  1. Have you contacted USCIS to find out what the problem is?

    You should first find out why they were sent back. When you called NVC, what were they able to tell you? only that it was sent back? Hopefully the petitions are still eligible :unsure:

    Thanks for the fast reply, yes first ive been contacting the NVC and they cant answer me. So awhile ago i called up USCIS but didnt talk to a human. i will again later maybe their phone were busy.

  2. Hi everybody,

    I just now knew that my I-130 petition has been returned back to USCIS. NVC already sent us AOS bill with the invoice and ds 3032, we already paid $70 for the AOS, 3 days after while wewere checking for the status online it keeps on saying not eligible to process so i decided to call NVC, from there i knew that the petition was sent back to USCIS, i was shocked! Why did the NVC sent the billing to us if they will send back the papers to USCIS? THey should have checked it first before they sent the billing. What would happen to the payment?

    Prior to that we got a notice from NVC that they got our petition from USCIS and they will send it to Manila Embassy. a week later they sent us another letter from NVC that they sent back the I-129 petition, :( so we decided to go to CR1 route.

    But i cant believe it that they both sent it back to USCIS!! whats the problem?

    can somebody tell us what to do? does anybody here have the same problem? pls help im so tired waiting. my petition was 2007 and we were so happy to get an approval notice after 2 years but look they sent it back again...does that mean another 2 years waiting? OMG i hope not

  3. U mention that you have 2 kids including ur daughter who's going to have CRBA.How about ur other kid...is he/she USC already?If not,you need to inlude him/her on the petition as K4 if you will go to K3 route.

    Oh ok tnx on ur answers, yes i have son from my previous relationship and we already included him to the K3/K4 petition, wht if we go to CR1 route do i have to file for his 130 petition ? My daughter already have phil passport, and now im working for this CRBA, does my daughter need CRBA b4 going to US? or i can do it to US na lng?

    Rick e-mailed me the notices from USCIS that our I-130s (for me and my daughter Pippo) have been approved. I was so stunned!

    But the Feds still have our I-129F pending...if they don't send it to us with the same date as our approved I-130s I know we will be in trouble...it would mean we cannot apply for K3 and K4, right? :(

    Can someone help me understand what we are going to do if we proceed with CR1? Because from what I understand, I have to become a permanent resident first before our daughter can submit her visa application...is this correct?

    The main reason why we want to do a K3 and K4 is so that both Pippo and I can get visas at the same time...if the Feds don't give us an I-129F approval with the same date, then we will be forced into CR1, which is not what we planned...I don't like the idea of leaving Pippo here for any amount of time...

    Please help...am happy about the approvals but that was sort of shortlived because there is no approval yet for the I-129F. :(

    First, you stated you and your daughter's I-130 were both approved. Did you submit an I-130 for your daughter? If you did then proceed with both I-130s.

    If not, then you will need to submit an I-130 for your daughter and slow your process down until your daughter's catchs up to continue with the CR1.

    The first thing you need to do if see if the I-130 was sent to the NVC. The I-130 NOA2 will state if the petition was forwarded to the NVC. If it is worded like you are already in the US, then the I-130 is being held for AOS and your I-129f was most likely approved too.

    your case is same as my case, I got approved too without knowing that my daugther I129f painding I got worried but so then dont waste your time, while ur case still on process to NVC you can or your husband can submit I130 petition for your daugther and slow down your IV processing. By the time your daugther approve then you and her can submit IV processing to NVC.

    Remember your visa will take only 6 months to expire before that happen I hope your daugther I130 approve.

    Hello can i just pursue the I-130 and when i have the visa i would just go to US first and would file for my kids' I-130 later so it wont slow down mine, would that be possible?

  6. I would suggest that you guys take the CR1 route. It might be a little pain in the #### going through the affidavit of support at NVC but its worth the wait. It'll save you a lot of bucks from the AOS if you do it in the states. And yeah, the timeline to process k3 versus Cr1 is quite the same.

    Hi there would i knw how did u email the DS 3032? I emailed mine 2 weeks ago using the template here but until now i didnt get any notice that they got it. i didnt attached the barcode from the DS 3032 would tht make any problem?

    Hello, i think we r on the same shoes, I-129 and I-130 approved at the same time and my husband got both the mails but the prob about our petition is that NVC mailed back the approved I-129 to USCIS and they didnt say what was the reason behind. My husband also got mail from NVC about the AOS billing. We are planning to do the I-130 instead but i heard that our kids need to have separate petition for I-130, :( It means that more more waiting.

    Did u file separate I-130 petition for ur daughter?coz u said here "Rick e-mailed me the notices from USCIS that our I-130s (for me and my daughter Pippo) have been approved" or just K3/K4 petition?

    ***As wht i understand (well, ive been reading coz of this scenario we r having) I-129 is a non-immigrant visa where in the spouse (and child/ren of spouse) of US citizen can go to US TEMPORARILY and u need to adjust ur status before the 2 years time. In I-130 which is an immigrant visa once approved u dont need to adjust ur status when u go there. They said CR1 is cheaper and better than k3 petition. But for spouses with kids like us we want to go to US with them.

    thats what I did for my son and they didnt look for an exit permit!

    Hi my daughter has a Phil passport and K3 petition just got approved (I-129 returned to USCIS from NVC while on I-30 we received letter from NVC containing the ds3032) does she need CRBA b4 going to US or we can do tht on US?

    got another question about I-130, if we decided to go to CR1 route do i need to file separate I-130 for each kid? i declare my son on k3/k4 n update USEM on our new born daughter(NVC already receive her Birth Cert.) or i can just call them for update of my i-130 petition?

  9. yes i sent my DS3032 with the cover sheet bcz i had attorney to do my I130 and if attorney does ur I130 then u automatically get cover sheet generated with the bill for the aos and ds230. i email my DS3032 and it was two pages one barcode and one ds3032. i format my ds3032 from the vj. abby n sheryl

    hi i used the ds3032 template from vj but didnt include the barcode. do i have to scan and send the page with barcode together with the letter?

    wait for case close

    when case close u will get interview date

    have the medical before the interview

    interview pass then get visa

    My hubby received 2 letters from the NVC , the 1st is stating that the I-129F approved petition is returned to USCIS, the 2nd letter contains the AOS billing and the ds 3032 form. I have few questions too and i hope for ur reply.

    1. Is it ok that i will just e mail ds3032 or i also have to send mail to NVC? My choice of agent would be my husband would that be ok?

    2. After my husband pay the AOS what would be the next step? Would they wait for the ds3032 mail from me before they proceed?

    3. My petition is K3/K4, what would be the petition to process first, the I-129 or I-130? Coz i read on some articles that it should be the I-129 but on my case it seems that the I-130 comes first.

    Hi Jen F! after you received a letter from the NVC, what is the first thing to do? email or mail the DS 3032 or pay the AOS? the USCIS email us that they already approved our petition but we haven't get the hard copy of NOA2 yet. I hope we can help each other. Thank you!

    Well actually neither of us get an email notice from USCIS, and only my hubby got a hard copy of approved petitions (I-129 and I-130), the first is returned to USCIS while the last one have send a letter to my hubby about the ds3032 and AOS billing invoice. I already email my ds3032 today and will wait for the confirmation from NVC after that i think we will pay for the AOS .

    wait for case close

    when case close u will get interview date

    fastest way to send ds3032 is to email it to NVC but sometimes they get and update it late so some sends it through snail mail. i did both though.

    after your husband pay the AOS, he then would get an instruction for the IV fee bill.

    i129f and i130 gets approved at the same time but the first one usually get finished first coz there is no pay processing time for the visa like the last one. only you pay for it when you're done your medical and before your interview.

    choice of agent is really your husband and he will be the one receiving any correspondence letter from the department of state in the future, but what they do is CC it to you so you'll have a copy for whatever they send to him.

    i may be wrong but im basing it from our case...

Hello everyone ..Being newbie here in this site makes me feel im belong..maybe because i know i am one of the people here in a situation of waiting for the time to be with their man or woman of their life..Anybody here can give me at least an idea which takes longer in processing between k3 and CR1..we told our attorney to process a k3 for us..though he filed it in two ways..as k3 and CR1..now we are approved in our I-130 and 129f remains pending until now..instead to be happy..we have questions in our mind now if this will be good or this will makes us wait longer than we expected..we got a notice from NVC telling us to pursue the CR1 now...we cant do nothing but follow.. so thats the path of our papers now......pleassssssseee i need to be enlightened because day by day its getting harder for me and for my loving husband waiting to be in each others arms..any idea would help..Thanks..Godbless... :innocent:

    cr1 na lang kase ganun naman nangyari sa case namin.di na kami nag file ng 129f.tuloy tuloy na yan. you will then receive ur case number from NVC...basta if NVC sent u papers just send your reply right away...NVC reply aptly...goodluck

    Hi, I have a petition K3/K4 both of them are approved at the same time but I-129 is returned to USCIS for reason we dont know. Now it seems that I-130 will be processed first than I-129. It means that we can pursue it and follow CR-1 right? how about my 2 kids? they will be left out if we dont file separate I-130, if we do how long would it take us to wait for the approval, another 6 months? if that so, then i must proceed to K3/K4 so i could bring my kids with me.

  12. Kumtu, your next step is to decide which one you want to follow. From what I've seen, the K3 is not really any faster than the CR1. The K3 will cost more money as you will have to pay for adjustment of status once the beneficiary is in the U.S. This runs around $1010 all together. With the CR1, you don't have that cost or the extra filing. The only benefit to the K3 that I can see (and is the reason I am following it) is because with the K3 the beneficiary interviews in the country where they got married. With the CR1, the interview is in the beneficiary's home country. My husband is from Iran, but lives in Canada. We got married in Canada and therefore, he is interviewing in Montreal, instead of Turkey or Dubai, which you can see would be a real hardship to have to go that far. I would not recommend following the K3 unless you have an extenuating circumstance that requires it. If you decide to follow the CR1, NVC will contact petitioner and beneficiary with the next step in the process. For the K3, NVC will send the petition to the Embassy and the Embassy will contact the beneficiary with instructions for the next step. Just ignore the instructions for the petition you do not want to follow. I hope this made sense.

    Hmmm u make me think there. We file K3/K4 and it says that no need to file a separate petition for the kids, so for me as i understand once I-129 and I-130 is approved it will automatically approves them. Am i right?

    Without I-130's for the kids there is no visa for them unless you go the "K" route....

    oh! so how would we file for the kids?

    3. My petition is K3/K4, what would be the petition to process first, the I-129 or I-130? Coz i read on some articles that it should be the I-129 but on my case it seems that the I-130 comes first.

    Would you mind sharing your timeline? Which Service Center processed your petition? We submitted our I-129F in May 2009, but our last update has been stuck at Jun 3, 2009. :(

    Hi simplyme4ever4...just curious, why did your Packet 4 take so long? You got your NOA2 for the I-129F fairly quickly (a little over a month), but your Packet 4 came several months after.

    Our petitions are at CSC...wonder what is taking them so long. :crying:

  18. I came here in the US using K1 visa, got married January 2009, applied for AOS last February 2009. Right now, my AOS application is still pending and Im 24 weeks pregnant.

    After much thought, my husband and I have decided that I will give birth in my home country, the Philippines. I am anticipating that I won't get my AOS application approved anytime this year. I already have my EAD and AP and I plan to travel with my son (who also has AP) using the AP documents. My question is, how long are we allowed to be outside US? Im planning to travel on October, give birth on first week of December then come back last week of December. So that will be 75 days total. My husband will follow and be there for the birth of our child. We will apply for CRBA for the baby and come back here in the US all together. How does our plan sound? Are we missing anything here?

    That's what i did..never had a problem at all. The only difference is i already have a green card when i travelled. You can stay as long as you don't stay out of US for more than a year. I was in Pinas for 5 months. Bring all ur husband's documents so it would be quicker for u to process the CRBA. Good luck.

    Just not sure about when your interview for your AOS or if you will be interviewed. You should not miss it. I can give you the detailed requirements and steps of the CRBA process or you can ask Mikenyhen..

    Hi there happywifeymom, im a wife of a US citizen and i gave birth here in Phil 8 months ago, our k3/k4 just got approved a month ago after 2 years (whew!) could u tell me if i should apply for my daughter's CRBA now or can i do it in US when we get there? If i should apply now what are the procedures and requirements needed ? pls help thanks
