Hubby's mom is here for a few months on a tourist visa fron Peru. We are thinking about starting the process to get her residency but aren't sure if we can file while she's here and if we do file and the tourist visa runs out can she stay until the other gets approved or is that a big no no? She has been here several times and never overstayed before and is in her late 60s in good health. Any info is appreciated!

My hubby is a legal permanent resident and he sold his apartment in Peru, but has not worked this year. Does he pay taxes on the sale of his property? What about on interest on stocks? Thanks!

Congrats! Ours was approved today too! After they transferred our case on the 25th of Jan, they didn't touch it other than the day he had biometrics and about three days later. Then we got the email this morning! We never expected to get one on a Sunday! No more paperwork for (almost) two years! YAY! Praise God!

Hello all!
My husband and I got married about three weeks ago and we were so thrilled to get our marriage license back today. We went into the drivers license office to change my name and address and get an application for him (he had a drivers license when he lived here back in 2000 to 2001 but it expired in Jan of this year) and they told me that since his last name on the marriage license has both his fathers and mothers last name, I could only change my last name on the license to the last (in order) name on the marriage certificate, even though that is not his official last name. His old license has only his official last name (his fathers last name, I should say) and also the SS card they issued him in 2001 only has that one last name on it. Nevertheless, we were told that he would have to go to court to officially change his name, then we would have to go to the SS office to change both of our names, and THEN wed have to get an amended marriage license before we can do anything else. HELP! Does anyone have any advice for us? Thank you!

Hi everyone, I was just wondering on the I134 for the K1, it asks if I have stocks and bonds. I have a 403b account that I'm saving money for retirement in and I know that money is invested in the market, at least partially. Do I need to put that on the I134? How do I get a list of where those are invested? I know the value of it, but I have NO idea where it is invested. Thanks!

Thank you Jenna555! I called and they told me that it did already pass through the NVC! They said it should be in Lima on Monday! Praise God for how fast this is going!

Hey everyone! I recieved our NOA2 on the 28th of September and the letter I got in the mail says, "The above petition has been approved and forwarded to the listed consulate." Does that mean that they didn't send it to the NVC first? Or do all the approval letters say that. We haven't heard anything and it's been almost two weeks, so I'm a little concerned! Thanks!

He can try and visit. There is a chance he will be turned away so he needs proof of ties to his home country when he visits.
What kind of documents could he show for that?

According to the rules: After you marry (in the US I am assuming) your fiance would return to his native country and you would petition for a CR1 visa for him. You could certainly even submit the petition during his visit to the US.
Do some reading here on VJ and you will find many people that have decided to marry while their boy/girlfriend is visiting and then adjust status. Your scenario is different as you are stating that the intent is to immigrate.
Entering the US with immigrant intent on a non-immigrant visa is fraud. There are some stiff potential penalties such as multi year bans on entry. Educate yourselves before beginning the process so that you are prepared for all eventualities.
So, would it be smarter to just apply for the K1 visa (what's a K2 visa?) instead and wait for that??

My fiance is from Peru and already has a B1/B2 visa and a SSN that was issued to him previously after he completed a master's degree here in the states. What else do we need before marriage? After we get married, what papers will we need to file? How long should it take before he can work?

Hello again!
My hubby, naturalized USC, is wanting to adjust his mom's status while she is here on a visitor's visa. We are wondering when and if she can leave the country and if so, for how long, during the process.
