  1. My spouse really was in no condition to go to the interview which is why we rescheduled... It just happened to be really bad timing I suppose...

    Yes we have a confirmation number showing that we did in fact call the day before. So far (almost a month later) we still haven't received a notice to go for the interview, but I'm personally not in a hurry, it's not like I'm going anywhere :) As long as it happens before my work permit expires I'm good

    I have seen people get letters like that (via posts here) - which is why you should make every attempt to keep appointments.

    However, since you have proof you re-scheduled, you should not have that much issue - I would make an infopass to make sure though. (depending on when your new interview is).

    Your SSN is yours for life - they don't "cancel" it. Some other issue is going on with that.

    My spouse fell sick two days before the interview and still wasn't better on the day of the interview so we asked to reschedule the interview the day before we were scheduled to go in. The USCIS lady on the phone was very nice to us and said they sent a notification to the local uscis office saying we rescheduled.

    A week later we get TWO letters. One says "because you didn't show up we have denied this application". Another said "we are in the process of rescheduling your appointment".

    I called immigration and they don't see that it was denied, and that it was probably a mistake in the system, but I don't want to assume anything.

    Then last week I tried opening a savings account with American Express and they said my social security number was invalid ! I don't know if that means that because of my lack of credit I couldn't open anything, or if (god help me) the federal government has canceled my social security number.

    I called SSA today and they said the number still belongs to me, but they can't say if the government did anything about my status.

    Has anyone else ever gotten two letters like this?

  3. We have our interview next week and my wife is really stressed out about it because our situation won't look very convincing to the immigration officer, even though we are REALLY MARRIED for LOVE...

    First of all we didn't have a big wedding because I had just graduated from a VERY expensive course, so I couldn't afford a big white wedding, nor a honeymoon, so we got married at the justice of the peace. Our philosophy was, when you love each other, you love each other, you don't need a big wedding to prove anything. So after our wedding we had a few drinks with friends and family that night, except my camera's battery was dead so all I have is a few really blurry phone pictures.

    The next thing is that none of our utility bill companies allow both names to be on the bills, so what we always do is I give her half the amount, or she gives me half the amount, and then whoever gets the money pays the bill using a credit card, but no credit card that is in both names... I have bills in my name and our address, and she has bills in her name and our address, but never "together"...

    Another problem is that we never got a second bank card of our joint bank account, and because it took so long for me to get a work permit I just used my banking card from back home in Europe, because I didn't want to use my wife's money. So... we haven't used the joint bank account yet (but we will, once I start working)

    Another thing is that my wife got a promotion at work and is now working nights, which means lately we haven't really "gone" a lot of places, because she's always tired and sleeps during the day, which is when everything is open... We like our life right now though, even though we mostly just stay home we watch TV and cook and spend quality time together, and when I'm done studying for another course I'm doing I play guitar hero with the kids. We really like what we have, but try to convince that to someone who thinks all marriages are fake just to get a green card!!! I come from a good country and have no business being here EXCEPT for my wife and her beautiful young kids. The only reason we decided I should stay here instead of them coming over to Europe is because the kids go to school here and none of them speak my language (Dutch). I just got reminded of another problem, she didn't take my last name, again because of the kids who are from her previous marriage (the ex-husband still has partial custody of the kids, and I do NOT like the guy... he still calls my wife every now and then and yells at her, and I can't do anything about it because he's crazy and quite frankly, he scares me, but he's a necessary evil in our lives right now)

    Anyway what we have so far is:

    - toll tag bills in both names

    - renewed car insurance again in both names

    - lease agreement in both names

    - we'll joint-file our taxes this week

    - pictures of us and the kids

    - my driver license just got renewed and now it's showing our home address

    - christmas cards from family

    - our story that you can't just fabricate (we met at McDonalds for crying out loud, hahaha!) Ok there's a whole lot more to that story, but still..

    What more do you guys think we can provide? Is this enough? I know it doesn't look good but our marriage is not a sham, we're honest people who have never done anything wrong, we just want to be together... Should I talk to an immigration lawyer this time?

    Sorry we haven't done the timeline yet, I don't quite know how to do that but I'll try after I'm done posting this

    My wife can't find her W2's of 2008 anywhere and we need them for the I-864 form... we went to H&R Block to pick up her tax return documents but they didn't have her W2's on file... she worked for 2 different companies that year and one company is NOT cooperating in sending us a W2 copy...

    The other option we tried was we called the IRS office in Austin to ask them if they can fax us a copy of her tax transcripts and they said they can't do that because of security reasons... Our only option it seems is to fill out a form and have them mail it in, which could take 2 months. The RFE has a deadline on it and I simply can't afford to wait 2 months to get those forms.

    Is there ANY way we can get anything sooner?! Please help

    Thanks everyone, we got through to someone and they can fax it as long as we stay on the line at the same time. Since we don't have a fax machine my wife will use the fax machine at work. Hopefully we can send everything back today

  6. Awww yep it's good they're working on your case and i'm sure it will all be fine.

    We sent the 1040 and the w2, plus 6 months pay stubs. If you don't have the w2 you can get tax transcripts from your IRS office.

    Ok thanks ! Yeah I'm afraid we'll have to get tax transcripts from the IRS because my wife can't find her W-2 anywhere... I hope they can email them instead of mailing them out to our home because that would take longer... I really can't afford to wait another 2-3 weeks (I got an awesome job offer and I want to start taking care of the family, but I have to wait for my EAD, which is dependent on me sending in those tax documents)

    Aw that sucks, I think you can request them by phone. Or possibly go to an irs office and collect them. I'm not sure of the specifics though. I know it was posted somewhere. Possibly on the October filers thread as I-864 RFEs seem pretty common.

    I'm completely confused now... so, my wife doesn't meet the poverty limits which means my brother-in-law is cosponsoring. I got the RFE after I sent in both an I864 form for my wife, as well as an I864 form for my brother-in-law, plus copies of their tax returns (1040A) for both my wife and my brother-in-law. I can't figure out what I did wrong? I keep reading about form 864A and I don't know what to do... Can anyone tell me what to send in exactly in my situation?

  7. I'm such a dumbass... I accidentally washed my passport with my clothes... I had it in one of my pockets and I forgot to take it out...

    Everything's still legible but the page with my information is loose from the passport... I called my embassy here in the States and they can provide me with a new passport but it's not machine readable... Has anything like this ever happened to any of you? I'm in the process of changing to a green card and I'm about to get a travel document. Will they need my passport for this document? If not I will just go home with an emergency travel card from my embassy once I get the travel document from USCIS, apply for a new passport in Europe, and come back with both my new passport as well as the travel document... Advice anyone?

    What is your status? For example, if you are here on VWP, you might also want to check on how to make sure you properly document your departure - if the I-94 is destroyed, you may need to get a new one -- etc.

    I'm here on an M1 visa adjusting to permanent residence. I have copies of my passport and I-94 card. As for the actual I94 card it still has the I94 number legible as well as my name and expiration date, but it's kind of "washed off". Immigration is already processing my I-485 with the copy of my I-94 though, and considering I'm getting a travel document and later a green card I'm sure the I-94 won't be a big issue

  9. Isn't it awful we have to prove the validity of our marriages? I met my wife 10 months before we got married. We just KNEW we were right for each other... and now we're scared that THEY won't see that. How do you prove your relationship is real if the documentation you sent in isn't enough?? I know many couples who don't always take pictures of everything they do, we sure don't!

  11. So I sent in my wife and my brother-in-law's I-864 forms together with a tax return statement for the most recent year, and now we got this RFE saying they never got it. ?!?!?!

    What did you guys do with this form when you sent it in?

    It's possible it got lost somehow or it got mixed up with other forms... Do you have a copy of the I-864 you sent in originally and the tax return. I would probably send it in again along with copies of the tax return and w2(s) and other applicable documents...

    All we sent in was the I-864 for both my wife and my brother-in-law with a copy of their tax returns (form 1040A if I'm not mistaking)... maybe that wasn't enough :whistle: I also had to show proof that my brother-in-law is a US citizen... I'll go to H&R tomorrow and see what can be done.

    I'm scared and excited all at once. haha

    I'm on an M1 visa and about to send everything in (I-130 and I-485 packages). My school I-20 expires in 14 days though...

    If I send everything in today and things are pending, do I need to maintain my M-1 status and not worry about that I-20 expiration date? Or should I get an extension?

    I know this is something I should probably ask from an immigration lawyer but maybe someone else here has had experiences with that...

  13. Oops, I meant to say that the fees for I765 and I131 are waived, so yeah that means we still need to pay the 130 form, as well as 693.

    Is it standard procedure to send in form I-693 when it's pretty much blank? I only filled out the top part (name, address)... cause naturally I haven't gotten the doctor's appointment yet :rolleyes:

    We're confused about what needs to be paid and what fees are waived.

    We're about to send in our I130 and I485 packages. The I485 instructions say that if we file both packages together we don't have to pay the I-130 fee of $355. The fee for the travel document would also be waived. So what needs to be paid exactly? Only the I485 fee of $1010?

    also both packages would be sent to this address right?

    According to the guides, I (the foreign spouse) can use a copy of my passport instead of a birth certificate for the I-130 package, though am I correct in saying I can't do the same for the I-485 package?

    Is a birth certificate absolutely necessary? If yes I'll have to ask my parents to go to the city hall tomorrow to get one for me, which would delay things again... GAH!
