  1. Hi I am trying to put in a I130 for my brother, his wife and their 12 years old son. My questions

    1) Do i just fill out one i130 or do i need seperate for each of them

    2) If 1, I see only 1 name for beneficiery, do i not include his wife's and son's name?

    3) Document wise, I see that i need my birth certificate and his that showing parents names.Do i also need to have their marriage certificate and their kids birth certificate? Again I don't see room in 130 to put his wife's and kids info.

  2. I assume you are a US citizen, Using a tourist visa with intent to immigrate is fraud and could earn your parents a lifetime ban.

    You file one I 130 for each parent and pay separate fees.

    It processes just like the old one did.

    Your parents shouldn't overstay their allowed entry.

    They are free to come and go while it is processing. If they happen to be in the US when it is approved they can AOS in the US if they are home they can interview there.

    Combined Processing for Parents Already in the U.S.

    Since a parent is considered an immediate relative and is immediately eligible for an immigrant visa, the USCIS allows for Combined Processing this category. This means that if the parent is legally in the U.S. (through a lawful admission or parole) at the time of filing the Form I-130, Petition for Alien Relative, he/she may also file for adjustment of status at the same time. Combined Processing is only available to beneficiaries/applicants who are in the U.S.

    Then I will go ahead and put the petition ((I 130) in ASAP. They plan in coming next month. Hopefully the petition gets approved while they are here, if not to avoid overstay, they will return.

    What documents do i need to show they are my parents. Does the documents need to be official copy and or notorized.

    Is there anything that explains checklist of all the docs needed?

  4. Hi, Need some help please..

    My parents are planing to come here next month on a tourist visa (they have been here before here already and still have multiple entry visa) and I plan in submitting petitions for them.

    Few questions

    1) Can i file the cr1/ir1 process as soon as they get here? Do they have to return back to home country or can they stay here and have all the visa proceedings here in US?

    2) When they come here if they have a one-way ticket, will the immigration let them in? Since they have tourist visa, is there a requirement for them to have two way ticket?

    3) what else do i have to consider/know for successful filing of this process?

    4) I am assuming this process is similar as spouse's process right? if so i had done that 3 years ago successfully and i still remember all the steps. In that case though my wife was overseas while i processing happened here and then sent to the embassy overseas.

  5. You do not have to, but I signed all my extra attachements, with the date.

    Initials are good also.

    Makes it more "official" looking. :star:

    Be sure to spend as much time reviewing and making sure all is complete. YOu don't want the docs to make its way back to you in a month..Be absolutely sure you have completed each and every items..

    First and foremost, I'd like to sincerely thank each and all of you here for helping each other with valuable information. As a result of these, almost every day people like me write posts like these indicating "visa granted" or terminology may be different in different phases of success.

    My wife was granted visa last night (our time). She will go back to the embassy to pick up her passport on Thursday and fly out on Sunday. I am excited and glad to put these heart breaking process behind now..Nonetheless, it was quite an experience. If I've learned anything from this it is "you cannot beat time"..Things will fall in place and take it course when it is due..Easier said than done though..

    Again I like to wish all of you the very best..and strongly hope for those of you still waiting, the good days will soon come.

  7. CONGRATS! My wifes embassy did the same for us! We were Febuary 19th, and now we have a January 12th appointment the same! I was just practicing on the phone with her because she wants to speak only english in the appointment. Best of luck to you! Be sure to check in tuesday with your status!

  8. HI THERE... our case completed november 16, 2009...late for dec. interview. SO i expect to be schedule this 2nd week of december for JANUARY INTERVIEW...

    Our interview is set for Jan 25th which is rediculous. Our case got completed on 11/13...2 1/2 months from case completion. My wife will be going to the Embassy and ask if they can reschedule the interview dat for something earlier...I've heard of incidents where they have done it before..

    I just ran into a phillipinese girl here in the laundry room. She was humble and nice...I guess she has been here for almost 10 years now and she was talking about her migration from phil to Chicago..She came here in a spouse visa too....

  10. NVC told me that they've sent our package on Dec 11th to Kathmandu, Nepal. In trying to track DHL, I found a whole list of packages to several countries except mine. I also tried looking on DEC 1Oth and can;t see mine. That makes me wonder if they;ve really sent it?

    What could it be..

    I am using Ref # EXP 11 DEC 2009A ..and EXP 10 DEC 2009A..

    If you think THIS wait is bad, just wait until you have the date.....these past few weeks have moved at a snail's pace!

    Second week of december is approaching in a hurry... Didn't realize time went by so fast. I remember being absolutely dissapointed upon missing November 2nd weeks scheduling cycle...Thanks to thanksgiving and the holiday for keeping me distracted from NVC stuff:) ..

    I am hoping to get early Jan interview date as our completed case has been sitting collecting dust at some NVC officer's desk since half way though second week of November...Hoping to be the first (or some where there) for Jan interview. I would love to get the first week's date..What a way to start the new year 2010...

  12. Hello Gurus - USEM called my wife and wanted her to show up to tackle the next steps involved with K3 processing. We have a completed CR1 sitting at NVC waiting for interview date which I believe will be assigned next month.

    Should we notify USEM about the fact that we do not want to pursue k3 go with CR1. Not sure if not informing them can screw things up later while CR1 interview..
