  1. OMG!! you never guessed what happened?! i sent in my rfe on november 7 in a certified return receipt mail. its been more than a week..

    i was wondering how come i didnt received the return receipt yet.. so i called USCIS and they said they haven't received anything..

    then i called my US postal office, i gave them my tracking number and they said, it hasnt been delivered until now.. they told me to call the destination post office to check it with them and they said they havent received or scanned anything..

    so im going to the post office tomorrow to talk to the manager..

    can i get a original copy of the RFE notice of action (I-797) from the USCIS?

    or can i send in photocopy of the RFE notice of action and have a letter from the postal service that it was lost?

  3. now im confused..

    it says to return this notice (I-797E NOA) on top of the requested information listed on the attached sheet..

    on the back side, it says, "when you reply, please include a COPY of the other side of this notice and also include any papers attaced to this notice."

    on the second page, it says, "each petition'ss response to a service request must be accompanied by its blue I-797."

    do i keep the ORIGINAL BLUE form (I-797E) and send a COPY of (I-797E) with the requested evidence???? or the other way around? :help:

    Remember I asked a service request from USCIS last week - i got an email today saying that my file is still in the background check.

    my congressman rep said she would send out a request yesterday or today ...so i'm not sure if she did it yet ...still waiting :crying:

    i got a rfe.. i'm thinking because i forgot to check the 'no' box on Part C no. 2 about convicted in court..

    but im so happy that they started looking at my petition.. :dance:

    what so funny is that, i emailed my local congresswoman yesterday and they replied back.. they want me to sign the privacy form and i also faxed it yesterday.. dont know if that made USCIS touch my petition..

    PS: I have my interview in December 30th, YAY! And I got my Medical Exam yesterday with vaccines and all (yes, there's one that really hurts... my arm still hurts! :( )

    ugh--- I'm still waiting for my stupid NOA2!! no updates yet. Nothing since my service request.

    Just got off the phone with the liason from the congressmans office and she was in contact with her rep at USCIS. Not too much to report other than the USCIS rep did confirm my response was received and logged into the system.

    Hopefully this will prompt work on the file!!

    Big hello for all CSC July filers..

    I have been reading your posts.. And I saw that some of you envolved congressman! So how did you done that? And what did you say?

    There are some couples from July that still didnt get their NOA2 (we are one of them).. But we see lot of August, September, and even October approvals?!

    So what do you think.. Can congressman do something about this?!? What is your experience!

    Welcome aboard. Looks like you have the same problem i do. WAITING!

    I have been saying I want to go to my congressman (who happens to be in the immigration reform caucus lmao) whatever ... I have been pushing it out ...but i'm going on monday morning! I figure I'll go then because it will be right after my 3.5 mark.

    Congressman in theory can help ...first figure out who yours is ...then go to their website. You will see a section for "constituents services" in there you will find a section for help with federal agency. They will require you to fill out a privacy waiver form ...I have been told that it is wise to go to their office in person and that generally each congressman has a person in their office who handles immigration issues. So, take some apple pie, hope that they are in a helpful mood and plead your case.

    There are quite of few people who have been successful with their Congressman's help and some people here who have used that approach.

    i see that you're from california too.. i cant seem to find the form (privacy waiver form) you need to fill out in my local congresswoman's (laura richardson) website..

    i went to constituents services then help with federal agency.. just cant find the form..

    do you need to call them first and they will redirect you to the form site? :help:

  8. I had an terrible day at work yesterday however I checked my case status tonight before I left for the evening and i saw that i had a touch. When I clicked on the petition number and the web page opened I saw the words I have been waiting for for so long.

    On October 28, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    So i will go out on a limb and say to the rest of the Julyers this is our week! As long as the paperwork is in order the NOA2's should be processed! I will keep you in my prayers tonight.

    malarie, what exactly did you say to your congressman? i'm planning on calling my local congressman as well when i get a day off..

    been busy of work at the hospital.. too many sick people because of the flu season..

    i hope we all get our no2 before the end of october.. wishful thinking..

    I am sure you will get your approval soon. I think its time to get in touch with your rep, maybe you can mail out a letter now. Sometimes they take long, but does not necessarily mean you will get an RFE. There is a May 09 filer who was waiting longer then all of us, and he contacted his rep and by coincidence he got his approval a week later.

    I finally got an interview date :).

    I was crying cause i can't access their website today...all day! haha

    Yeah - I'm contacting congressman next week ...going in person. Screw this! 2 august approvals and i'm already depressed. My theory is : keep myself busy ...and it doesn't hurt to try!!! :innocent:

  10. Got approved. :) Got my text message around 7:30pm. No touch, just approved. :D

    Back to my original point Guardian - this process is like LOTTERY because i bet you aren't b*tching now since you have your NOA2 and people before you don't.

    So, the only way I rationalize it is by believing it is a matter of luck - this way, when people get it I can still cheer them on. And that's why I was trying to give you a positive outlook the other day ...Which from your response didn't go so well.

    And on that note, Congratulations!!! I'm sooo excited for you...just like I was excited and happy for everyone else that got their NOA2. Goodluck on the rest of your journey ...wish you a swift one!!!

  11. OK Folks - I promised an update. Recall I sent an e-mail to the DHS person a friend of mine sort of knows. Below is the edited text of the e-mail I sent.

    My name is William Rogers and I am an employee of U.S. Civil Service. I was wondering if you could answer a few questions for me regarding my 129F

    Petition submittal. My understanding is that the USCIS reviews and addresses these types of petitions on a case by case basis and in the order they are received.

    BACKGROUND:

    1. I submitted a completed 129F petition w/check on 18 July 2009 to the California Service Center.

    2. My NOA1 date is July 22, 2009 and review time is still within the 5 month goal.

    3. My Receipt Number is XXXXXXXXXXXXXX

    4. I prepared my submission in accordance with the preference outlined in the Instructions for 129F Petition for Fiancée printed by your organization.

    5. To date I have NOT received a request for Further Evidence (RFE).

    6. To date I have not noticed that my 129F has been touched by your agency other than acknowledging receipt and cashing check. I gather this from the USCIS website "Case Status" Section.

    CONCERN:

    1. I track peoples K-1 visa process on various websites. I have since confirmed that the CSC has APPROVED petitions (non-expedited requested and

    non-military) that have NOA1 dates beyond mine. Clearly this is not the order in which they are received.

    Can you explain this to me? I am concerned mine is lost!

    2. If during this process we are still in the background check stage (and if I understand correctly this is a background check for me at this time) for national security - this should be easy... I work for the Department of Defense and do not present a national security threat. Same for my fiancée

    - She worked on a U.S. Army post in Korea and she too had to get checked out.

    I understand that DHS Immigration and DoD are separate agencies but I think we are "checked out (for lack of better terminology)"

    Perhaps by the time you receive this I will have my NOA2 - but if not is there anything I can do to speed this up? Can you tell me why others with

    later NOA1 dates have been processed?

    I would also like to have the name and contact information of a U.S. Government Employee, not a contractor, that can assist me in my query.

    I respect the Mission and Core values of the USCIS. I too have to operate under similar principals with a strong emphasis on customer service as I

    serve the members of the armed forces.

    Please respond concisely to my questions - look into this as I am concerned my 129F is missing or please tell me if I can clarify any concern.

    "You are correct the processing time for these petitions is 5 months and you are within the processing time.

    SO I responded back letting him know I spent some time writing that e-mail and that he didnt ackowledge any question and that he only acknowledged what I stated about the 5 month processing time. I told him I will take the customer service aspect up with the name of the person my friend gave me.

    I will note that in the morning I checked my case status at the USCIS website and nothing - the date of my NOA1. I decided to check before i left work tonite at 6:00 PM HST and I had my first touch. Coincidence - maybe, i'm not sure BUT I am a bit more happier today than yesterday. Good luck to my friends here! I'll keep you posted

    i feel you.. i'm also losing patience.. :angry: i sent my petition 1 week ahead of yours and until now my petition hasnt been touched! i have the same concern that it is lost or what.. Based on timeline data, my I129f may be adjudicated between October 9, 2009 and October 21, 2009..

    i have one question.. last week, Based on timeline data, my I129f may be adjudicated between October 17, 2009 and October 27, 2009*. but today, i noticed that it states Based on timeline data, my I129f may be adjudicated between October 20, 2009 and October 29, 2009*.

    how come it moved back instead of moving forward?? :angry:

    just wondering, will the consulate deny K1 visa if there is a pending F2B petition (unmarried, over 21 years old)?

    My fiancee's parents petitioned her in 2004. we plan to get married so i filled K1 visa last july 2009because it's the fastest way for her to be with me..

    A reply is most appreciated to ease my worrisome! :unsure:

    my fiancee has a current pending F2B (unmarried sons and daughters over 21 years of age of green card holder) from her parents filed in 2004.. I met fiancee in 1999 in the philippines in my college years and we are a steady couple for 10 years.. i finally became US citizen this year and decided to get married since K1 is the fastest way for her to get over here..

    will this pending petition deter the approval of the K1 visa i recently filed? or Will the consulate deny her the approval of K1 visa due to this ground?
