  1. Hi everyone,

    My wife entered the US 2 years ago on a K1. When we got married, we hyphenated her last name to be her maiden name-my last name. Now that she has been living here for 2 years, we have realized that to change her name in her native country Brazil will be too complicated, and for simplicity she wants her old last name back!

    So, with a hyphenated last name on her Green Card and Removal of Conditions coming up in a few months, what do you think about legally changing her name BACK to her original name? Does this look shady? Should we wait until after conditions are removed?

  2. 1) After marriage on a K1 Visa, should my wife change her name on her passport from here in the US at the Brazilian Consulate, or is it better to travel on Advance Parole to Brazil and do it there?

    2) My wife and I WILL be traveling to Brazil, she'll be using her AP. When we return, should I go with her in the Foreigners immigration line? Should she come with me in the US Citizen line?

  3. Hi everyone! Any help or similar stories will greatly be appreciated:

    My wife is here on a K1. We got married and filed our AOS. Her interview was scheduled for September 23.

    HOWEVER, she will be in Brazil Sept 19 - Nov 27, using her Advanced Parole which we already received.

    We already bought her flight, and successfully canceled her interview. We tried to call to tell them to not reschedule the interview until Nov 27, however the agent said he cannot update our case until September 20th, and call back then. However she will be in Brazil already, and won't be with me when I call to say that I can speak for her.

    Today we tried calling to ask if she can permanently give permission for me to speak on her behalf. But this was not possible. Does anyone have any advice on how we can make sure our interview is not scheduled until after Nov 27?

    p.s. I know our judgement was skewed when we canceled her interview instead of changing her flight. I guess we thought the process would be easier than this!

  4. Hi everyone,

    We're starting our AOS packet now from a K-1 visa. My new wife plans to change her name, but hasn't yet. She has a social security number with her maiden name.

    What name should we use in the packet? Her new (planned) name, even though it doesn't match her passport, visa, etc.?

    Especially concerned about the I-131 Advanced Parole, as it's sort of separate from the rest of the AOS packet. Should we use her maiden name as that will match with her visa?

    I've searched this site in and out but haven't been able to locate a clear cut answer.

    After arrival on the K1 visa, should you get your SSN before or after getting married? In Massachusetts, you don't need an SSN for a marriage license. It seems like this would skip a step and we wouldn't have to change the name on the social security card.

  6. Finally, the K1 visa is in my fiance's hands!!!!

    Now, I have a question about her traveling to the US. She plans on coming here in April. She also knows she will need to travel to Brazil (her home country) in September/October for a few weeks. In general, round trip tickets are a better deal than one ways. Is it a little fishy for her to come to the US with her K1 on a round trip ticket? Do you think this will cause problems?

  7. My fiance has her K1 interview in Brazil on Jan 7. We plan on getting married in the US in April, however, she needs to be in Brazil in March for her college graduation.

    Is it possible for her to travel as a tourist, without using her K1 visa, to visit me for a few weeks in January/February after getting her visa (she already has a tourist visa)? She would return to Brazil, and then the next time she comes to the US it would be using her K1. Is this too risky?

  8. My fiance has her interview in Brazil coming up in January. She lived and worked in Japan from 2001-2004, in several different cities. I don't see how it will be possible for her to get a police report from Japan, as she moved around a lot (this is very common for Japanase people in Brazil to go back to Japan to work for a few years).

    Has anyone had any problems with getting police certificates, and has it been a problem in the interview?

  9. We have successfully been approved and received the NOA2 and notice from the NVC that our case was sent to the consulate in Rio De Janeiro. We are now waiting for my fiance to receive a packet from the consulate in Rio with instructions and interview date.

    My fiance is a student, and cannot easily take a couple days off to go to Rio (she lives in Santos). Is it possible to move the assigned interview date if necessary?

  10. I am starting the K-1 Visa process, and my fiance just sent her signed G-325A from Brazil to me. I just read on the homepage that ...

    "VisaJourney would like to remind all petitioners that are required to file a USCIS G-325A Biographic Information Form to submit four copies of the Biographical Information page (page one on the newest form). In the past the G-325A form contained four pages that automatically printed out (with the same information on all pages). The new form only has one page however petitioners should still submit four copies of the Biographic Information page with their petition."

    My fiance only signed and sent me 1 copy. Should I make copies of this form? Do I really need to send 4 of this form?

  11. You dont need to handwrite anything... Use the typewriter from Adobe Reader.

    Open your g-325a.pdf file

    click on Tools

    drag the mouse to Typewriter

    click on Show Typewriter Toolbar

    that tool allows you to write over any part of the form

    and you can change the size of the text , spaces and font.

    Thanks! However I just tried it and it looks like the typewriter toolbar buttons in the G-325a are grayed out. Can anyone else confirm this?

    Looks like we have very similar situations. I'm in Atlanta now but I am originally from Boston :thumbs:

    From what I've been reading, mixing the student visa with any type of visa is a bad idea. The student visa is intended for foreigners who show true intention to return to their home, and if during the interview they sense any intentions of getting married in the US, she will get denied. I'm not sure but this is what I have gathered from reading this site.

    A similar question: Can the fiance travel to the US on a tourist visa while she is waiting for the K1 visa interview?

    I'm facing a similar situation. Can't believe I found this site and this post. God bless the internet

    Brazilian girlfriend and I recently got engaged. She's planning to move up here permanently in December/January and wants to take university classes starting in January (university here has indicated that application shouldn't be an issue - she's currently at a University in Brazil with good grades, good work experience, her family's wealthy and I make a bunch of money as well). We haven't figured out the immigration issues yet.

    She currently has a valid tourist visa. She has not yet completed the university transfer admissions process and does not yet have a student visa.

    If she hasn't yet applied for the student visa, can she apply now for the K1 fiance visa and then while that is processing obtain a student visa and enter the US in December on that, or does an open fiance visa application prohibit her from obtaining a student visa and using that to enter the country?

    One post indicates that she could apply for the K1 fiance visa while she is here on the student visa and then would only have to return to Brazil for the interview. Do we have to go that route and wait to file for the K1, or can we apply for it now?

    If she were here on a student visa and we got married, would there be any way to just change her visa status or something so that she can stay permanently? Returning to Brazil for an interview is okay, but we're set on her moving here at the end of the year.

    I just got engaged to my Brazilian girlfriend and I'm new to this forum, looking for answers.

    We are debating getting married here via a K1 fiance visa, or getting married in Brazil via a K3.

    My question is if the following is possible:

    My fiance wants to take an English course at a university here in the US from January-March 2010. She will either need a student visa, or we will get married in Brazil and October and try to bring her here in January as my wife. Is this possible in the 3 month period? Or, is it legal for her to travel to the US as a student WHILE she is waiting for the K3 visa?
