  1. Entering US with visitor visa and adjust the status is illegal and considered visa fraud.

    If you wish to bring them to US to be with you, you need to follow proper channel and go thru proper process.

    Your parents don't fall under IR1 visa IR1 visa is only for the spouse. Your parents would go under IR5 and you will have to follow the process and timeline for IR5.

    This is the second term for my mother to get a 5 years multi entry visa. It is not our intention to commit any fraud. This is my mother's fourth visit to the US except this time my wife and I are expected a baby and I am trying to have my mother help us out with the baby without her having to leave the country and coming back. Trying to save some money you know on the air tickets. Also I have been a citizen for 4 years now. I could have applied for my mother long time ago but she did not want to stay here for more than 3 months last three times. Thanks again!!

    First of all thank you all for being a kind and wonderful community. I couldn’t have done without you!!!

    Now here is my situation –

    I am a US citizen. My mother and my 2 siblings (both under 18) are visiting the US on a visit visa that will expire in Dec 2011. I am planning on filling I-485 for my mother so that she can get her status adjusted. My question is - can my minor siblings be added on the I 485 form (or any other from?) with my mother so that they can also get their status adjusted to permanent residents.

  3. Hello to all my VJ Friends,

    On 9-22-09 I got a case status online update stating that my I-130 have been approved. It only took 28 days. I was thinking it would take at least three months. Now, I know USCIS will transfer the I-130 to the NVC.

    My question is can I wait 45-60 days before paying the AOS and IV Bill? Is there an expiration date on approved I-130 that is sitting at NVC? Is there a certain time frame within which I need to pay the NVC fees?

    FYI - The reason I need 45-60 days is because my wife has some exams in November that will determine her pass/fail degree after four years of college education. I would like to have her interview date in December 09/ January 10.

    You friends are great. I appreciate all your help whole heartedly.

    I just got my I 130 approved on September 21st. Here is the case status online result. There is hope. Please hang in there and you will be fine. Thank God for all his help.

    Priority Date: 08-25-2009

    On line Approved Case Status on 09-22-2009

    “On September 21, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.”

  5. Hi, I am a USC ( Bangladesh Origin) and I filled I-130 for my Bangladeshi wife. Now my question is would my wife have to submit DS-230 at the US embassy in Bangladesh in her Visa Interview? Or do I need to submit it in the NVC here in the US with IV Package? I am going for IR-1 / CR-1 Immigrant Visa for my wife.

    I am a USC got married with my native Bangladeshi girl on July 24th 2009 in Bangladesh. I left Bangladesh on August 7th 2009. I am filling I-130 for her here in the US. The question # 21 of I-130 ask the following ---

    21. If filing for your husband/wife, give last address at which you lived together. (Include street, city, province, if any, and country): From To

    Now, I was in Bangladesh only for two weeks after marriage. Would this be considered ‘livied together’ with her?

    I am a USC. I just got married in my home country of Bangladesh two weeks ago. I want to file I-130 here in the US. What supporting documentation can I sent since I just got married and don’t have much documentations. I have marriage certificate, wedding pictures, reception invitation card. Please advice what else can I add as supporting documents for I-130 being a newlywed??
