  1. Looks like we want to extend the length of time before the interview. I rushed this application and just got a job that will become permanent soon. I feel if I can push out the interview for a couple of months, we will have a much better chance at showing support. Another reason to do this is if they request any more documents, my fiance's country takes much time for any official documents to be produced, and I'd hate to go over the time period if we needed more documents after being interviewed.

    I beleive I have to write an explaination email to the US Embassy where my fiance is. And they can either accept or deny this request. Can anyone confirm that?

    Does anyone know if these are good reasons to state on the request letter? Is there a sample request letter. I haven't been able to find one.

  2. What exactly is the problem with last year's tax return? It doesn't matter whether you made enough last year, you need to verify you make enough NOW (at the time of the interview) Lots of people, especially former students, qualify with making little or no money the year before. You WILL have to submit the last years tax return for the AOS so you may as well warm up the copy machine.

    Consulates can extend the petition approval in four month increments on request, and at their discretion.

    So if the interview is before I get this years(2009) tax return, then I have to file 2008's?

    I'll tell you the problem, I didn't file in 2008. I was working over seas and wouldn't have paid in or gotten paid. I know, I know, I'm a bad person.

    And this may seem stupid, but I haven't had to deal with most of this for many years since I lived over seas and I forget the tax process. I usually filled out the forms and mailed it in, but the return never came to my address overseas and whatever was send back was filed for me by someone else.

    So what I submit is the W-2, and the tax return. And the tax return is a piece of mail that come back to me after I've filed, correct?

    I'm not sure why you would ask me how strong my desire is for me to have this visa accepted. I'm obviously here trying to learn how to do the right thing to get a visa for my fiancee.

    I would imagine that you only need to show your Federal tax info, or is not submitting the State proof that I don't really care about the visa going through?

    Reading this again and your help to me it looks like you do not have to submit your last years tax return and w-2 unless you are self employed. Which I am not, I have a contract, but I am working for a company

    I'm still fuzzy about what I need to submit. At minimum two to three recent paystubs, and a signed letter of employment from my company.

    But it also says this "Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134."

    But I can't find the 4 options in the I-134 or anywhere.

    Anyone know if you can push out the interview date?

  4. This is the problem.

    I'm on my NOA2, which I just received yesterday.

    I moved from Japan recently, and haven't been working all year until now.(which was my choice)

    I just started a contract position, meaning there is suppose to be an end date. But in more likely hood this contract will go on for a year or so or I will get hired full time.

    From reading the guides, I beleive that I need to submit my last years W2 forms if I don't have a full time position. I don't know if a contract position is considered full time. If the interview happens early next year my W2 for this year will not show enough money to qualify.

    I also may run into trouble if my fiancee's interview happens quicky, as I won't have three months of pay checks to show them.

    I don't own anything or have more than a few thousand in the bank, but my salary at this contract is more than enough to qualify for the 125% over minumum

    Any thoughts on this? Is a full work week contract position considered full time and allow me not to submit my last years W2?

    Also, is there any way to prolong the date of interview. Can you ask to have it scheduled at a later time?

  5. It looks like the during the I-129F process they don't ask for much proof that you can support your fiancee. It only asks iy you are employed on the G-325.

    At the time I am not employed and haven't been for a while, is it possible that I could be rejected at this point because of this? I intend to be working very soon and have others that would be co-sponsors, I don't need to show this on the application for the I-129, correct?

    It looks like the second part for the interview is when support proof needs to be shown, correct?

  6. A month ago I filled out the G-325A. It had 5 pages, four you could fill out and were the exact same sheet. It also says on the USCIS webpage that there are four sheets. This sheet had an expire date of 5/31/09

    I went there today to look and the USCIS webpage still says four sheets but when downloaded there are only two sheets, with only one copy of the information and the other being instructions. The document has an updated expire date of 6/30/11.

    Looks like they only need one sheet now. Anyone else know about this. Also, can we get the G-325A download on this site corrected fast so no one has any problems?

  7. I'm not sure about how detailed this should be and I don't see any examples.

    How long should this be? Would this be sufficent?

    I (My Name) have lived and worked in Japan as a (my job) for the XYZ Company through August 2004 to July 2009. (her name) has lived in Japan from *********. April, 2007 on the internet on a website named “My Space” we became acquainted. A few days later we met in person at a bar in Roppongi Tokyo. (Her Name) was with a friend name (friends name), I was alone.

    We started dating immediately and have done so since that time. We have traveled together many times to locations such as China, Burma, and South Korea. We have been in daily contact since meeting either in person, email or using skype.

    I look at that and think it is aweful. But is that what they want?

  8. The example can be a little confusing because they are examples for both the initial petition stage (when submitting the I-129f package) and again for the interview stage (where you will submit them again).

    For the initial I-129f stage you'll use the Service Center address and for the interview, you'll change this to the Embassy/Consulate. If that helps.

    ok, so both of us should use the Service center in Vermont for our first applications.

    At a later stage, we will need to send these two documents again and we will use the Embassy where she is located.

    I am the USA citizen, am i correct saying that only she will be getting an interview.

    On the guide for the I-129 it says: "Original statements (from both the US Citizen and foreign fiance)"

    I assume that we both need to fill these out.?

    I'm confused what address we are suppose to add for each letter.

    The example on this site says write the (USCIS service center address).

    I assume that both I and she would use the Vermont address.

    Also on the example, it says if submitting for interview, instead of using the above Vermont address. We should use the:United States Department of State

    United States Consulate, [name of country where Embassy is located]

    [Embassy Address]

    I'm not sure if we are submitting for an interview at this step? Or is the person who is coming to the states applying for an interview and should that person add that info onto the sheet?

    Also, anyone have link to the Vermont USCIS address. I can find the mailing address but not the real address. Or is that what they want.

  10. A few more questions.

    1. I think at some point I have to submit my last years W-2 forms. Again, my last years earnings were probably enough to support both of us and satisfy the K-1 Visa requirements. At what point is this info given to the goverment.?

    2. I will be sending in the I-129F soon. If that is all ok, then it will be sent to the Embassy where my Fiancee is (Japan).

    She will have a interview. It looks like my work will be done. I don't have an interview at all. Is that correct. Like I mentioned, I will be travelling the next few months and an interview in the USA would be very hard to make.

    I am starting my journey on getting a K-1 Visa for my fiancee. I live in Maine, she lives in Japan, but she is Burmese. I just moved from Japan, she is there. She has been married before in Japan, but now is divorced.

    I'm sure others have asked this question, but I thought I'd start a thread so I can reply with specific questions.

    First off........I'M CONFUSED! This is a lot to take in. Second. Congrats to those who have completed the process.

    Ok, on then. Please correct me if I am wrong.

    So the first thing I will need to do is send in the I-129F

    Along with the I-129F should be:

    1. Copy of my Birth Certificate, front and back

    2. Copies of Evidence that we have met in the last two years.(Pictures and emails I suppose)

    3. Original statements from both me and my Fiancee stating that we want to get married, also evidence to prove that we want to get married.

    4. Documentation that proves that she is divorced

    5. 2 copies of the Biographical information document signed by both her and I. Document G-325A

    6. A passport style photographs for both her and I

    7. A check for the appropriate money

    Does that sound correct, am I missing anything? I don't have any criminal offenses, so documentation for that is not necessary. I thought I read that you need police reports from all countries you have lived in, but I don't see that listed on the uscis site.

    One thing that might be a problem is that I am unemployed and have been since the beginning of the year. The G-325A is asking for the latest employment and dates. It has been my choice to be unemployed. I have been travelling and working on farms for free. i also plan to travel the next few months. Does anyone see this as a problem?
