I have a bit of an odd situation guys.. was going to ask for help. I have a daughter that got pregnant during the visa process. Now, her final interview is scheduled (thereafter a visa to us arrives) but now, she has her 1 month old son. Does he qualify for follow to join benefits? (She hasn't gone thru the interview yet, only her brother, who arrived her in the US last month). Do I just file the i-485 while she waits in Brazil?

We were so lucky to get an email today that my husband's green card is in production, his condition to remove status approved, no interview! Wo wooo! Talk about a great Valentines gift! From 2008 to now, he and his 2 children from Brazil are now in the clear..
I had to stop by to share the good news and to thank everyone here at VisaJourney for the invaluable service and support you provide. We had a couple of freak outs (one including them opening the green card package they weren't supposed to touch in Brazil!) and this site has always led us by the hand and reassured us! Thank you all!

Don't fret guys, I filed mine end of September, I believe.. and didn't get a letter for biometrics until early December. We did get the letter, though, that my husband could travel in the year his case was being reviewed. Also, to note, our location was changed. His first biometrics was in a different city.. does sound like its backlogged.

My husband was arrested in the 2 year period we've been married. He was arrested so they "could find a translator" and investigate. The case had no validity and was No Billed by the grand jury. We also were able to get his record expunged (as of August) because of this. We tried to get official copies of his No-Bill and Arrest, but the county clerks says because of the expunction order, no such records exist (which is good news...) but... now do we provide this proof then for our case? All I have is a copy for our lawyer of the Order to Expunge his record due to the No-Bill, etc. Ideas please?

I agree. Skip visitor visa and go for i-130. Since it is before you and your wife's 2 yr anniversary he will come in as a CR2, but being that he's under 18, will be directly treated as your child. I just filed for my 2 step children, process took about 6 months, our interview for visa is in July.
This may be one of those cases where AOS from a visitor visa is not the best idea.
CR1/IR1 may be a better bet.

i emailed them for a name correction on my step-daughter, and for a question, two seperate emails. they're reply time on an email was about 2 weeks.

We currently have an interview set up for my step-children and hopefully, in August, they will be entering the United States. Because I filed for them before our anniversary, they are both CR2 status.
However, before entry, we will be having our 2nd anniversary (next week). Does this automatically make them IR2 status?

I have a letter from the mother, as well, stating her approval of them living in the US with their father. But since they don't fall into either of the 2 categories:
Applicants in the following visa categories are required to provide 1) an original or certified copy of their Petitioner’s birth certificate and 2) original or certified copy of their Petitioner’s marriage certificate from the Petitioner’s current and all previous marriages.* Parent of a U.S. Citizen who is at least 21 years old (IR-5)
* Brothers and sisters of United States citizens (F4)
I don't need my (petitioner) birth certificate and marriage certificate, correct?
Guys, just a quick question. I am filling out the ds-230 for my 2 step children. As the petitioner, do I need to provide a certified copy of my marriage certificate? birth certificate? Also, my husband can sign for them since they are both minors, correct?

I'm in a similar process w/ my 2 step children. I filed both i130s together (same envelope, 2 applications, 2 fees) and the cases have travelled along together. they were approved in january and are marked as "related" .. for the affidavit of support, i was only charged once.
this discussion brings up a good point though, i am about to file their choice of agent and affidavit of support forms, should i also ask their mother (whom they currently live with in brazil) to go ahead and do that notarized letter that says she allows them to come and live here? should i send that in w/ the forms, or just seperately when it arrives by mail?

I'm a bit confused on the process after approval, I am trying to bring my step son and daughter from Brazil. They are both minors, under 21, unmarried.
After I send in the affidavit of support and choice of agent forms, what next?
Do they have to do an interview at the embassy (even if they're both minors)?
Do they have to go to the embassay at all?
Where will their visa forms be mailed, here or Brazil?

Just a bit of follow up on what happened with the case here:
Her case was joined w/ my son's as a "related" case.. so when I look up his case, her's actually shows. I also only had to pay the fee once and it covered both of them. Only trouble was, they entered her name as *my* name and I have to now send in her passport/birth certificate to have that amended.

Hi guys,
I filed for my son & daughter, both minor children of USC, together and their cases were accepted together and approved together in January. However, in February, I only received one letter from the NVC asking me for choice of agent etc. Since the cases were going together to this point, I'm quite worried my daughters case might have been lost somewhere in the mail?
I sent an email to the NVC contact address on my son's case, explaining I had not received my daughters info and gave them my info, my sons and my daughters.
Anyone had any luck w/ email responses? Any ideas what might have happened?

Ah, ok that makes sense. So, they basically get their visa applications from the consulate and we wait for that process, correct? And as I understand it as children under 21, unmarried of a USC, they do not have to wait for a Visa number? I'm wondering if the chances of us flying back with them are getting brighter!

Hey Guys,
I filed for my husband's children and received the letter January 19th. I've heard others mention that the letter requests a 485? My letter simply said they were approved and the consulate near them would be notifying them. In the meantime, though, I'm up for my yearly visit over there. I'll be staying for two weeks, visiting them in Brazil, and by luck, I'm also flying out of the same city the nearest consulate is at. Is there anything I can do? Any thing I can prepare ahead of time?

He actually keeps very good contact with them, and has for years (thank god for msn video!). He also spent 3 months with them in Brazil after he got his green card and I joined him for one of those months. Met the entire family, including Mom. We are blessed in that the family are all very welcoming and we are hoping the best!

ah! I got it guys, i think I'm clear now.
Ok, so basically run thru the I-130 form/procedure is our best (and likely only) bet for now and the future, correct?

We would not mind having them to stay, of course, just for now.. we'd prefer just a visit to give them the opportunity to choose.
Even though he did Adjustment of Status, wouldn't he still be a K3 (Spousal) visa.. so then could I request my children (stepchildren) on a K2 thru the embassy? Then adjust status (if we choose) with the I130 once they are here?
That's where I'm getting confused...

We do plan to have them go back and live in Brasil, if only temporarily. This is mainly a tester visit to see how they like it here. So, our primary goal is just a visit.
I am a US Citizen, he came in on a visitors, expired. We married a few years after that, adjusted his status and now he has a Green Card.
So, they do not qualify for follow to join benefits?
Then I need to take action and file an I-130 for them, correct? That's the only way they can visit?

I'm a USC, married to my husband (came in on visitors visa, succcessfully adjusted status and got green card beginning of Dec 2008). My step children are 10 and 12, and after meeting them in Brazil we would like to bring them here for a visit first, possibly to stay later. Primarily, now, a visit.
The daughter's birthday is coming up and we'd love to suprise her by bringing her and her brother for a visit here. What is the quickest way? K2? (she and her brother were listed on his application forms) If so, then I call the US Embassy and tell them my daughter is ready for her interview, correct? They get their medical exam, passport, interview and ready to go? (My husband also had a notarized consent granted from mother that she would allow them to travel done while he was in Brazil.) Then.. later I adjust status?
Or, do I do Follow to Join and file Form I-824 with the National Visa Center?

The petitioner (my husband) is a USC. He filed for my daughter and son. But we're wondering as our daughter walks thru that lost process, if we can change her status to add a follow to join for my grandchild. And if so.. how do we do that with the interview already pending abroad?
