regarding the passport style photo.
1) Doe both the petitioner (US) and beneficiary (Korea) have to have 2 in x 2 in photos? We got our pictures taken in Korea and the dimensions seem like they are 35 mm x 45 mm.
2) Can my wife scan her picture and then send it to me?
3) Can we take our 35 mm x 45 mm picture to a photographer and alter it to a 2 in x 2 in photo?
4) Any other suggestions regarding this matter?

Passport size photos should also be included... I think the amount is 2.
Is there a difference between passport style photo (which I have included) and passport size photo?
Also, 2 for me and 2 for my wife or 1 for me and 1 for my wife?

Hello, everyone.
I am a US citizen and my wife will be coming (hopefully) to the United States in about 3-4 months. At that point, the address where we would be is unclear due to the fact that I am getting a new job in a couple of weeks. What should I answer for the I130- Q18 then? Should I mark N/A for the "street address" box? I know the city and the country so should I fill those in at least? Thanks.

My wife and I have submitted our AOS Package and we have received an e-mail back. The e-mail states that the police certificate (South Korea) is not an original or certified copy. However, the document is the original copy! What should we do about this (we no longer have the original copy). Thanks.
