  1. I have already paid $70 for AOS fee. Now if i pay $230.00 for DS230 (for I-130) and then my wife comes to USA on K3 visa (since her K3 interview is on Nov-02 in Pakistan) and after she comes to USA on K3 visa and i apply for adjustment of status....I know i have to pay the adjustment of status fee of 1010 although i have paid $400 for DS230....pls advise or should i dont make the fee payment for DS-230 (I-130) and wait till she arrives here and simply do the adjustment of status.....or do i still have to pay for DS-230 besides paying for adjustment of status.

  4. My wife's I-130 & K3 both are approved and infact we didn’t send the choice of agent for I-130 when we find out that K3 has arrived the Embassy in Islamabad-Pakistan after approval by USCIS. We filled the forms and send all the required doc's to the embassy and K3 interview is now scheduled for Nov-02. We still have not send the choice of agent for I-130 thinking that she will get her K3 visa on Nov-02nd and then she will comes here in USA and we will file the adjustment of status.

    Question: Is that the right thing to do or should I still send the choice of agent for I-130…if I do then I have to send the $ 400.00 fee for DS230. I was thinking that she will come to USA on K3 and we will file adjustment of status and this way we don’t have to sent the 400.00 fee for DS230. Please guide me if I am doing the right thing or either way I have to pay that $400.00….i mean either she do the adjustment of status or send the DS230 fee. Please help.

    I do have 3 tax returns - 2008 is single but the other two (2007 & 2006) are joint with my ex. So when i fill the form I-864 where it ask for the income as per my tax return do i need to put only my income from 2007 & 2008 tax return or W2 and not the total that includes my ex income also....am I right?

    2008 tax return is single.............i will put my income from the W2

    2007 was joint..............do i need to put only my income from the W2 or the tax return, excluding my ex??

    2006 was joint..............do i need to put only my income from the W2 or the tax return, excluding my ex??

  6. You need to put down the total for each of the three years on which you paid your taxes, as per your 1040s, not your W2. To do anything else will boomerang if they try to verify with the IRS. For AOS purposes, they are only interested in knowing that you have enough continuing income to support your spouse.

    Thanks for the reply....but why am I putting my ex spouse income when only its me supporting?? I think i should put only my income from the joint returns and exculde my ex's?...pls advise

    Hey everyone, I just recieved a call from my Congressmens office saying they talked to VSC and saying that A# has been assigned to my case (I-130) and she gave me the A# also.

    Do you know what that means...i mean assigning a A#....does that mean that my case has been approved or what....Also advise whats the next stage and how long will it takes...

    NOA1 date: January 6th, 2009

    After the above notification i never recieved anything from VSC. I called the Congressmans office on monday and faxed them the papers that asked for and on Wednesday they called me back saying that They have talked to the Supervisor at VSC and they will work on your case and sent it over to NVC within a week. They further said to call them mid next week (which will be Aug-19) just to remind them and they will contact VSC again to check the status.

    I hope this will work and the Congressman's office said and it will be done soon. I hope so. But nothing has changed on the USCIS website, i mean its still not showin any update....so i dont know...i am anxiously waiting for the Wed/Aug-19 so that i can call and remind the Congresman to please check the status again. Lets see what happens.

    USCIS has publihsed that average processing time @ VSC is 5 months and my I-130 is more than 7 months old now and dont see any update on my case or any touches...:-(

    Please guide me if there is anything further i can do.

    Question about when should I have a congressman/senator's office call the USCIS for me to check on my I-129F?

    Do they have to wait til the wait time (5 months) is expired as well, or can they inquire now??

    I just feel like I have been totally skipped over since almost everyone else in March is getting their approvals and we havent even been touched or anything!!

    Yes, You must wait for that deadline to pass before you wants to contact a C/men office. Mine is more than 7 months @ VSC and average time per USCIS is 5 months. So i called C/men office and they are workin on it. Good Luck!!

    Now i am really confused and losing my trust on Visa journey website. Last Friday it shows that VSC is processing I-130 recieved on January 12, 2009 and now today its showing that VSC is processing the I-130 recieved on November 22st, 2008. Is VSC is going backward??????

    This website sometime give very conflicting information and kinda concerns me more. Can someone please tell me what to do, I applied I-130 more than 7 months ago (VSC) and never heard anything after NOA-1. I have already contacted my congressmen and gave 'em all the details and hoping that may be able to get an update from VSC.

    On this website I have seen people posting that their case was at VSC in Feb & Mar and that already have a NOA-2, then what happened to my case...I am a US citizen too.

    Please assist and advise.

  16. ours took a year for approval...so don't worry but do closely follow up with your case....

    also you might want to contact your state senator or congressman

    Thanks for the replay. But why it takes that long with the website shows average processing time is 5 months for VSC. And the people who applied after me in Feburay has already recieved the NOA2.

    So this is kinda worries me.

    I am a naturalized US citizen and applied for my wife's I-130 in January and recieved a letter from USCIS on Jan 06, 2009 and was advise it has been sent to VSC for processing. But its more than 7 months now and never heard anything after that...we are getting kinda worried. Websites show average processing time is 5 months for VSC so whats goin on with my petition. Can someone guide me what to do and whats the whole process..
