  1. The cheque has to be in US funds and drawn on a US bank so the Royal Bank of Canada cheque would not be accepted. The forms can be filled out in pen - it should be either black or blue ink.

A lot of people prefer to send cheques for the very reason that you can see when it is cashed. What is also useful for almost all of the immigration process is that USCIS writes a case number on the back of your cheque as well and you can often see what this number is even before you receive the NOA1 receipt. With that number you can set up an online account with USCIS that updates when something significant happens to your file and that you can check for yourself. The cheque does, however, have to be from a US bank.

Oh thank you very much. Once we send it in Im going to create a time line. I think I will fill out the forms with him online and send him mine plus his so he can sign his parts and send it all away.Thank you so much for your help!

  2. Now does my fiance, who is American have to order the fiance visa application from USCIS and get them to mail it to his address before we can fill them out? Or can we just fill out the forms online, print them out and send it away with our Cheque or money order?

Fill them out send them. There is nothing to order.

    It's VERY helpful. :)

I forgot to ask Can I send them the cheque for $455? My bank is Royal Bank of Canada. Will they accept that? I prefer to send a cheque to see when they cashed it. Can my fiance fill in his part of the forms in pen?

  5. Wondering about the vacinations records. One place says I dont need them for my k-1 visa medical exam another place says I do need them. Im 38 yrs old and do not have a copy of my vacinations and as I know it a Doctors office can destroy your records in 7 yrs. How will it be possible for me to get a copy of my vacinations?

Contact the hospital/doctor's office where you got your vacs for copies of it; if they cant find it then you should arrange to do them again.

Is it safe to have them done again? Is the titer good enough to say Im immunized?

  6. Some people will tell you that for a K1 you do not need your vaccinations until you file AOS, which is technically true but the consulates in Canada will not pass you without your vaccinations complete, so you will need a copy. If you can't get ahold of the documents on stuff you have already had you can get a titer test done to show what you have immunities to.

Thanks for the info. When should I get the titer test done? Just before my medical exam? And show them the results at the exam? I will be applying for my K-1 visa next mth but I just want to start getting everything together now.

    Thanks!

And is it possible to go for the interview in another Canadian city? Thats closer to my fiance? he lives in Baltimore.

First off tessatoxx, welcome to VJ! Make sure you read the Guides above to give you a better idea of how the process works. Please also come to the Canada Forum here on VJ and as well check out the VJ Wiki pages. I've posted you the links here:

Many Canadians visit the US to meet with their fiance during the K-1 process. The key is to have a lot of proof of your ties to Canada when trying to cross the border. If you come to the Canada Forum, you'll see some threads of people's recent experiences. For a few Canadians lately, they have actually had trouble coming in for six months. They have been given a stamp on their passport saying that they have to be back in such and such time, and are actually given a date. I think about 3 months? Anyway, you can't if you come down overstay past the date they give you, IF they give you a specific date to return. The links I provide you will have information as well on what proof of your ties to Canada you need to successfully enter the U.S. While it is true we can visit up to 180 days, it is also at the discretion of the Border Officials.

Since you're living in Vancouver, you'll be interviewed in Vancouver. There are only two places in Canada where there are K-1 interviews and that's at Montreal and Vancouver. There are MANY Canadians that WISH they could be interviewed in Vancouver! The timelines for interviews in Vancouver is MUCH quicker, so be thankful! You can shave off probably on rough estimation about 3 months of wait time if you're in the West and applying for a K-1.

Please join us over in the Canada Forum once you've had a chance to read the Guides above, and visit the links I've posted and I hope that once you apply for your K-1 things move speedy for you!

Thank you so much for the speedy reply! Shaving off about 3 mths is a big help!!! Im very pleased to join this group to learn as much as possible and make firends! Knowing Im not alone helps things considerably.

  10. It's all about your intention at your entry to the U.S.A, if you do decide while (not before the visit) you are visiting him to get married it is up to you to PROVE that you had no intentions of staying upon your last entry. Getting married in the U.S.A. is not illegal, many people get married and then apply for a spousal visa such as K-3 or CR-1. Getting married with the intention to stay while visiting and adjust status from that of a visitor is fraud.

    :guides:

So what your saying is I cant marry my fiance while I visit him if we decided thats what we wanted to do. In Canada you can marry and apply from within Canada while your spouse lives with you. Is this different in the US?

  11. I have a question......Im Canadian and my fiance is American. What if I went to go visit him and we go married while I was there? Could I live with him there, while we do all the paperwork and wait for it to go through?

  12. I have a question. I have fallen in love with an American. I live quite close to the American border and was wondering if he could work in the US everyday but live in canada with me? The ultimate plan is still to live in America with him but want to apply for all the proper paperwork in the meantime we wont have to be apart. Is this possible? And would he need any special documentation to cross the border everyday besides his passport. Thank you

No special documentation needed, why don't you guys just get engaged and start the immigration petition for you to come live in United States or for him to move to Canada? he could then explain to the officers at the border you live in Canada and he's visiting you as frequently as possible but you already have proof of the petition. What you have to understand is every time he crosses the border he will get a stamp in his passport, eventually he will run out of pages and they will look at him suspiciously, all of this can be proof before either the canadians or americans that your relationship is serious.

Do we need an immigration lawyer to start the petition? Is it easy to do on your own?
